555 BASALT AVENUE SPECIAL REVIEW
FIERSTEIN RECUSED. QUORUM REMAINS, 5 PLANNING AND ZONING MEMBERS PRESENT.
Lindt gave a background of the proposed development application, and introduced Mareike Blodgett and
Justin Fries from the development team representing the Applicant, MREH LLC. This is a continued public

hearing. Staff has identified that in addition to a special review application for the proposed development,
an amendment to the Master Plan, specifically the Future Land Use Map (FLUM) and the Typology
Designation would be required. The 4.8 acre site is located in the Basalt Business Center (BBC) South
Planned Unit Development. The proposal includes 54 storage spaces and 48 multi-family residential units
across 3 multi-family buildings.
Staff has included draft language for a resolution for the associated Master Plan amendments. The draft
resolution would amend the FLUM to accommodate the new proposed uses on the site and amend the
Typology Designation on the property to permit the residential to be separate from the commercial
component.
Planning and Zoning Commission requested additional materials at the February 3rd meeting, the applicant
has provided updated elevations, an updated traffic report, and additional analysis around East Cody Lane,
the applicant has received a conceptual approval from CDOT for an increase in the number of permitted
trips to East Cody Lane.
Staff has provided a list of review items for consideration 1) Consistency with the Master Plan; 2) Level
and Mix of Affordable Housing Mitigation; 3) Exterior Storage Waiver; 4) Compatibility of Proposed Use;
5) Building Height; 6) Pedestrian Connectivity; 7) Fiou Lane; 8) Access Road to East Cody Lane; 9) Traffic;
10) Southside Floodplain; 11) Green Building/Wildfire Mitigation.
Lindt reviewed consistency with the Master Plan and FLUM (Future Land Use Map). The proposed use
was not envisioned with the previous Master Plan and requires the Master Plan Amendment as proposed
in the resolution in the packet..
Lindt reviewed consistency with the affordable housing standards. Lindt reviewed requests as presented
to BACH. BACH encouraged the applicant to accommodate larger units, and did not support the storage
waiver that was requested. It was discussed that the Applicant amended the proposal to combine units
to create a two-bedroom deed restricted units. Lindt noted that the Applicant changed the proposal such
that the affordable housing units are now proposed to be for-sale units. BACH was supportive of the forsale product and suggested increasing the category for deed-restrictions to Category 3, on average. BACH
reviewed and recommended approval of the housing development program.
A second traffic count was conducted since the February 3rd meeting of the Planning Commission. The
second traffic count was higher than the initial traffic count conducted, further substantiating the traffic
conclusions made by the applicant team. Additionally, the applicant’s traffic consultant joined the call to
provide additional detail related to queuing for the traffic created on East Cody Lane.
Staff has suggested that a third party traffic consultant be engaged to create a recommendation for Fiou
Lane, as well as a condition that the Applicant provide a 10’ easement along Fiou for potential future
construction.
Lindt noted that residential and storage are supported uses with residential being a special review use
that requires review at P&Z and approval at Town Council. Lindt reiterated P&Z comments from the
January 20th meeting, which noted that storage shall remain as storage, and shared that Staff has included
a condition to this effect.

2

Lindt suggested the Commission 1) consider applicant comments; 2) hear traffic comments from Jim
Charlier; 3) take public comment; 4) provide Commissioner discussion; 5) respond to the provided
conditions.
Staff has provided several options for the P&Z, including approving with the draft conditions, approving
with changes to the draft conditions, denying the application, or referring the application back to Staff for
further development.
The applicant team began their presentation and response. Justin Fries from Studio DH introduced
himself and the application.
Fries responded to the concerns from the January 20th and February 3rd meetings, and shared colored
renderings with consideration given to materiality. Fries noted that the traffic concerns have been further
researched and considered since the last meeting.
Fries showed the FEMA floodplain and reviewed the site plan’s accommodation of floodwater in a 100year event.
Fries reviewed the updated PUD amendment language and table of uses.
Fries shared the changes to the unit mix and sizes, to accommodate the BACH Committee’s suggested
changes. Fries also showed the storage added in the site plan.
Fries presented the cross-sections of the multi-family building showing the 35’ height with the 3’ parapet
and sloping roof height and noted the Code allowance for the height including the elevator overrun.
Fries presented the proposed traffic flow as designed on Cody Lane. Fries presented photographs of the
space along Cody Lane where the pedestrian improvements could be considered, Fries also noted the
existing utilities and drainage concerns in the area.
Fries reviewed the concerns with the Fiou Lane expansion. The applicant is willing to consider either
expansion or limiting the roadway to a one-way.
Fries shared that CDOT was in support of the traffic engineer’s assessment, which would allow an increase
in vehicle trips by allowing egress for the residential use to Cody Lane. CDOT approved the conceptual
design.
Fries presented some precedent imagery for the architectural design in regard to architecture, color, and
materiality. Fries compared and contrasted the new renderings with the precedent imagery, noting the
changes to the fascia, and the use of exposed steel on the residential product.

COMMISSIONER QUESTIONS
Hirschfeld asked whether the storage units would be for sale or for rent. Fries responded that the storage
units would be sold.
Leavitt asked what the FTE created would be from the storage portion of the site. Fries responded that 9
FTE were identified.

3

Horvath asked whether the project would pay into the roundabout project and what would initiate the
construction of the roundabout. Lindt responded that the Applicant would be required to pay toward the
fund and there is no specific trigger, but rather the fund will grow until Staff is directed to begin design.
Vozick asked whether any of the existing infrastructure could be reused.
Vozick asked whether there would be any issues with meeting the SBRs/green building regulations.
Leavitt asked staff if this was a mixed unit development as imagined in the Master Plan what the project
may look like. Thibeault responded that the Master Plan is not that prescriptive.
Vozick clarified that the discount for mixed-use mitigation results in three fewer affordable housing units
than if they were required to mitigate for both the commercial and residential components of the
development. Lindt confirmed.
Horvath asked for the traffic engineer to respond to the traffic design whereby traffic is directed away
from Fiou but increased on Cody. Curtis Rowe responded that the shift of the residential traffic to Cody
Lane, provides a benefit by queuing vehicles at an intersection that includes a stop sign, additionally the
reduction of traffic on Fiou Lane will improve the functionality of Fiou and the Fiou/Basalt Avenue
intersection. Horvath asked how many vehicles could be accommodated in the left turn lane. Rowe
responded that 4-5 cars could be accommodated right now, however the design for this intersection is
envisioned to change with the addition of a roundabout.

