4.
Presentation and discussion of Open Meetings Act and Public Information Act.
City Secretary and Assistant to the City Manager Bobbie Jo Taylor presented training on the
Texas Open Meetings Act (TOMA), the Texas Public Information Act (PIA), state conflict of
interest law, and the City’s Code of Ethics and Conduct. She noted that she was not providing
legal advice. Commissioners received a packet containing a PIA election form for keeping
personal contact information confidential, a conflict of interest affidavit form, and the City’s
Planning and Zoning Regular
September 17, 2026
ethics policy acknowledgment. She asked any Commissioner without a PIA election form on
file to complete and return one, since without it a member’s contact information is public.
Ms. Taylor stated that the Planning and Zoning Commission was re-established by ordinance
in 2024 and serves as an advisory, recommending body to the City Council. It consists of five
members with staggered terms and two alternates. The Commission normally holds its
organizational meeting in July, so current terms will be short and officers will be elected again
in July 2027. The City Charter requires all meetings to follow TOMA. Each agenda must
include citizen comments and Commissioner comments, which are limited to items of
community interest. Consent agenda items are not discussed; any member may pull an item
from the consent agenda for discussion without a motion. The Commission may convene in
Executive Session only if that language is on the posted agenda.
Effective September 1, 2025, agendas must be posted three full business days before a
meeting, not counting the day of posting or the day of the meeting. An agenda must state the
date, hour, place, and each subject to be discussed. The date, time, or location cannot be
changed once posted; the agenda must be reposted. If an unposted issue is raised during
citizen comments or by a member, the Commission may not deliberate on it and should direct
the speaker to staff or place the item on a future agenda. Limited exceptions apply for
emergencies.
TOMA applies whenever a quorum (a simple majority, with alternates counting toward the
quorum) exchanges information about Commission business. It does not apply to purely social
gatherings, but discussing current, past, or potential Commission business among a quorum,
in person or by phone, email, text, or social media, creates an illegal walking quorum.
Penalties include a fine of up to $500, jail of up to six months, and voiding of the action taken.
In response to Commissioner questions, Ms. Taylor confirmed that past business also may not
be discussed by a quorum, and that a conversation between two members is not a walking
quorum unless it is relayed to a third member. Members who want an item placed on an
agenda should contact staff.
Under the PIA, public records include emails, social media posts, text messages, notes, and
messages sent from the dais. Commissioners are temporary custodians of any records in their
possession, including after leaving the Commission, and must keep them for the retention
period set by the Texas State Library and Archives Commission or send them to the City
Secretary. Failure to provide a record may result in disciplinary action. The City must respond
to requests within ten business days, and withholding information requires a request for an
Attorney General ruling.
Under Chapter 171 of the Texas Local Government Code, a member with a substantial interest
in a business entity or real property affected by an action must file a conflict of interest affidavit
with the City Secretary before the meeting begins and must abstain from discussion and
voting, leaving the dais while the item is considered. The interests of a spouse and of certain
relatives are treated as the member’s own. Violations may result in up to one year in jail, a fine
of up to $4,000, or both, and the City’s action may be voidable.
The City’s newly adopted Code of Ethics and Conduct applies to Council members, board and
commission members, candidates, and their spouses. It also requires members to disclose
conflicts of interest to the City Attorney, prohibits using a position for special privileges or
favors, and limits gifts to $50, with exceptions. The Community Development Director is the
Planning and Zoning Regular
September 17, 2026
Commission’s staff contact, except for open meetings and public information matters, which go
to the City Secretary. Members should not “reply all” to staff emails sent to the full
Commission. Consultants are considered staff under the policy. Members who have
contributed $250 or more to a Council member’s campaign must disclose it at appointment,
and that Council member must recuse from the appointment vote. Ethics complaints may be
filed only by Council members or staff. Mediation must be scheduled within ten days of a
complaint. Unresolved complaints are reviewed by the City Attorney and then by a threemember outside Board of Review, which reports within 15 business days. Council actions may
range from a finding of no merit to a written reprimand or a resolution of censure, and Council
may remove an appointed official by majority vote or require ethics training.
Ms. Taylor noted that an amendment to the ethics policy is on the upcoming City Council
agenda. If adopted, it would prohibit board and commission members and their family
members from applying for City or economic development grants, and an updated policy would
be distributed for signature.
In response to a question on the timing of conflict of interest disclosures, Ms. Taylor explained
that the state affidavit may be filed with the City Secretary at any time before the meeting is
called to order. Because the City’s ethics policy also requires notifying the City Attorney, who
does not attend Commission meetings, members should identify conflicts early; a voicemail to
the City Attorney is acceptable.
