Item Description: The applicant and property owner, Ubaldo Torres, requests approval of a replat for Lots
1R-5R, Block 2 and Lots 14R-16R, Block 3 of Torres Estates No. 1 Addition, consisting of eight (8)
single-family residential lots. The property is generally located northwest of the intersection of Cedar
Street and Wendell Avenue.
The proposed replat complies with the requirements outlined in Chapter 154 (Subdivisions) and Chapter
155 (Zoning) of the City’s Code of Ordinances. The City Council will consider this request on April 28,
2026, following a recommendation from the Planning and Zoning Commission.
DETAILED COMMISSION REPORT
Background & Technical Analysis: The subject property is currently platted as Lots 1-6, Block 2, and
Lots 13-16, Block 3, of the Original Town of Cleburne, totaling ten lots, as shown in Figure 1. The
proposed replat will reconfigure the properties into eight total lots for the construction of single-family
residences. The lots are currently zoned Single-Family Dwelling (SF-7) District and the minimum
dimensional standards are provided in Table 1 below:

PARKWAY, CASE ZC25-023.
Item Description: The applicant, KBC Advisors, represented by Hayes Stewart, requests to rezone
approximately 62.79 acres located north of County Road 1125 (Industrial Boulevard) from Agricultural
(A) District to Planned Development (PD) District. The City Council recently approved a voluntary
annexation request for this site on March 24, 2026.
The proposed PD includes a base zoning of Commercial/Industrial Flex (CI) District with certain
modifications as outlined in this report. The applicant has not identified a specific land use or site layout
for this property, as typically accompanies a PD request. Instead, the proposal establishes a regulatory
framework intended to allow a range of commercial and industrial uses allowing flexibility for future
development.
If approved as presented, site-specific details would be provided for staff review and approval through the
Detailed Site Plan process prior to development, rather than returning to the Planning and Zoning
Commission and City Council for consideration and approval through the public hearing process.
The City Council will consider this request on April 28, 2026, following a recommendation from the
Planning and Zoning Commission.