PUBLIC COMMENT opened at 6:48pm
Andy Rothchild at 409 Meadow View Lane
Rothchild was not aware of the application until recently. He added that the current 8’ privacy fence has
been a benefit to the neighborhood, he would support a retention or replacement of the privacy fence.
He additionally noted that Fiou Lane is an important access to the Southside neighborhood, and would
support two-way traffic without increasing the traffic on Fiou.

Stacey Stokes at 221 East Fiou
Lives on the corner of Fiou Lane and Alexander. Stokes supports a one way for Fiou Lane beyond the
daycare, and doesn’t support a two way. Stokes believes that a 6 foot wide hard surface path would an
ideal way to create the ability for wider vehicle travel ways in an emergency. Feeling that two lane road
would increase traffic in the area. Stokes supports a stop sign and a further developed one way with
emergency infrastructure to accommodate for emergencies.

John Fitzpatrick
John Fitzpatrick of BBC East shared that he feels the traffic study does not address the additional trips
onto Cody Lane. Fitzpatrick wished that the traffic engineer respond to the number of trips created by

4

the residential use. Fitzpatrick shared concerns with ped/bike conflict at the Cody Lane intersection with
Basalt Avenue, and shared that he believed that another form of egress is needed for Southside Basalt.
PUBLIC COMMENT CLOSED AT 6:57PM
Rowe responded that the current volume for Cody Lane is 132 trips per hour and would increase by 26
trips per hour to 158 trips per hour, or a little under 3 trips/min. The intersection with Basalt Avenue
would still perform at a service level A, and the access to Cody for residential vehicle users would improve
system efficiency.

COMMISSIONER COMMENTS
Horvath supported the construction of residential units proximate to the RFTA station. Horvath asked
what the desired outcome would be for a third-party traffic study on Fiou Lane. Lindt responded that the
goal would be to analyze the alternatives between one-way and two-way traffic, while also
accommodating pedestrian and multi-modal traffic. Thibeault added that the Town is trying to add some
scientific support for a recommendation in order to not pit the wishes of the neighbors against the design
directives of the Public Works Design Manual. Horvath supported a hard surface path along Fiou Lane to
accommodate multi-modal travel and use in the case of an emergency.
Maron thanked the applicant for the revised elevations and care that the team gave to updating the
design. Maron acknowledged and supported the increased livability of the units especially with regard to
size and storage. Maron supports a third party study, but would like to see the condition updated to note
AASHTO Green Book best practices and better acknowledge multi-modal transport. Maron has no issues
with height accommodation. Maron supports the draft conditions including the Master Plan amendments.
Leavitt is stuck on the Master Plan amendments, and has a concern with not including commercial space
to new residential. Leavitt would like to see the storage reconsidered and commercial included.
Hirschfeld believes that the Fiou Lane issue is legitimate but an aside from this review. Hirschfeld is in
support of a one-way for Fiou. Hirschfeld believes that the amount of deed-restricted affordable housing
should be 50% at a minimum.
Vozick stated that a third party study would be great. Vozick does not support storage or the need in the
community, and questions whether storage is the best usage for the site.
Horvath stated that he supports additional affordable housing.
Maron noted that the application meets the review criteria. Leavitt clarified that the Master Plan
amendment is not by right at the moment.
Hirschfeld responded that there may not be the demand for industrial uses in this town. Maron
responded.
Vozick further emphasized his disapproval for a storage use.
Maron noted that the disapproval of the storage use could be included as a draft condition.

5

Thibeault noted that the value of the housing, the will to see Fiou Lane studied should be included for the
benefit of Council.
Horvath asked the applicant why the HOA did not support the storage to be used as a primary place of
business. Fries responded that the HOA was not willing to support primary place of business as it may
increase traffic.
Hirschfeld asked whether the applicant explored additional deed restricted housing. Fries responded that
the applicant did not explore additional deed restricted housing as part of the pro forma.
Thibeault noted that Staff needs two motions, one for the special review and PUD amendment and a
separate motion for the Master Plan amendment.

M/S MARON AND HORVATH TO RECOMMEND FOR APPROVAL OF THE SPECIAL REVIEW AND PUD
AMENDMENT TO COUNCIL WITH THE CONDITIONS PRESENTED AND CONSIDERATION GIVEN TO MULTIMODAL TRANSPORTATION AND THE NEED FOR A THIRD PARTY EVALUATION FOR FIOU LANE. MOTION
PASSES 3-2.
M/S HIRSCHFELD TO APPROVE A RESOLUTION FOR THE MASTER PLAN AMENDMENT TO AMEND THE
MASTER PLAN TO RESIDENTIAL ON THE NORTHERN PORTION OF THE SITE WITH THE CONDITION THAT
THE RESIDENTIAL USE INCLUDE A GREATER PERCENTAGE OF DEED-RESTRICTED HOUSING (UP TO 50%)
AND A PREFERENCE FOR MIXED-USE ON THE NORTHERN PARCEL. MOTION PASSES 4-1, MARON IN
OPPOSITION.

PUBLIC HEARING – MIDLAND AVENUE DESIGN GUIDELINES
Henry provided an introduction to the Midland Avenue District Design Guidelines. Staff requested that
Planning and Zoning Commission provide constructive feedback on the design guidelines and provide a
recommendation to Town Council.
The design guidelines include a number of design and architectural considerations in the proposed
Midland Avenue District.
Hubbard introduced the GMSHAY team and their experience in historic preservation and design guidelines
for historic districts. Hubbard reviewed the concept of design guidelines with the Commission, and
reviewed their application in the Town of Basalt. Hubbard also reviewed the outline of the guidelines
including the chapters: 1) Introduction; 2) History & Character of Midland Avenue; 3) Treatment of Existing
Buildings; 4) Site Development – New Construction; 5) Architecture – New Construction; 6) Sustainable
Design; 7) Review Processes.
Hubbard reviewed the revisions and additions to the design guidelines since the January 6, 2026 P&Z
meeting, updates to Sections 4.1, 4.3, 4.5, 4.6, and 4.8. Updates included the addition of a checklist,
removal of the open space maximum, revision of language around building placement, open space, active
frontages and compatible infill, revisions to overhang and awning design requirements, the addition of
landscaping guidelines with input from the Town Arborist, and revisions to sidewalks, including language
regarding water mitigation.
6

COMMISSIONER QUESTIONS
Maron shared support for the document.
Fierstein asked whether the WUI regulations were discussed. Henry added that any State regulations
would still be required. Thibeault added that tree removal permits are still required, and noted that the
Town Arborist reviewed the landscaping standards and requirements included.
Hirschfeld shared that she doesn’t remember all of the items suggested at the work session, but believes
that the draft looks good.
M/S MARON AND LEAVITT TO RECOMMEND APPROVAL OF THE MIDLAND AVENUE DISTRICT DESIGN
GUIDELINES. MOTION PASSES 6-0, UNANIMOUSLY.
COMMISSIONER COMMENTS AND STAFF UPDATES
Thibeault noted that the Cliff’s Hillside Park Renovation RFP submittal period ends on Friday, 2/27. Henry
noted that the Planning and Zoning Commission would be reviewing a land use application for 540 Basalt
Avenue in the coming weeks for a proposed deed-restricted dwelling unit. Lindt updated the Commission
regarding the Land Use Code update and associated working group meetings. Leavitt asked for an update
on the Black Mountain (Jadwin) project; Lindt shared that he had heard from the development team,
which is preparing for Final Plan submittal, which will be heard by Planning and Zoning again. Lindt shared
that the next P&Z meeting is scheduled for March 3, 2026.