No action was taken on this item.
5.
Public hearing, consideration, and action on an ordinance amending Section 42-9,
“Rules of Construction and Definitions,” of Article I, “Applicability of Ordinance;” Section
42-22, “SF-2 Single Family Residential District,” Section 42-30, “RC Regional
Commercial District,” Section 42-32, “IND Industrial District,” and Section 42-36, “FN
Floodplain and Nature District,” of Article II, “Districts and Land Uses;” and Section 4245, “Additional Regulations for Special Uses;” of Article III, “Special Uses,” of Chapter
42, “Zoning,” of The Code of Ordinances, City of Alvarado, Texas, by adding definitions
and providing for regulations related to crematory, data center, food truck park, and
solar farm uses.
Community Development Director Justin French presented the item. He explained that Section
42-10 of the Zoning Ordinance requires new and unlisted uses to be brought to the
Commission for a recommendation to City Council. Crematory, data center, food truck park,
and solar farm uses are not currently listed in the ordinance, and the City has received
inquiries about them.
Mr. French reviewed the proposed definitions for crematory, data center, food truck park,
mortuary or funeral home, and solar farm. The ordinance currently lists where mortuary and
funeral home uses are permitted but does not define them. Because of that, the Zoning
Administrator determined that a proposed crematory could not be treated as a mortuary or
funeral home. The proposed mortuary or funeral home definition excludes crematory services.
He noted that a data center may include telephone exchange uses, which are already defined
in the ordinance and are less intensive, but a telephone exchange would not include a data
center.
Planning and Zoning Regular
September 17, 2026
Under the proposed use chart, crematories, data centers, and solar farms would be allowed
only in the IND Industrial District with approval of a Specific Use Permit (SUP). Food truck
parks would be allowed with SUP approval in the SF-2, RC, IND, and FN Districts and the
Downtown Overlay District. Mortuary or funeral home uses would remain permitted in the RC
District and the Downtown Overlay District, as under the current ordinance.
Commissioners asked about the effect of not adopting the definitions. Mr. French stated that
without them, particularly for data centers, an applicant could argue that the use is permitted or
is equivalent to a telephone exchange. Adopting the definitions now would put the City’s
regulations in place ahead of any possible state legislative changes. In response to a question
on the data center definition, Mr. French noted that data centers vary widely in size, from very
large facilities like one near Abilene to buildings comparable to the existing telephone
exchange downtown. He explained that the definition is intended to capture all data center
activities, and that under the proposed chart data centers would not be allowed in any district
other than IND, and there only with an SUP.
The Chair opened the public hearing at 6:58 p.m. No one spoke. The Chair closed the public
hearing at 6:58 p.m.
Commissioner Fuller moved to recommend approval of the ordinance as written.
Commissioner Neilan seconded the motion.
No opposition, No abstentions
Vote: Motion passed unanimously.
6.
Public hearing, consideration, and action on the application of Derek Williams with
Verdad Real Estate on behalf of Audit Link, LLC and J & J Superior for approval of a
zoning change from Agricultural (A) District to Regional Commercial (RC) District on
approximately 1.7135 acres known as portions of Tract 97 of the S. Morris Survey, A536, being approximately addressed at 124 Cecil Lane and 5537 E. Hwy 67. (7Eleven
Rezone - French)
Community Development Director Justin French presented the request. The subject site is at
the westernmost point of the City limits, at the northwest corner of the intersection near the two
existing convenience stores that voluntarily came into the City limits. The Future Land Use
Plan was recently amended to designate the two northern quadrants of the intersection as
Regional Mixed Use, which is consistent with the requested RC District. The portions of the
site inside the City limits are zoned Agricultural (A). The remainder is outside the City limits,
and an ordinance to annex it is expected to go to City Council. Annexed property is temporarily
zoned A until rezoned, so the Commission’s recommendation assumes the annexation is
approved and will be considered on the same Council agenda.
Mr. French reported that no notices were returned in support or opposition from property
owners within 200 feet of the site inside the City limits. Staff received one phone inquiry, and
the caller had no further comments after the request was explained.
A Commissioner asked why the property was being changed again after the earlier action. Mr.
