c.

Amendment to CEMC 2.48.340 — Maintenance of Cemetery Headstones
Mathew Bailey — Public Works Director
Director Bailey presented his staff report. The City of Cle Elum owns and operates Laurel Hill
Cemetery. Over time, cemetery headstones, monuments, and other memorials can and have
become displaced or knocked over due to various reasons including weather, ground
settlement, wild animals, vandalism, age, deterioration, or other circumstances. As part of
routine cemetery maintenance, it may be appropriate for City staff to reset or stabilize

headstones, monuments and other memorials when they are found lying on the ground or
leaning in an unsafe or unsightly manner. The existing Cle Elum Municipal Code Language
(CEMC), however, does not specifically address the City's authority to reset or stabilize fallen
or displaced grave markers, nor does it address circumstances where there is no known or
reachable person available to authorize the work. Therefore, staff recommends that the Public
Works and Community Development Committee recommend to City Council an amendment
to CEMC 2.48.340 to expressly authorize the City to reset, straighten, stabilize, secure,
relocate, or remove cemetery headstones, monuments, grave markers, and other structures
when necessary for cemetery maintenance, appearance, preservation, or public safety.
Chair Cook made a motion that the Public Works and Community Development Committee
recommend to City Council an amendment to CEMC 2.48.340 to expressly authorize the City
to reset, straighten, stabilize, secure, relocate, or remove cemetery headstones, monuments,
grave markers, and other structures when necessary for cemetery maintenance, appearance,
preservation, or public safety. Councilmember Ratliff seconded. Motion passed.
d.

Public Works Staffing Request – Three Full-Time Positions
Mathew Bailey — Public Works Director
Director Bailey presented the staff report. The City of Cle Elum has a significant backlog of
infrastructure construction and rehabilitation projects. At the same time, the City's Public Works
Department is responsible for the ongoing operation and maintenance of the City's water, sewer,
stormwater, streets, parks, airport, and cemetery systems. The current staffing level limits the
City's ability to move beyond routine maintenance and dedicate personnel to larger construction
projects. As a result, projects that could potentially be completed with City forces must compete
with daily operational demands or be contracted out.
Councilmember Ratliff moved that the committee recommend that City Council consider and
authorize the addition of Three Full-Time Public Works Positions for In-House Construction
and Capital Project Delivery. Councilmember Wallace seconded. Motion passed.

e.

Discussion of Draft Work Plan for Ad Hoc Data Center Committee
Chair Cook referred to his draft work plan documents included in the agenda packet.

AGENDA STAFF
REPORT

AGENDA DATE:

November 3, 2026

ACTION REQUESTED:

Approve the proposed 2027 garbage rate increases, effective January 1,
2027, as outlined in the attached rate schedule.

BACKGROUND:

The City reviews garbage rates to account for changes in waste collection,
disposal, and administrative costs. The proposed 2027 rate adjustments
are intended to help the City recover anticipated increases in these
expenses and maintain the financial sustainability of the garbage
collection program.
The proposed 2027 rate schedule includes an 8.8% increase to City
garbage rates, effective January 1, 2027. This adjustment accounts for
anticipated increases in the costs associated with providing garbage
collection services.
Kittitas County tipping fees have increased by an average of
approximately 9%. The City anticipates that a similar increase in County
tipping fees will occur in the upcoming year. These disposal costs are a
significant component of the overall expense of providing garbage
service and are a factor in the proposed rate adjustment.
The proposed rate calculations also account for an anticipated 4.5%
increase in Waste Management charges beginning in November 2026 and
an adjustment for the City's business and occupation (B&O) tax
calculation.
Additionally, the proposed schedule identifies a further 6% increase for
roll-off dumpster rates beyond the general 8.8% increase. This additional
adjustment accounts for the staff time required to establish, maintain, and
separately bill roll-off dumpster accounts.