Work Session: Land Use Code Update – Design Workshop
Commissioner Comments and Staff Updates
Adjourn

MEETING CALLED TO ORDER AT 6:08PM
LAND USE CODE UPDATE – DESIGN WORKSHOP
Lindt provided a brief background on the Land Use Code Update Project. Staff contracted Design
Workshop in 2025 to undertake a full-scale Land Use Code review and amendments suggested through
the update.
Jessica Garrow from Design Workshop introduced herself and the impetus for the Land Use Code update.
Garrow introduced Design Workshop and their planning practice. Garrow noted that Weber is also
supporting the Design Workshop team on the ADU Code and Housing Mitigation project.
Weber shared the project scope and schedule. The project began in June and the team is presenting the
50% draft at this meeting. The team will return with a 90% draft at a future meeting for review by the
Planning and Zoning Commission.
Weber presented the guiding principles for the project:
1)
2)
3)
4)
5)

Creating a code that is clear and does not require further interpretation
Articulate the “why” in regulations
Provide clear processes that do not over-complicate reviews
Include clear language and enforcement options
Reinforce the ideas of sustainability that are in the Master Plan and coordinate with other ongoing Town efforts

6) Build off the Master Plan process and engagement; do not duplicate those efforts

Weber covered the high priority topics for the project including 1) code organization & usability; 2)
integration of ongoing amendments (housing and historic preservation related; 3) community character
& design; 4) annexation, PUD, and subdivision standards; 5) zoning map and district alignment
The 50% draft is broken into three parts, simple & structural, administrative processes & enforcement,
and new policy concepts.
These code updates align with goals and objectives found in the 2020 Master Plan including affordable &
inclusive living goals.
Weber showed the updated table of contents with the movement of Annexations from Chapter 15 to
Chapter 14 (currently reserved), and the addition of a ‘Development’ related chapter as Chapter 16.
Weber also showed how the proposed update consolidated and simplified the existing chapter structure
for the Land Use Code related chapters Chapter 14-17.
Garrow reviewed the changes to the Annexation chapter, including relevant state statute changes.
Additionally, Design Workshop added applicability standards and review criteria; the team hopes to
provide flow charts and graphics at the 90% draft stage.
Garrow reviewed the changes to Chapter 15 Zoning. The major change includes relocating all district
related standards and definitions into a singular location. Additionally, cannabis and natural medicine
sections have been moved to Chapter 6. Garrow also reviewed new policy concepts added to the Zoning
chapter including categorization of land uses, the process of conditional uses in residential, commercial,
and industrial districts. Garrow reviewed changes to adult businesses and the consolidation of adult
businesses, the addition of language related to formula businesses, and the transition away from the
developing resource district to a legacy zone district.
Garrow reviewed the addition of Chapter 16 Developments. The Development chapter aims to establish
a uniform location for standards, processes, etc. related to development proposals or applications.
Garrow made note of the inclusion of language to bring the Town into compliance with Prop. 123 related
to incentives for affordable housing. The update also includes changes to the approval of insubstantial
PUD amendments, the inclusion of parking reduction criteria for mixed-use development, administrative
approval for parking reductions, and more. The team has also added new approval standards and criteria
for PUDs. Additionally, Chapter 16 includes the new ADU language, the relocated natural and
environmental hazards language, new processes related to conditional uses and special use reviews, and
Prop. 123 language.
Garrow reviewed the changes to Chapter 17 Subdivisions. Definitions have been relocated to Chapter 15,
Technical Review Committee standards have been relocated to Chapter 2, and common development
procedures have been relocated to Chapter 16.
COMMISSIONER COMMENTS AND QUESTIONS
Hirschfeld asked whether the Midland Design Guidelines are included in the Code update. Lindt responded
that the two projects are separate. Garrow noted that the team aims to incorporate.
2

Maron commented that he’s uncomfortable with discouraging affordable housing. Maron clarified that
his comment comes from support for parking reductions for affordable housing regardless of proximity to
transit. Garrow noted that the guidance for this item comes from the Master Plan.
Maron further elaborated that the Code should include more prescriptive language such as “shall/must”
and not just a nod to the Master Plan at the beginning of land use related chapters.
Maron also shared his opposition to approving ADUs without residency requirements.
Vozick asked whether residency requirements are included in the Code anywhere. Lindt answered that
Town Council has elected not to add additional requirements on top of the initial deed-restriction.
Leavitt asked whether this is the appropriate place to discuss residency requirements. Maron, Vozick, and
Hirschfeld shared a similar concern. Garrow responded that the Code is the appropriate place to include
those requirements and further expressed the tools available through the land use code to regulate
residency standards.
Maron noted that data center land use should be included and considered in this Code update. Garrow
noted that the team could include that land use as an industrial use, and add special review requirements
such as a Council approval.
Maron also shared his desire for the inclusion of historic preservation demolition standards.
Maron also stated that he supports parking reductions for proximity to transit.
Hirschfeld noted that the Town does not have local historic preservation like Telluride or Aspen.
Lindt noted the voluntary nature of the residential historic designation.
Vozick agrees that historic preservation and demolition should be included.
Leavitt asked whether affordable housing and workforce housing are used interchangeably. Garrow
answered that without deed-restrictions, she does not professionally believe that workforce housing is
the same or interchangeable with affordable housing. Lindt added that our guidelines consider housing
with deed restrictions to be interpreted as community housing. Leavitt specified his concerns with
units/developments pitched to the Town as workforce or attainable housing.
Leavitt asked whether there is a standard for the frequency of Land Use Code updates. Thibeault
responded.
Hirschfeld questioned the whole data center designation and noted the concern with water usage.
Hirschfeld stated that the update should discourage the use of data centers.
Vozick responded to the discussion item related to formula businesses. Thibeault responded that the C2
Zone District would prohibit formula businesses. Garrow noted that Telluride prohibits formula
businesses of which there are three or more and that Aspen prohibits formula businesses with 10 or more.
Aspen allows for a conditional use review. Garrow asked whether there was a preference for defining
formula businesses. Vozick expressed support for a prohibition on Midland or in the C2.
Garrow asked for further clarification on the parking reductions piece. Garrow stated that as written a
parking reduction of up to 25% could be considered for proximity to transit, and reviewed several other
3

opportunities to reduce parking minimums. Maron shared support for reducing parking minimums.
Hirschfeld asked what defines proximity; Garrow answered that ¼ to ½ mile is generally considered.
Garrow reviewed the next steps between the 50% draft and the 90% draft for adoption of the Land Use
Code.