French explained that the earlier action amended the Future Land Use Plan, a policy map in
Planning and Zoning Regular
September 17, 2026
the Comprehensive Plan adopted in March 2026, while this request amends the Zoning Map,
the regulatory tool that implements the plan. The Future Land Use Plan amendment allowed
the applicant to request a straight rezoning to RC rather than a rezoning to a neighborhood
commercial district plus an SUP. In response to a further question, he explained that the
Commission’s action is a recommendation to City Council, that the City Attorney has confirmed
this sequence is legally permissible, and that the City used the same approach for the Project
Inspire site.
The Chair opened the public hearing at 6:44 p.m. The applicant’s engineer of record from
Driver Engineering was present to answer questions. In response to a Commissioner question,
he stated that the existing building on the adjacent property, an old storage building formerly
used as a bait shop, will be demolished and that portion of the property will be acquired for the
7-Eleven. No one else spoke. The Chair closed the public hearing at 6:45 p.m.
Commissioner Reed moved to recommend approval of the zoning change from Agricultural (A)
District to Regional Commercial (RC) District as presented.
Commissioner Fuller seconded the motion.
No opposition, No abstentions
Vote: Motion passed unanimously.
Mr. French stated that City Council will consider the request at its October 19, 2026 meeting,
along with the annexation public hearing, assuming Council approves a resolution on
September 21, 2026 setting that hearing date.

NEW BUSINESS
1.
Consideration and action on the application of David Upton, PE with Kimley-Horn on
behalf of Wal-Mart Real Estate Business Trust for approval of the Inspire Addition final
plat on approximately 37.586 acres out of the J. Dixon Survey, A-214 and the W.M.
Balch Survey, A-48, approximately addressed at 6881 E. IH-35W and 602 Percifield
Trail. (Stringfellow)
Interim Community Development Director LaShondra Stringfellow presented the Inspire
Addition final plat. She noted that the annexation of the property is scheduled for City Council
consideration the following week, and that the Commission previously considered the rezoning
and preliminary plat for the property. Infrastructure plans have been approved. The plat covers
approximately 37.586 acres and includes one large lot for the Walmart store and five outlots
for future development. Access is provided by an internal access easement that functions as a
ring road, with one access point onto IH-35W and two access points onto US Highway 67.
Commissioners asked about right-of-way and a minor arterial shown on the City’s
Thoroughfare Plan. Ms. Stringfellow explained that the preliminary plat was submitted before
the Comprehensive Plan and Thoroughfare Plan were adopted; therefore, the development is
vested under state law and the City cannot require it to accommodate that alignment. She
noted that thoroughfare plan alignments are general until set through public hearings and
coordination with property owners, and that staff supports the layout because an alternative
route for the arterial can still be identified. US Highway 67 is a state roadway, and any future
expansion would be coordinated by the State with adjacent property owners; the site has
adequate land to accommodate it. She stated that the arterial alignment was the only item
affected by vesting and that the plat otherwise meets City code.
Commissioners relayed resident questions about possible future access through Percifield
Trail or a rear entrance for delivery trucks. Ms. Stringfellow explained that the development is
vested only to the design shown on this plat, and that the Commission’s recommendation
covers the lot layout and the access points shown. Any change would require a replat, which
would be subject to all current ordinances and plans and would return to the Commission and
City Council.
In response to a question about the location of the second US Highway 67 entrance, it was
noted that the entrance is located on the west side of the site, approximately 2,000 feet from
the nearest driveway to the west, and that the adjacent equipment rental business will receive
a new driveway tied into that entrance. It was also noted that an approximately 30-foot
retaining wall will be constructed behind the Walmart along the Percifield Trail side of the
property, where a pond is located; therefore, no driveway is planned there. The final plat is
scheduled for City Council consideration on Monday, October 19, 2026.

Agenda Item
Discuss and consider an application for a Preliminary Plat – Reata Commons, Lots 1–6, Block
A, approximately 20.819 acres zoned “NMU” (Neighborhood Mixed Use) District, located at the
southwest corner of U.S. Highway 67 (E. Henderson Street) and N. Cummings Drive, with the
approximate address being 723 N. Cummings Drive.
Applicant:
Property Owner:
Surveyor:
David Ferrette, Powell Family Group
Alvarado Reata LLC
Winkelmann & Associates, Inc.
Background & Findings
The applicant proposes to subdivide a 20.8-acre tract into 6 lots located at the southwest
corner of Highway 67 and N. Cummings Drive. The site is undeveloped and referred to as
Reata Ranch. It was rezoned from “A: (Agricultural) to “NMU” (Neighborhood Mixed Use)
District in July. The proposed plat includes five lots that are approximately 1 acre and one lot
that is approximately 16 acres. Fast food restaurants are proposed on the smaller lots with a
gas station on one of the lots. The largest lot is proposed to accommodate a 55,000-squarefoot medical office building. However, any use permitted in the NMU Neighborhood Mixed Use
district would be allowed.