Existing Conditions: The subject property is located north of County Road 1125 (Industrial Boulevard),
approximately 0.25 miles west of the Chisholm Trail Parkway. The site is currently vacant and was
recently annexed into the City of Cleburne upon request of the property owner. All newly annexed
properties are assigned Agricultural (A) District zoning until a permanent classification is established
through the rezoning process.
Proposed Planned Development: The applicant requests Planned Development (PD) District zoning for
the subject site. If approved, all future development will be subject to the development standards
applicable to Commercial/Industrial Flex (CI) District, with the following modifications:
Permitted Land Uses: The applicant proposes to allow all uses permitted by right in the CI District, which
can be found in the attached Use Chart. The applicant proposes to prohibit the following uses which are
permitted by right in CI District: Bail Bond Services; Cemetery or Mausoleum, Gun Club, Skeet or Target
Range (Indoor); Heavy Load Vehicle Sales and Service; Pawn Shop; School (Career); School (K-12);
Seamstress or Tailor Shop; Shoe Repair Shop; Swimming Pool; and Taxi Garage or Dispatch.
In addition, the application proposes to prohibit the following uses, which require approval of a Specific
Use Permit (SUP) in CI District: Automobile Wrecker and Impound Lot, Crematorium, Funeral Home or
Mortuary, Gun Club, Skeet or Target Range (Outdoor); Halfway House; Penal and Correction Institutions;
Private Club; RV Park, and School (College or University).
Setbacks and Screening: A new single-family residential development known as Aberdeen Lakes is
planned and approved for the property immediately north of this site. Cattleman Drive will be extended
through the subject property, providing direct access to this subdivision. The Zoning Ordinance requires
additional screening and setbacks for non-residential development adjacent to residential development.
For CI District, the minimum side and rear yard setbacks increase from 5 feet to 25 feet when adjacent to
single-family properties. The applicant proposes to further increase these minimums to 10 feet (standard
setback) and 50 feet (when adjacent to single-family development) as part of the PD request.
Additionally, a masonry wall is required along the shared property line, with a minimum height of 6 feet.
The applicant proposes an increased height for this wall of 8 feet, to extend along the northern property
boundary adjacent to the Aberdeen Lakes development.
Landscaping: A 50-foot landscape buffer is proposed along the northern property line to accommodate
the proposed 50-foot building setback described above. This buffer area will include a double row of shade
trees planted at 30-foot spacing, exceeding the minimum requirements of the Zoning Ordinance.
Parking: The minimum parking requirement for industrial uses including Light Assembly and
Manufacturing Processes, Manufacturing or Industrial Operations, and Warehouse/Distribution is one
space per 1,000 square feet of gross floor area. For these uses, the applicant requests to reduce the
minimum parking requirement to one space per 2,500 square feet. All other uses would be subject to the
minimum parking requirements outlined in the Zoning Ordinance.
Building Design: The Zoning Ordinance outlines minimum building material and architectural
requirements dependent on the size and location of each structure. For buildings in the CI District, a
minimum of 20% window coverage is required for primary facades, and 10% window coverage is
required for secondary facades.
The applicant requests that Light Assembly and Manufacturing Processes, Manufacturing or Industrial
Operations, and Warehouse/Distribution uses be exempt from minimum window coverage requirements,
and have the ability to utilize modified design feature options including vertical articulation, material or
paint color variation, and form liner details.
PD Application Requirements: The Zoning Ordinance establishes the purpose of PD zoning as “to allow
for creative and exceptional design within a unique physical, natural, or market context where the
standards provided in the PD create a balance that compensates for any deviations from or reductions in
the standards required in this Zoning Ordinance.”
Section 155.5.08 requires submission of a PD Design Statement and Concept Plan that, at a minimum,
identify the proposed development framework, including land use distribution, development phasing,
transportation network and connectivity, stormwater management, utilities, building types, site design,
and physical characteristics of the property. The Concept Plan is intended to illustrate the full build-out of
the development and its integration with surrounding properties and infrastructure.
The Concept Plan submitted with this request shows the extension of Cattleman Drive and proposed
buffer, but it does not provide the level of detail required for a PD Concept Plan as listed above. Without
this detail, staff is unable to evaluate the full proposal for consistency with the requirements of the Zoning
Ordinance.
Engineering Design & Public Infrastructure:
Street Section: The subject property fronts Industrial Boulevard, a minor collector on the City’s Master
Thoroughfare Plan (MTP). In addition, the MTP shows an extension of Cattleman Drive, a proposed minor
collector, running north-south through this property in order to provide connection to the residential
development planned north of this site (Aberdeen Lakes). Both roadways have a minimum right-of-way
width requirement of 75 feet.
Public Utilities: This property is eligible for City water and sewer service. The developer will be required
to extend utilities at the time of development in accordance with City policy.
Drainage: At the time of development, this property will be required to provide detention/drainage
facilities in accordance with City policy.
Floodplain: This property is not located within the limits of the regulated floodplain.
Future Land Use Plan: The Future Land Use Plan designates the western portion of this site as MediumDensity Residential, and the eastern portion as Node. Medium-Density Residential is intended to provide
areas for detached single-family homes on traditionally sized lots. The secondary purpose is to provide
limited areas and locations for duplex, townhome, and nonresidential development that directly serves
adjacent neighborhoods. The CI District, and therefore the proposed PD, is not considered compatible
with this designation.
The purpose of the Node designation is to provide anchor development that serves large sectors of the city
and surrounding communities. This type of development is characterized by mixed-use areas centered
around a major intersection with nonresidential uses other than industrial that serve the daily needs of the
surrounding population, such as the Cleburne Station development or West Henderson corridor. The
secondary purpose is to provide areas for multi-family development. Encouraged uses include
commercial, retail, and office. The CI District and proposed PD are considered to have limited
compatibility with this designation.
Property Owner Notifications: A total of eleven property owners within 200 feet of the subject property
were notified of this request. Additionally, a zoning sign was posted on the property, and notice was
published in the newspaper and on the City’s website. As of the writing of this report, no letters of
opposition have been received by staff.
Requested Action: As a newly annexed property, the options below are available to the Planning and
Zoning Commission for action on this request:

Recommend approval of the PD request as presented.
Recommend approval of the PD request with modifications.
Table the request to a future meeting date to allow additional information to be submitted.
Recommend denial of the PD request, instead assigning Agricultural (A) District zoning as the
permanent zoning classification.