COMMISSIONER COMMENTS AND STAFF UPDATES
Thibeault shared that the Town Council candidates forums was held on March 2, 2026, and a video of the
forum was recorded by Grassroots TV.
Lindt noted that the next meeting would be March 17th, which would a public hearing on 540 Basalt
Avenue, and no meeting will be held on April 7th.
Henry added that 72 Sunset Drive would be required to notice for public hearing should it return to
Planning and Zoning Commission. Henry also shared that the Town received 5 proposals for the Cliff’s
Hillside Park Renovation Project, with interviews upcoming.
Thibeault added that 18 grant applications were submitted for Town of Basalt (BPAC) grants for 2026.
Additionally, the Town has posted a call to artists for art installations in Willits, as a follow-up to the
Midland Avenue installations in 2025.
Thibeault also noted that Council would be hearing a work session on the State Wildfire Urban Interface
Code.
Leavitt asked whether there was an update on the non-compliant exterior lighting at FedEx along Willits
Lane. Lindt responded that Town staff had sent a compliance letter as of March 3, 2026.

Background

The property contains 7,838 sf and is located at the northwest corner of Basalt
Avenue and Fiou Lane in the Industrial Zone District and the Basalt Business
Center South (BBCS) PUD. The property is bordered by mixed-use properties to
the north and to the west, with commercial, residential, and industrial uses in the
general vicinity. The Southside Floodplain runs through the site, however no
changes to the building envelope or footprint are proposed as part of this
application.
Currently, the site is mixed-use in nature, with the Rug Wash on the ground floor,
and an existing residential unit. The Applicant has proposed the addition of a 659
sf two-bedroom residential unit to be deed-restricted at Category 5. The property
currently contains one 758 sf two-bedroom residential unit, which is proposed to
remain.
III.

Review Process

The review process requires a review from the Basalt Affordable and Community
Housing (BACH) Commission. BACH is a referral agency on land use
applications that provide deed-restricted housing, tasked with producing a
recommendation to Council regarding compliance with the Housing Guidelines
and the land use code requirements. On February 26, 2026, BACH reviewed the
application with consideration given to 1) consistency with the Master Plan; 2) the
level of affordable housing mitigation; 3) the proposed unit mix; 4) compliance
with the minimum livability requirements found in the Community Housing
Guidelines; 5) the proposed occupancy priorities; and 6) storage and bicycle
storage.
The proposed PUD Amendment requires review by the Planning and Zoning
Commission, and a recommendation to the Town Council for decision pursuant
to Town Code Section 16-65(d)(6), Planned Unit Development; Approval
Procedures; Effect of Approvals. In the event of a denial by the Planning and
Zoning Commission, the Applicant could appeal the denial by the Planning and
Zoning Commission to the Town Council. The Special Review and Site Plan
Review also require the Planning and Zoning Commission’s review and
recommendation to the Town Council. Staff has provided a draft conditions for
the Planning and Zoning Commission for consideration and discussion.
IV.

Discussion Items

Consistency with the Master Plan:
The site is located completely within the Town’s Urban Growth Boundary (UGB).
The site has been amended to accommodate the existing residential use. The
2020 Basalt Master Plan includes a designation of “existing land use” on the site
on the Future Land Use Map.
2

Staff believes that the following goals and objectives in the Master Plan may be
applicable to the proposed development:
Goals:
2.1: Provide housing that services residents
demographics, incomes and collective needs.

across a range of

2.3: Promote the development of innovative and diverse housing types
close to existing and planned commercial and transit centers.
4.2: Place high value on mixed use and live/work arrangements.
Objectives:
2.B Promote affordability of living and diversity of housing types including
market rate housing.
2.Z. Ensure that development projects approved or recommended for
approval by the Town incorporate walkability, access to services and parks
and reduce dependencies on personal vehicles.
3.J. Promote housing development to have bicycle- and pedestrian
orientation by encouraging housing development at high connectivity areas
(e.g. near the regional trail system or RFTA stops that have safe pedestrian
and bicycle crossings).
4.E. Encourage projects that incorporate mixed use and live/work concepts,
provided these projects are consistent with the other community goals
outlined in this document.
7.L. Strongly support workforce housing that accommodates lifestyles for
the next generation of workers, and that is near or incorporated into
workplaces.
Level of AH Mitigation: The Applicant proposes one (1) residential unit, proposed
to be a deed-restricted Category 5 unit. The two-bedroom deed-restricted unit is
proposed to be 659 sf. No additional commercial, industrial, or market-rate
residential square footage is proposed as part of this application.
Unit Mix: The Applicant proposes one (1) residential unit, proposed to be a
deed-restricted Category 5 unit. The 2024 Housing Needs Assessment indicates
a need for deed-restricted units in all income categories and sizes. As the unit is
not proposed as mitigation for any new free-market residential or commercial
development, it is not subject to the requirement to average Category 2.

3

Compliance with the Minimum Livability Requirements in Community Housing
Guidelines: The proposed units meet the Town’s Community Housing Guideline
requirements in regard to:
• unit size
• kitchen size,
• facility requirements,
• livability requirements,
• kitchen and bathroom amenities (i.e. bathtubs in the units),
• private open space is proposed to be provided in a shared deck space of
564 sf. The Applicant has not provided detailed information regarding
exterior storage for the proposed residential unit. As the property is in the
floodplain, it is noted that the Town Code requires any development not
increase the base flood elevation; the Applicant has not proposed any
change to the building footprint.
Alternatives for providing storage may include:
•
•

removing or reducing the size of some of the units and incorporating
exterior storage on the upper floors; and/or
incorporating additional outdoor bicycle parking to help alleviate the need
for the required exterior storage.