The requirements for a preliminary plat are described in Sections 34-34 and 34-65 of Chapter
34 of the Code of Ordinances [Subdivision Regulations], with design standards in Article VI
(Sections 34-162 through 34-175) and adequacy of public facilities in Article VII (Sections 34206 through 34-218). Staff's findings are summarized below.
Requirement
Staff's Findings
Lot Area, Width, and Depth

Use district:
• Min. Area: 4,000 square
feet
• Min. Width: 50 feet
• Min. Depth: 80 feet (100
feet per Section 34167(e))
Proposed lots meet the minimum requirements:
• Lot 1: 40,876 square feet
• Lot 2: 38,551 square feet
• Lot 3: 37,006 square feet
• Lot 4: 69,746 square feet
• Lot 5: 684,211 square feet
• Lot 6: 36,472 square feet
Lots 1–3 are approximately 250 feet deep. All lots exceed
the minimum width and depth.

Requirement
Staff's Findings
Street Frontage
Lots 1–4 front U.S. Highway 67. Lots 4, 5, and 6 front N.
Cummings Drive. Each lot has at least 40 feet of street
frontage.
Access and Rights-of-Way
N. Cummings Drive – The Master Thoroughfare Plan
classifies N. Cummings Drive south of U.S. 67 as a Collector
(70-foot right-of-way, two-lane undivided). The plat shows a
called 60-foot right-of-way and a 5-foot dedication along the
640.67 feet of frontage, which provides 35 feet from the
centerline if the existing right-of-way is centered. One
driveway is proposed on N. Cummings Drive, aligned with
Hopper Street.
U.S. Highway 67 – U.S. Highway 67 is a TxDOT highway
with a 220-foot existing right-of-way. Staff recommends
eastbound right-turn lanes at both U.S. 67 driveways and at
the U.S. 67/N. Cummings Drive intersection. The applicant is
to acquire TxDOT approval for all access points, which could
impact the ultimate lot configuration.
Pedestrians – Although not shown on a plat, sidewalks will
be required along N. Cummings Drive. TxDOT would
determine the feasibility and allowance of sidewalks on
Highway 67.
Water
A 15-foot water and sanitary sewer easement runs along the
U.S. Highway 67 frontage, and 10-foot water easements are
shown within the site. Water system design is under staff
review with the civil plans.
Wastewater
A 20-foot sanitary sewer in a private drainage easement is
shown. Wastewater service design is under staff review with
the civil plans.
Drainage
The property is in FEMA Flood Zone X, outside the 0.2percent annual chance floodplain. The plat shows a
detention area on Lot 5, behind Lots 1 and 2, within a private
drainage easement. It is connected by private drainage
easements along the west boundary. Detention sizing and
outfall design are under staff review.
Plat Content
The applicable features are not fully delineated. The plat is
missing:
• the subdivision name, owner information, and a complete
date;
• a vertical datum;
• existing utility mains;
• easement purpose statements; and
• the Hopper Street label.
Parkland Dedication
No residential units are proposed. If residential units are
proposed later, the requirement will apply at that time.

Filing date: The plat was filed on October 27, 2026. The Planning and Zoning
Commission will consider the plat application on November 12, 2026.
City Council deadline: City Council must act within 30 days of the Commission's action
(Texas Local Government Code, Section 212.009).
Approval by inaction: A plat that is not approved, approved with conditions, or
disapproved within the required period is approved by operation of law (Texas Local
Government Code, Section 212.009).
Legal Review
Not applicable.