Item Description: The Henderson Street (HS) Overlay was established by City Council in 2022 to promote
high-quality development along the Henderson Street corridor, a key gateway through the City. The
overlay includes enhanced design regulations addressing building layout, architectural design,
landscaping, and parking, and prohibits certain automotive uses including repair, sales, and salvage.
The proposed text amendment adds a Specific Use Permit (SUP) requirement for new gasoline service
stations on properties located more than 300 feet west of Nolan River Road within the HS Overlay. This
area contains much of the remaining undeveloped land within the overlay, resulting in unique traffic and
access management considerations for high-volume automotive uses such as gas stations.
The SUP process provides additional City Council review and oversight through a public hearing process
prior to approval, allowing for evaluation of site design, access, circulation, and compatibility with
surrounding uses. This requirement would apply only to new development, as there are no existing or
approved gas stations within the affected area.
The City Council will consider this request on April 14, 2026, following a recommendation from the
Planning and Zoning Commission.
DETAILED COMMISSION REPORT
Existing Overlay: The Henderson Street Overlay (HS) was established in April 2022 as part of the
comprehensive update to the City’s Zoning Ordinance. The overlay includes all properties with frontage
on Henderson Street between the east and west junction with Highway 67.
Permitted land uses are governed by the underlying base zoning district of each property, which is
Regional Commercial (RC) District for most properties along this corridor. Certain land uses are
prohibited, including Automobile Body Shop, Automobile or Other Motorized Vehicle Sales and Service,
Automobile Salvage, Automobile Service Garage (Major), and Automobile Wrecker and Impound Lot.
Section 155.4.06.C of the Zoning Ordinance outlines the building and site design regulations that apply
to properties within the HS Overlay, in addition to base zoning requirements.
Proposed Amendment: The proposed amendment to Section 155.4.06.C adds a Specific Use Permit (SUP)
requirement for gas station uses as defined below. This use is currently permitted by right throughout the
overlay on properties zoned RC District.
Gasoline or Diesel Passenger Vehicle Filling or Service Station: Property used partly or entirely
for storing or dispensing flammable liquids, combustible liquids, liquefied flammable gas, or
flammable gas into the fuel tanks of passenger motor vehicles, including any associated use.
If approved, the SUP requirement would apply only to properties located more than 300 feet west of Nolan
River Road. This area contains much of the remaining undeveloped property within the HS Overlay and
serves as a key entry point from the U.S. Highway 67 interchange. No changes are proposed to existing
gas station uses or entitlements in the remainder of the HS Overlay.
Land Use Considerations: Gas stations differ from most commercial uses in that they generate higher
traffic volumes, frequent turning movements, multiple access points, and on-site vehicle stacking. Without
careful site design, these characteristics can create conflicts with adjacent development and impact
roadway operations along a high-traffic corridor.
In addition, the existing HS Overlay regulations emphasize a pedestrian-oriented development pattern,
making it difficult for new gas stations and auto-focused businesses to achieve compliance. For example,
parking is prohibited between a primary building and adjacent public street, and minimum window
coverage and architectural requirements can be challenging to integrate into typical gas station designs.
The SUP process provides a mechanism for site-specific review, allowing consideration of site design,
access, circulation, and compatibility with surrounding uses, and providing flexibility where appropriate.
SUP Process: The SUP process requires submission of an application, site plan, landscape plan, and
building elevations for review, followed by public hearings before the Planning and Zoning Commission
and City Council. City Council may vote to approve or deny any SUP request, and may apply conditions
to approval as necessary to mitigate any negative impacts.
Public Hearing Notifications: Notice of this proposed amendment and public hearing was provided in
accordance with State Law and the City’s Code of Ordinances, including publication in the newspaper
and on the City’s website. As of the writing of this report, staff has not received any written
correspondence in support or opposition to this request.
Previous Council Discussion/Action: In March 2026, the City Council discussed the HS Overlay and
directed staff to bring forward this amendment for consideration and public hearing.