BACH finds the proposed unit to meet the Community Housing livability
requirements as proposed.
It should be noted that there is additional flexibility in requiring community benefit
in PUDs in exchange for an Applicant requesting variation in PUD requirements.
Parking and Vehicular Circulation: The Applicant is requesting a 25% reduction in
parking as made available in the land use code; and a variation from the
intersection spacing requirements in the PUD. The Applicant has proposed the
addition of one parking space on-site for the proposed unit and to reconfigure the
vehicular access to the site by eliminating one of the two vehicular entrances to
the site. Staff has discussed the potential for the Applicant to dedicate a parking
space on the adjacent Cathers Home Property through a parking sharing
agreement to respond to the Public Works concerns regarding overflow parking.
Combined Private Open Space: The Applicant has also proposed shared
outdoor amenity space with a 564 sf deck accessible by the tenants of each of
the two respective residential units. Staff finds the combined private open space
proposal to be consistent with other multi-family development approvals in
Basalt. It is also noted that the 564 sf deck is considerably larger than the 100 sf
of private open space that would be required per Town Code. BACH was
supportive of the proposed amenity space.

4

Occupancy Priorities: The Applicant has requested priority for employees of the
property owner; the Applicant has not otherwise requested adjustments to the
occupancy priorities as set forth in the Town’s Community Housing Guidelines
which are as follows:
1. Essential Employees working in Basalt,
2. Non-Essential Employees working full-time in Basalt,
3. Essential Employees working outside Basalt but in the Roaring Fork
Valley,
4. Non-Essential Employees working outside Basalt but in the Roaring Fork
Valley.
BACH expressed support for the Applicant’s proposed occupancy priorities.
V.

Planning and Zoning Commission has the following recommendation options to
Town Council:
1) Recommend approval as presented; or,
2) Recommend conditional approval; or,
3) Recommend denial.
Staff recommends Planning and Zoning Commission hear presentations from

Project Overview
PC Development, LLC (the “Applicant”) submits this land use application for PUD
Amendment, Site Plan Review, Special Review, and Housing Mitigation Report to
construct a new deed-restricted residential unit on the third floor of an existing two-story
structure located at 540 Basalt Avenue, PID # 246718102010 (the “Property”). This
application is submitted in conformance with the Pre-application Conference conducted
with the Town of Basalt, dated 17 January 2025.
Property Overview
The Property is located in the Industrial Zone District (IN) of the Town of Basalt and in
the Basalt Business Center South Subdivision (BBCS). The Property contains 7,838 SF
of gross lot area and is bounded by Basalt Avenue to the east and south. A mixed-use
commercial and residential building that is part of the BBCS Subdivision borders the
Property to the north. A mixed-use commercial and residential building that is part of
the Basalt Business Center West Subdivision borders the Property to the west.
Existing Site Condition
The existing two-story building contains a 2,038 SF commercial space with 272 SF
storage area on the first floor and a 758 SF two-bedroom residential unit on the second
floor. Currently, the commercial space is used as a rug wash. There is a 230 SF deck
connected to the residential unit, and a 100 SF shed is located on the rear of the
Property. Onsite parking is accessed from Basalt Avenue. There are three (3)
coniferous trees on the Property which line the eastern border of the Property along
Basalt Avenue. Several additional broadleaf trees border the Property to the west.
There are currently two curb cuts that access the Property.
Proposed Development
The Applicant proposes adding a third-floor deed-restricted two-bedroom residential unit
to the existing structure. The proposed unit, which the Applicant proposes as a
Category 5 unit, will contain 659 SF of interior space. Materials included in this
application provide information on compliance with community housing livability
requirements. All applicable requirements have been met. The Applicant requests that
this unit occupancy is prioritized for the Applicant’s employees. The deck is proposed to
be expanded to contain 564 SF and will feature a planted edge that will act as a codecompliant guardrail. The expanded deck will be accessible to both residential units.
Two exterior “Rug Wash” signs are proposed to be added to aid in identifying the
commercial use. Two (2) additional parking spaces are to be provided at the northeast
portion of the Property, located between the building and Basalt Avenue. Total onsite
parking will be six (6) spaces. The Applicant requests the 25% reduction of parking
available in the land use code. Site constraints do not allow additional parking to be
added. Moreover, the close proximity to transit and other amenities and the fact that the
unit will be for employees of the Applicant support the reduction of parking. The 1,712
SF of proposed landscaping will include waterwise and indigenous deciduous and
coniferous plants while maintaining existing trees.
One of the existing curb cuts, located under the existing conifer trees, will be removed.
The remaining curb cut will be widened to provide improved access. A requirement of

the BBCS PUD Control Document states that driveways must be located more than 75
feet from an intersection. Due to the existing trees, the access cannot be located
farther north than proposed to meet this requirement. It is believed that adequate sight
lines are present to ensure safe traffic movements to and from the Property. The
existing dumpster, which is unattractively located to the south of the building, is
proposed to be relocated adjacent to the existing shed on the rear of the Property. This
location has been preliminarily reviewed with the trash hauler and accepted. He
Applicant has also coordinated with the adjoining property owner and they, too, have
preliminary accepted this location for a shared dumpster.
We look forward to working with Town of Basalt staff, the Basalt Affordable Community
Housing Commission, the Planning and Zoning Commission and Town Council in
connection with this application.

of maintaining mature vegetation that creates meaningful shading to the existing and
proposed structures. Proposed landscaping has also considered the presence of
existing easements and the governing documents of the BBCS. Please see
Attachment 6.
(c) Control of storm drainage shall be provided so as to not damage adjoining properties. The
plan must be approved by the Town Engineer.

PUD Amendment
Sec. 16-66. Application requirements.
(2) PUD Amendment. A PUD amendment application comprised of written materials and site
plans as provided below shall be required for amendments to approved PUD plans:
a. Written information:
1. A legal description of the property

The legal description of the Property has been included as Attachment 1. A legal
description has also been included on the Improvement Survey. Pursuant to
these sources, the legal description is as follows:
LOT X, BASALT BUSINESS CENTER SOUTH, ACCORDING TO THE PLAT
THEREOF RECORDED AUGUST 11, 1995 IN BOOK 38 AT PAGE 1,
COUNTY OF PITKIN, STATE OF COLORADO.
2. A description of the existing and proposed PUD and the objectives of the PUD,
including a spreadsheet outlining requested variations from the underlying
PUD schedule of requirements, the PUD design standards and other applicable
sections of Chapters 16 and 17 of this Code. The statement should also include
a listing of all enhancements offered by the proposal which are not required by
this Code, to allow an objective analysis and comparison of the benefits and
code variations.