Recommendation
Staff recommends conditional approval subject to the following conditions:
1. Show the proposed subdivision name on the plat. (Chapter 34, Section 34-65(3)a)
2. Show the owner's name, address, and telephone number in the title block, replacing the
“CLIENT ADDRESS / CITY, TEXAS ZIP” placeholder. (Chapter 34, Section 34-65(5))
3. Complete the plat date, which currently reads “0.00.2026,” and label the scale as 1 inch
= 100 feet. (Chapter 34, Section 34-65 and 34-65(5))
4. Label the private access easement serving Lots 1 through 6 as a common access
easement with its width and dimensions shown on each segment. Widen it to a
minimum of 26 feet. Where it meets N. Cummings Drive, align it with Hopper Street. If
the U.S. Highway 67 access near the Lot 2/Lot 3 line identified in the Traffic Impact
Study is retained, extend the easement to the right-of-way at that location. (Chapter 34,
Section 34-175(b) and (d)(7)–(8))
5. Label Hopper Street. (Chapter 34, Sections 34-65(1)d, 34-65(2)b, and 34-164(f))
6. Label each easement as public or private and identify the grantee. (Chapter 34, Section
34-65(2)b)
7. Provide written confirmation from TxDOT, Fort Worth District, of the ultimate right-ofway along the U.S. Highway 67 frontage, including any corner clip at N. Cummings
Drive and any right-of-way for turn lanes. Where the ultimate right-of-way exceeds the
existing right-of-way, show and label it as the “Future Right-of-Way Line.” Required
yards are measured from that line. Lots along U.S. 67 may be adjusted to
accommodate it. (Chapter 34, Sections 34-163, 34-164(a) and (i), and 34-210; Chapter
42, Section 42-55(b)(1)f; Master Thoroughfare Plan, 2026 Comprehensive Plan)
8. Add a plat note stating that private access, drainage, and utility easements are
maintained by the lot owners or a property owners' association, not the City. (Chapter
34, Section 34-169(b))
City of Alvarado | City Council Meeting Management Report

9. Label the detention area as a private detention pond within a private drainage
easement, with dimensions. Show drainage easements covering the pond, its inflow,
and its outfall to an approved discharge point. (Chapter 34, Sections 34-65(2)b, and 34166)
10. The conditional approval is only applicable to the preliminary plat. The infrastructure
plans are administrative review and approval.

NMU Neighborhood Mixed
Use district:
• Min. Area: 4,000 square
feet
• Min. Width: 50 feet
• Min. Depth: 80 feet (100
feet per Section 34167(e))
Proposed lots meet the minimum requirements:
• Lot 1: 40,876 square feet
• Lot 2: 38,551 square feet
• Lot 3: 37,006 square feet
• Lot 4: 69,746 square feet
• Lot 5: 684,211 square feet
• Lot 6: 36,472 square feet
Lots 1–3 are approximately 250 feet deep. All lots exceed
the minimum width and depth.

Requirement
Staff's Findings
Street Frontage
Lots 1–4 front U.S. Highway 67. Lots 4, 5, and 6 front N.
Cummings Drive. Each lot has at least 40 feet of street
frontage.
Access and Rights-of-Way
N. Cummings Drive – The Master Thoroughfare Plan
classifies N. Cummings Drive south of U.S. 67 as a Collector
(70-foot right-of-way, two-lane undivided). The plat shows a
called 60-foot right-of-way and a 5-foot dedication along the
640.67 feet of frontage, which provides 35 feet from the
centerline if the existing right-of-way is centered. One
driveway is proposed on N. Cummings Drive, aligned with
Hopper Street.
U.S. Highway 67 – U.S. Highway 67 is a TxDOT highway
with a 220-foot existing right-of-way. Staff recommends
eastbound right-turn lanes at both U.S. 67 driveways and at
the U.S. 67/N. Cummings Drive intersection. The applicant is
to acquire TxDOT approval for all access points, which could
impact the ultimate lot configuration.
Pedestrians – Although not shown on a plat, sidewalks will
be required along N. Cummings Drive. TxDOT would
determine the feasibility and allowance of sidewalks on
Highway 67.
Water
A 15-foot water and sanitary sewer easement runs along the
U.S. Highway 67 frontage, and 10-foot water easements are
shown within the site. Water system design is under staff
review with the civil plans.
Wastewater
A 20-foot sanitary sewer in a private drainage easement is
shown. Wastewater service design is under staff review with
the civil plans.
Drainage
The property is in FEMA Flood Zone X, outside the 0.2percent annual chance floodplain. The plat shows a
detention area on Lot 5, behind Lots 1 and 2, within a private
drainage easement. It is connected by private drainage
easements along the west boundary. Detention sizing and
outfall design are under staff review.
Plat Content
The applicable features are not fully delineated. The plat is
missing:
• the subdivision name, owner information, and a complete
date;
• a vertical datum;
• existing utility mains;
• easement purpose statements; and
• the Hopper Street label.
Parkland Dedication
No residential units are proposed. If residential units are
proposed later, the requirement will apply at that time.
City of Alvarado | City Council Meeting Management Report
Page 2
It should be noted that water, wastewater, and drainage design are under staff review with the
infrastructure plans, which are reviewed and approved administratively. TxDOT approval is
required for all access points on U.S. Highway 67, which could affect the final lot configuration.