RECOMMENDATION:

Approve the proposed 2027 garbage rate schedule, effective January 1,

AGENDA STAFF
REPORT

AGENDA DATE:

November 3, 2026

ACTION REQUESTED:

Approve the 3% increase to monthly water and sewer rates, effective
January 1, 2027, in accordance with the Cle Elum Municipal Code.

BACKGROUND:

The Cle Elum Municipal Code establishes annual rate increases for the
City's water and sewer utilities. These increases help support the ongoing
operation, maintenance, and financial sustainability of the City's utility
systems.
CEMC 13.12.100(B) requires all water rates and charges to increase by a
minimum of 3% annually, effective December 31, as established by City
Council resolution.
CEMC 13.08.370 requires monthly sewer base rates and usage charges
to increase annually by the higher of 3% or the applicable Consumer Price
Index (CPI) for the West region, using the August reference month
published in September. The annual increase is effective January 1.
For 2027, the City is proposing a 3% increase to both water and sewer
rates, effective January 1, 2027, consistent with the annual minimum
increase established in City Code.

RECOMMENDATION:

Approve a 3% increase to water and sewer rates, effective January 1, 2027

ACTION REQUESTED:

Amendment to CEMC 13.14.040 – Schedule of Equivalent Residential
Units (ERUs)

BACKGROUND:

The proposed amendment was previously discussed by the Public Works
Committee. CEMC 13.14.040 establishes the ERU values assigned to
different types of property uses. These values are used to calculate water
connection charges based on the estimated demand a property places on
the City's water system.
The existing schedule identifies ERU values for residential, commercial,
industrial, and other uses but does not specifically address accessory
dwelling units.
The proposed amendment adds two classifications for accessory dwelling
units to the ERU schedule:
• ADUs that do not require an additional water meter or sewer
connection: 0 ERUs.
• ADUs that require an additional water meter or sewer connection: 1
ERU.
The intent of this amendment is to help make ADU construction more
affordable by reducing utility connection charges when an additional
meter or connection is not required. This approach is intended to
encourage the development of ADUs while ensuring that charges reflect
the additional utility infrastructure needed to serve the property.
The amendment will provide clearer direction for City staff, property
owners, and applicants when determining applicable charges. The
proposed changes were previously discussed by the Public Works
Committee.

RECOMMENDATION:

Discuss and determine direction of current Public Works Committee.

Petition for and relief from utility bill.

In the event any person is aggrieved by the amount of one hundred dollars or more in excess of the amount billed
for monthly water and sewer service, they may, within fifteen days of the postmark on said bill, petition the city
council in writing to the utilities clerk for a downward adjustment to their bill. Upon receipt of such petition, the
utilities clerk shall notify the public works director and the public works committee and schedule a meeting to
consider the petition for downward adjustment. The public works committee may consult with the city staff
regarding the matter and shall, upon deliberation and oral findings following the meeting, make a
recommendation to the entire city council to grant a downward adjustment only upon good cause shown. No
downward adjustment will be considered for leaks within the primary residential or commercial building; however,
adjustment for leaks within crawlspaces may be considered on a case-by-case basis. Any bill granted a downward
adjustment by the city council shall include both water and sewer totals and shall not exceed one thousand dollars
in relief and shall be presented to the mayor for signature on the face thereof. Notice of the reduction shall be
provided in writing by the city to the customer. No ratepayer may petition the city council more than one time per
twelve-month period for such a downward adjustment. In the event that city-maintained water pipes prevent
water service to a customer’s water meter due to cold or frozen weather for more than two days (forty-eight
hours), the city council may, upon the recommendation of the city public works director and the public works
committee, provide equitable relief to the customer by crediting up to one month’s water fees which include water
base rate fee, water reserve fee, and applicable water taxes for every two to thirty days of interrupted service, or
multiples thereof. In the event any neighbor assists a customer with frozen, city-maintained water service by
providing water through that neighbor’s meter (i.e., through the use of a hose or similar apparatus), that neighbor
will be allocated double the volume of water in the base rate for the same period of interrupted service.