The Covenants, Conditions, and Restrictions of BBCS have been
included as part of this application. See Attachment 4. The purpose of
the BBCS is to allow light industrial buildings and permitted accessory
uses together with employee housing (accessory residential is proposed
to be utilized by employees of the Applicant) as well as those uses
allowed after special review approval is granted by the Town of Basalt.
No variations are requested.
3. A list of the names and addresses of all property owners and lien holders, the
planner, architect, engineer and surveyor. Authorization from the property
owners to file and process the application.

A list of property owners within 300 feet of the Property as well as within
the BBCS has been included as part of this application. See Attachment
10. The included title commitment provides the names of any lien
holders. See Attachment 3. Finally, a letter of authorization from the
manager of PC Development, LLC has been included as Attachment 12.
4. A statement of how the proposal relates to the Master Plan, Three Mile Plan,
and any other long-range planning documents deemed appropriate by the
Town.

This proposed development would increase density by providing an
additional two-bedroom residential unit on the third story of an existing
building. This would help to discourage the construction of such a unit on
an undeveloped parcel of land, thus preserving undeveloped portions of
Town.
The proposed location for this residential unit is approximately a 5-minute
walk to a RFTA park and ride. This adjacency and accessibility would be
in keeping with the intentions of this master plan objectives of creating a
walkable Town, discouraging single-occupancy vehicle use, and living
adjacent to where you work.
6. A development schedule indicating the estimated timing and phasing of
construction activities. The schedule shall include the estimated area allocations
for each land use in each phase of development. The total area of common open
space provided at any phase of the development shall be provided.

No phasing is anticipated for the completion of the project. The project
will be pursued immediately following land use approval and the issuance
of a building permit. It is estimated that construction will take
approximately six (6) to eight (8) months.

7. Quantitative data shall be provided for the following:
a) The total number and type of dwelling units in the PUD.

This application is not amending the overall BBCS PUD. This
application proposed to add one (1) additional dwelling unit to the
BBCS PUD.
c) The maximum area and estimated building square footage of proposed
nonresidential construction on the subject property.

This application does not propose nonresidential construction.
d) The development intensity expressed as the ratio of the floor area to the
gross area of each tract or the subject parcel.

The proposed floor area ration will be .47 : 1.0.
e) The area of open space and the percentage of the open space to the gross site
area.

Open space is estimated to be 5,528 SF or 70% of the site.
f)

The amount of off-street parking to be provided for each use within the PUD,
including the number of spaces for residents and guests for residential use
and for employees and customers for business or industrial uses.

The proposed off-street parking for the Property is six (6) spaces.
Two (2) spaces are reserved for residential use and four (4) for the
existing commercial space.
The required parking, with the allowable 25% reduction would be 6
spaces (the existing industrial rug wash requires 4 spaces (2038/500
= 4); the existing and proposed residential would require 4 spaces).
The proposed residential unit is intended for employee housing of the
adjacent commercial business and is within 5 minutes’ walking
distance of the Basalt Park and Ride. These conditions merit the
further reduction of parking requirements.
8. A description of the means by which all open space and recreational areas,
walkways and private streets are to be maintained.

2020 Town of Basalt Master Plan Response
G.1 | PEOPLE & COMMUNITY CHARACTER
GOAL 1.3: Balance the natural and recreational attractions of the area with accommodation
for a diverse spectrum of residents, workers, and visitors.
1.M. Encourage projects that would promote density so as to conserve other nearby
lands for open space, recreation or other uses to preserve existing character.

This proposed development would increase density by providing an additional twobedroom residential unit on the third story of an existing building. This would help to
discourage the construction of such a unit on an undeveloped parcel of land, thus
preserving that land.
G.2 | AFFORDABLE & INCLUSIVE LIVING
GOAL 2.1: Provide housing that serves residents across a range of demographics, incomes and
collective needs.
2.G. Discourage affordable housing projects and residential developments that are not
connected to the transit system or which do not have a well-lighted, safe, protected
pedestrian access to and from transit stops.

The proposed location for this residential unit is approximately a 5-minute walk to a
RFTA park and ride. Therefore, this nearness and accessibility would be in keeping
with the intentions of this master plan objective.
G.4 | AUTHENTIC PLACES & DESTINATIONS
GOAL 4.2: Place high value on mixed use and live/work arrangements.
4.E. Encourage projects that incorporate mixed use and live/work concepts, provided
these projects are consistent with the other community goals outlined in this
document.

As the Property is the site of a commercial operation and is within the Basalt Business
Center, the addition of another residential unit would improve housing diversity in the
area.

Description of Consistency with the Basalt Business Center South
The purpose of the BBCS is to allow light industrial buildings and permitted accessory
uses, together with employee housing, as well as those uses allowed after special
review approval is granted by the Town of Basalt. All uses permitted in the Town’s IN
zone district as well as uses specifically granted through special review approval by the
Town.
The proposed additional residential use, which will be utilized for employee housing, is
consistent with this purpose statement. The project will comply with the dimensional
requirements outlined in the BBCS PUD Control Document. To the extent possible, all
landscaping standards are met. The design of the proposed residential unit also meets
all Building Design and Architectural Guidelines of the BBCS.

Community Housing Guidelines and Requirements
TOWN OF BASALT COMMUNITY HOUSING GUIDELINES
Updated with Amendments Made as of 6/25/25
All new residential developments will integrate community housing into the development… methods
will be developed to maintain the affordability of existing housing in Basalt.

The creation of this deed-restricted housing unit would satisfy the requirement for the
development of affordable housing and help to maintain overall affordability in the Town.
Community housing should be disbursed throughout the community and, where possible, integrated
into the existing community fabric.

The proposed development utilizes an integrated design that takes advantage of vertical
space to improve density of housing over an existing commercial space.
The Town will emphasize programs that will result in the creation of community housing units -- by
units being constructed or by existing units being permanently restricted for community housing,
either through deed restrictions or other methods.

The proposed development is proposed as a Category 5 deed-restricted unit and would
therefore be beneficial to the overall goal of the Town to created more permanently
affordable housing.
Community Housing will be transit friendly, integrate with intermodal transportation connections, and
perpetuate the Town's history of pedestrian walkability and ease of mass transit use.

The proposed location for this residential unit is approximately a 5-minute walk to an
RFTA park and ride.