WHEREAS, the City of Cleburne, Texas (“City”), is a home rule city acting under its
charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and
Chapter 9 of the Local Government Code; and
WHEREAS, the City Council is authorized under the Texas Local Government Code to
regulate land use, buildings, and business operations within the City in order to protect public
health, safety, and welfare; and
WHEREAS, the Henderson Street corridor serves as a key gateway into the City; and
WHEREAS, undeveloped properties along this corridor, particularly those located more
than 300 feet west of Nolan River Road, present unique development considerations related to
access management, traffic circulation, and public safety; and
WHEREAS, gasoline or diesel passenger vehicle filling and service stations have the
potential to generate high traffic volumes, frequent turning movements, and queuing that may
impact roadway operations and adjacent development patterns; and
WHEREAS, the City Council finds that requiring a Specific Use Permit (SUP) for such
uses provides an appropriate mechanism for case-by-case review of site design, access, circulation,
and compatibility with surrounding development to ensure protection of public health, safety, and
welfare; and
WHEREAS, public notice was given of the zoning text amendment as required by state
law; and

WHEREAS, a public hearing of the Planning and Zoning Commission, at which parties
in interest and citizens had an opportunity to be heard, was held on the 13th of April, 2026, after
due notice in the manner provided by law; and
WHEREAS, the Commission made a report to the City Council of the City of Cleburne,
Texas with a recommendation for approval of the zoning text amendment by a vote of __-__; and
WHEREAS, a public hearing in relation hereto at which parties in interest and citizens
had an opportunity to be heard was held by the City Council of the City of Cleburne, Texas on the
14th of April, 2026, after due notice in the manner provided by law; and
WHEREAS, the City has complied with all requirements of Chapter 211 of the Texas
Local Government Code, the Zoning Ordinance of the City, and all other applicable laws
governing notice, publication, and procedural requirements for the amendment of zoning
regulations; and
WHEREAS, the City Council therefore finds that it is in the best interest of the health,
safety, and welfare of its citizens to amend the regulations for the Henderson Street (HS) Overlay
to require a SUP for Gasoline or Diesel Passenger Vehicle Filling or Service Station uses.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CLEBURNE, TEXAS, THAT:
SECTION ONE. Subsection E “Certain Uses Restricted” of Section 4.06.C, “MS, Main Street
Overlay and HS, Henderson Street Overlay Standards” of Section 155.4, “Site Development
Requirements” of Appendix A, “Zoning Ordinance,” of the Cleburne, Texas Code of Ordinances
(hereinafter the “Code”), is hereby amended as follows:
A. A new subsection E.3 is inserted to read as follows:
“Within the HS, Henderson Street Overlay, a specific use permit (SUP) shall be required
for a Gasoline or Diesel Passenger Vehicle Filling or Service Station on any property
located more than 300 feet west of the centerline of Nolan River Road.”
B. Existing Subsections E.3 and E.4 are renumbered to become E.4 and E.5, respectively.
SECTION TWO. This Ordinance shall be cumulative of all provisions of ordinances and of the
Code of Cleburne, Texas, as amended, except where the provisions of this Ordinance are in direct
conflict with the provisions of such ordinances and such Code, in which event the conflicting
provisions of such ordinances and such Code are hereby repealed.
SECTION THREE. It is hereby declared to be the intention of the City Council that the phrases,
clauses, sentences, paragraphs, and sections of this Ordinance are severable, and if any phrase,
clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the
valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance,

since the same would have been enacted by the City Council without the incorporation in this
Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section.
SECTION FOUR. Any person, firm, or corporation violating any of the terms and provisions of
this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be
fined in accordance with Section 10.99 of the Code. Each day that a violation is permitted to exist
shall constitute a separate offense.
SECTION FIVE. The City Secretary of the City of Cleburne, Texas, is directed to publish the
caption, including the penalty of this Ordinance at least once within 10 days after its passage in
the official newspaper of the City of Cleburne, Texas, as authorized by Section 3.16 of the
Cleburne City Charter.
SECTION SIX. All rights and remedies of the City are expressly saved as to any and all violations
of the provisions of the Code of Ordinances, City of Cleburne, Texas, or any other ordinances
affecting the matters regulated herein that have accrued at the time of the effective date of this
Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal,
whether pending in court or not, under such ordinances same shall not be affected by this
Ordinance but may be prosecuted until final disposition by the courts.
SECTION SEVEN. This Ordinance shall be in full force and effect from and after its passage and
publication as required by law, and it is so ordained.