4. COMPANY’S RIGHT TO AMEND
The Company may amend this Commitment at any time. If the Company amends this Commitment to add a defect, lien, encumbrance, adverse claim, or
other matter recorded in the Public Records prior to the Commitment Date, any liability of the Company is limited by Commitment Condition 5. The
Company shall not be liable for any other amendment to this Commitment.
5. LIMITATIONS OF LIABILITY
(a) The Company’s liability under Commitment Condition 4 is limited to the Proposed Insured’s actual expense incurred in the interval between the
Company’s delivery to the Proposed Insured of the Commitment and the delivery of the amended Commitment, resulting from the Proposed
Insured’s good faith reliance to:
i. comply with the Schedule B, Part I—Requirements;
ii. eliminate, with the Company’s written consent, any Schedule B, Part II—Exceptions; or
iii. acquire the Title or create the Mortgage covered by this Commitment.
(b) The Company shall not be liable under Commitment Condition 5(a) if the Proposed Insured requested the amendment or had Knowledge of the
matter and did not notify the Company about it in writing.
(c) The Company will only have liability under Commitment Condition 4 if the Proposed Insured would not have incurred the expense had the
Commitment included the added matter when the Commitment was first delivered to the Proposed Insured.
(d) The Company’s liability shall not exceed the lesser of the Proposed Insured’s actual expense incurred in good faith and described in Commitment
Conditions 5(a)(i) through 5(a)(iii) or the Proposed Policy Amount.
(e) The Company shall not be liable for the content of the Transaction Identification Data, if any.
(f) In no event shall the Company be obligated to issue the Policy referred to in this Commitment unless all of the Schedule B, Part I—Requirements
have been met to the satisfaction of the Company.
(g) In any event, the Company’s liability is limited by the terms and provisions of the Policy.
6. LIABILITY OF THE COMPANY MUST BE BASED ON THIS COMMITMENT
(a) Only a Proposed Insured identified in Schedule A, and no other person, may make a claim under this Commitment.
(b) Any claim must be based in contract and must be restricted solely to the terms and provisions of this Commitment.
(c) Until the Policy is issued, this Commitment, as last revised, is the exclusive and entire agreement between the parties with respect to the subject
matter of this Commitment and supersedes all prior commitment negotiations, representations, and proposals of any kind, whether written or oral,
express or implied, relating to the subject matter of this Commitment.

(d) The deletion or modification of any Schedule B, Part II—Exception does not constitute an agreement or obligation to provide coverage beyond the
terms and provisions of this Commitment or the Policy.
(e) Any amendment or endorsement to this Commitment must be in writing and authenticated by a person authorized by the Company.
(f) When the Policy is issued, all liability and obligation under this Commitment will end and the Company’s only liability will be under the Policy.
7. IF THIS COMMITMENT HAS BEEN ISSUED BY AN ISSUING AGENT
The issuing agent is the Company’s agent only for the limited purpose of issuing title insurance commitments and policies. The issuing agent is not the
Company’s agent for the purpose of providing closing or settlement services.
8. PRO-FORMA POLICY
The Company may provide, at the request of a Proposed Insured, a pro-forma policy illustrating the coverage that the Company may provide. A pro-forma
policy neither reflects the status of Title at the time that the pro-forma policy is delivered to a Proposed Insured, nor is it a commitment to insure.
9. ARBITRATION
The Policy contains an arbitration clause. All arbitrable matters when the Proposed Policy Amount is $2,000,000 or less shall be arbitrated at the option of
either the Company or the Proposed Insured as the exclusive remedy of the parties. A Proposed Insured may review a copy of the arbitration rules at
http://www.alta.org/arbitration.
IN WITNESS WHEREOF, Land Title Insurance Corporation has caused its corporate name and seal to be affixed by its duly authorized officers on the date shown
in Schedule A to be valid when countersigned by a validating officer or other authorized signatory.

100% LED Light Output Chart

Total distance from LED Driver per lead (m)

With every foot of lead wire and every light fixture, there is voltage loss. With too much voltage loss all
light fixtures will not develop 100% of their potential output. Below is a chart of acceptable voltage loss
which will maintain 100% of the potential light output of the LED MiniDisc Light. Simply plot the number
of LED MiniDiscs you wish to place on one lead on the horizontal axis, with the total distance from the
LED Driver to the last LED MiniDisc on the vertical axis. If the resulting plot is at or below the line shown,
you will have acceptable voltage loss and your LED MiniDisc will output 100% of their potential.

Engineering Report, Rug Wash improvements – Proposed Top Floor Dwelling, Utilities and Drainage
Design Evaluation, 540 Basalt Ave, Lot x Basalt Business Center South
SE Job #34125.01, Parcel ID #:246718102010

Dear Willis,
Sopris Engineering, LLC (SE) has prepared the following report in support of the proposed vertical expansion
development of a new apartment dwelling structure at the Existing Rug Wash facility. The subject site address is
540 Basalt Ave located at the southeast corner of the Basalt Ave and Fiou Lane intersection situated on Lot X in the
Basalt Business Center South subdivision. The proposed 768 S.F. third floor dwelling addition will be constructed
over the existing 768 S.F. second floor dwelling matching the existing exterior perimeter structural walls. Proposed
site Improvements associated with this dwelling addition include a slight expansion of the parking area, drainage
upgrades for onsite roof and paved areas, conversion of a portion of roof area to deck and upgrade of utilities as
required to serve the new 2-bedroom apartment dwelling. The information presented in this report is for a
preliminary Site Plan Review in support of an application for PUD Amendment.
This report addresses the existing and proposed utility service improvements and plan to support the facility with
factual information regarding potential additional waste water flow impacts and service capacity to the Basalt
Sanitation District sanitary sewer system. This report provides drainage plan information and recommendations
regarding stormwater management and drainage improvements to insure no adverse effects to adjoining
properties.
This narrative and attached preliminary site plan delineates the existing and proposed conditions with notations
and details associated with the above referenced issues, prepared with respect to the Town’s Unified Development
Code (UDC) development plan criteria and requirements. The preliminary site plan was prepared based on the
Rawley Design Planning, Schematic Landscape Plan, dated 03-25-2025, High Country Engineering, Inc., ISP, dated
01-08-24, Willis Pember Architects, Inc., Architectural plans, dated 11-05-24 and Previous SE existing conditions and
utility survey base information.
Existing/Proposed Conditons and Project Summary
The subject property is planned to be re developed with the addition of a 768 S.F. third floor dwelling unit
constructed over the existing second floor dwelling unit of the same dimensions. The expansion will result in a
facility comprised of two 768 S.F. -2-bedroom residential units, and the existing ground floor commercial rug wash
facility. Currently the site has 4-5 parking spaces and a paved surface with existing flow path to the north that
routes storm drainage toward Basalt avenue. Based on site observations runoff pools on the surface. The existing
concrete driveway access and parking areas (2588 S.F.) will be reworked to provide for 6 parking spaces with a
single access from Basalt Avenue. Concrete paved surfaces will be added, sawcut and replaced and some area will
be removed to be reclaimed as landscape areas resulting in a decreased 2393 S.F. area. Therefore the reworked site
will result in a 195 S.F. net decrease of impervious pavement. The Associated site improvements will include the
installation of drainage inlets, drainage conveyance piping and installation of a new strorm water management