§ 155.4 SITE DEVELOPMENT REQUIREMENTS.
4.06. Overlay Regulations.
C. MS, Main Street Overlay and HS, Henderson Street Overlay standards.
1. Purpose and applicability.
a. The MS, Main Street Overlay and HS, Henderson Street Overlay do not apply to
property zoned for Residential Use, zoned I, Industrial District, or developed
as a public use or building or play field or stadium.
b. The requirements of this subsection are in addition to all other requirements
of Section 155.4. If there is a conflict between this subsection and another
requirement or provision of Section 155.4, the requirements of this section
will govern.
c. The boundaries of the MS, Main Street Overlay are shown in subsection 2.04.E
and the boundaries of the HS, Henderson Street Overlay are shown in
subsection 2.04.F.
2. Building design and layout.
a. Design requirements.
1) New buildings must be constructed so that parking is located to the
side or rear of the building and not between the building and the
street. For platted lots that are less than two acres or less than 65 feet
in width, the Zoning Administrator may approve one row of parking
between the building and the street.
2) Buildings at the corners of intersections must utilize corner features
that are a minimum of 15% higher than the remainder of the façade
and finished with a decorative cap or cornice that projects at least 12
inches from the building face. The corner feature must extend
between 15% and 25% of the length of the façade.
3) Buildings must provide window coverage according to the following:
a) A minimum of 35% windows on the front façade (defined as the
façade containing the primary building entrance);
b) A minimum of 30% windows on all primary façades (defined as
all façades that face a public street or right-of-way); and
c) A minimum of 20% windows on all secondary façades.
4) Of the window coverage required at least 60% must be transparent.
5) No more than 80% glass coverage is allowed on any façade.

6) A landscaped edge equal to 20 feet shall be provided along Main
Street and Henderson Street and equal to 15 feet along intersecting
streets that abut any lot or development with frontage along Main
Street and Henderson Street.
7) The landscaped edge may include any portion of the right-of-way
behind the curb if it meets the planting requirements below:
a) One shade tree or two ornamental trees per 30 feet, which may
be staggered; and
b) Sidewalks a minimum of six feet in width.
b. Building layout.
1) Development or redevelopment involving three or more buildings
must configure all buildings in the following manner:
a) Buildings must be laid out in blocks separated by internal
streets, driveways, or pedestrian pathways to provide internal
circulation;
b) Buildings must be designed to frame or enclose parking areas,
open space, and amenities so that such areas are not
predominantly situated along the public right-of- way and are
equally accessible and enjoyed by users of each building;
c) Building entrances must face the street or an internal common
area such as a courtyard or park.
2) Development or redevelopment involving one or two buildings
where the developed area is more than one acre, such as a shopping
center, must design parking lots, drive aisles, drainage facilities, and
underground utilities, to allow for future redevelopment of parking
areas into buildings that can be designed in a way that meets
subsection 4.06.C.2.b(1).
c. Administrative setback reduction.
1) The Zoning Administrator may reduce landscaping requirements by
50% for properties within the MS, Main Street Overlay that directly
abut Main Street between Kilpatrick Avenue and Poindexter Avenue.
2) The reduction may apply both to required plantings and required
depth of landscaping buffers.
d. The Zoning Administrator may approve a reduction in minimum setback
depth for properties in the MS, Main Street Overlay and HS, Henderson Street
Overlay if 50% or more of the buildings along both sides of the same block
have setbacks that are less than the minimum required setback on the lot

where the building is proposed. In granting a setback reduction, the Zoning
Administrator may not reduce the required landscape edge more than 50%
and may not approve a building setback closer to the right-of-way than the
median setback of all buildings along both sides of the same block.
e. Certain uses restricted.
1) Within the MS, Main Street Overlay, a certificate of occupancy will not
be issued for any of the following:
a) Automobile salvage;
b) Automobile wrecker and impound lot.
2) Within the HS, Henderson Street Overlay, a certificate of occupancy
will not be issued for any of the following:
a) Automobile body shop;
b) Automobile or other motorized vehicle sales and service;
c) Automobile salvage;
d) Automobile service garage (major);
e) Automobile wrecker and impound lot.
3) Within the HS, Henderson Street Overlay, a specific use permit (SUP)
shall be required for a Gasoline or Diesel Passenger Vehicle Filling or
Service Station on any property located more than 300 feet west of
the centerline of Nolan River Road.

Existing uses listed in subsection 4.06.C.2.e(1) will be treated as
nonconforming uses subject to subsection 3.07.
4)5)
A specific use permit (SUP) may be approved in accordance with
subsection 5.09 to secure a certificate of occupancy for a change in
ownership of a prohibited use listed in subsections 4.06.C.2.e(1) and
4.06.C.2.e(2) that is in existence prior to the adoption of this
ordinance. The following will be taken into consideration at time of
application for a specific use permit (SUP) under this subsection