detention system to attenuate and infiltrate onsite runoff. There will be an elevated walkway and new stairway
constructed to access the proposed 3rd story apartment from the reconstructed ground level to second story
stairway and landing. Currently all roof drainage is routed to the Westerly side of the building to a 10” wide grass
vegetated area via gutters, downspouts and scuppers. It appears that the runoff effectively infiltrates into the
pervious grass landscape area. No evidence of runoff to the adjacent property to the west was observed or is
indcated by existing flat grading. The existing roof and deck drainage collection components will be reworked to
accommodate the new third floor structure and deck areas with minor grading improvements to the pervious
landscape area. The existing 2nd floor roof gutter on the westerly dripline edge will be removed. A new 3rd floor roof
drain will be installed for collection of new roof runoff and conveyance via an internal integral roof drain/overflow
pipe system routed down to a new pipe outlet penetration at the base of the westerly wall. Storm drainage
discharge to a new 4” subsurface drainage collection pipe routed to new infiltration gallery components to be
installed. The existing scuppers on the existing westrly wall that discharge runoff from the southerly 1st floor roof
deck and the northerly 2nd floor level roof will be maintained. The northerly 2nd floor roof will be retrofitted to serve
as a 3rd floor dwelling deck.
The existing sanitary sewer service will be maintained and has effective capacity to accept and convey the
increased waste loading from the additional dwelling unit.
Vehicle Access
The existing site currently has two entrance access driveways from Basalt Avenue. The northerly drive access will
be removed and reclaimed as lanscaped area. The southerly driveway access will be widened to 20’ to allow for
two-way vehicular movement to the expanded paved parking areas.
Drainage
The subject site will be decreasing impervious area from the existing condition however to alleviate onsite ponding
in the paved area new stormwater collection, conveyance and infiltrative detention component will be installed.
Direct stormwater runoff on the paved drive/parking surface will be directed to a series of drain inlets along the
existing graded flowline for routing via drain pipe to the drywell/infiltration gallery. The new development is
proposing to collect roof drainage in roof drains and to pipe that water to an on-site drywell/ infiltration gallery
structure located off the southwest corner of the building in a small portion of the parking and grass strip area. The
existing first floor roof, second floor deck, proposed third floor roof/deck and walkway will shed runoff to the
westerly landscape area strip graded to a new yard inlet that will be piped into the infiltrative detention gallery. If
the infiltration gallery reaches capacity during an extreme storm event water will overflow out of a terminal drain
inlet at the northeastly corner to the property to flow to the curb and gutter on Basalt Avenue. Due to new
drainage collection/infiltration improvements, existing grades on the westerly and southerly boundaries no storm
water runoff will flow or be routed to adjacent properties.
The proposed drainage BMP (Best Management Practice) incorporates a small shallow 24” diameter drywell
structures with perforations at depth and lateral infiltration gallery piping with screened rock bedding and backfill
installed around the exteriors of the storage/infiltration components. The onsite sub-soils are capable of moderate
to high infiltration rates, therefore drywell/infiltration gallery system are considered to be a viable BMP. The BMP
will dramatically reduce the onsite runoff flow and volume of stormwater generated from tributary impervious
areas and provide for stormwater runoff recovery by infiltration into the pervious subsurface soils. The system
design will insure that no adverse impacts to the subject property or surrounding properties will result from the
proposed development.

Temporary erosion control will be addressed at Building Permit. During construction site specific erosion control
including best management practices (BMPs) such as silt fence, log wattles, and truck tracking control onsite will be
installed and maintained as necessary.
Utilities
Domestic Water System
The subject site falls within the Town of Basalt’s water service area. Prior to proposed development, the site
existed as a single-residential unit and shop ½ bath with 1-EQR usage. Proposed development will most likely have
total usage equivalent to 2.2-EQR per Basalt’s EQR Schedule. The existing water service tap is adequate for the
additional potable water usage in the new 2-bedroom apartment unit.
Sanitary Sewer System
The subject site falls within the Town of Basalt’s sanitary sewer service area. Similar to the domestic water system,
the existing site has 1-EQR for sewer from the existing single-residential unit and shop ½ bath prior to
redevelopment. Proposed development will most likely have usage equivalent to 2.2-EQR per Basalt’s EQR
Schedule.

There is an existing 4” PVC sanitary sewer service from the existing building to the sewer main along Basalt Avenue
that has effective capacity to accept and convey the increased waste loading from the additional dwelling unit.
Based on invert elevations of existing sewer service pipe and main the sewer servic pipe slope is assumed to be
approximately 2% that will convey up to 170 gpm in a 4” PVC pipe. Assuming a conservative 1 hr peak time for
residential use and 8 hour usage time for the commercial unit half bath, the total expected peak flow in the
sanitary sewice is expected to be approximately 10-11 gpm. Therefore the existing 4” sanitary service pipe has
adequate capacity for the two appartment and commercial uses.

RE:

540 Basalt Avenue – Traffic Conformance
FHU Project No. 124108-01

Dear Mr. Cathers:
Felsburg Holt & Ullevig (FHU) has been asked to analyze an addition to 540 Basalt Avenue in Basalt, CO.
The current proposal is to add an additional accessory dwelling unit (ADU) to the existing building by
adding a third story. The site plan is illustrated in Figure 1 which also eliminates one of the two existing
curb cuts from the site onto Basalt Avenue. A prior traffic study, Town of Basalt Southside Traffic Impact
Study, was prepared by SGM in October 2016 with existing data collection occurring in October of 2015.
This TIS explored several planned developments south of CO 82 including Cathers West which includes
the 540 Basalt Avenue site. The TIS did not address which trip generation was directly associated with each
parcel, but the building on the 540 Basalt Avenue site was operational in October of 2015 as The Rug Wash
Company, which occupies the roughly 2,300 square foot first floor, and an ADU, which occupies the
roughly 750 square foot second story. This remains unchanged over the last decade and remains what is in
place on site today. As a result, we believe that any trip generation related to the current 540 Basalt
Avenue site would have been captured in the existing conditions of the Town of Basalt Southside Traffic
Impact Study.
The currently proposed site, as mentioned previously, plans to add a third story to the building which
would provide one additional ADU of approximately 650 square feet. Since it is unclear as to what
development trip generation for the Town of Basalt Southside Traffic Impact Study is associated with, we
have elected to add the trip generation for that ADU as new trips that wouldn’t have been accounted for in
that prior study to present a conservative estimate. The ITE Trip Generation Manual, 11th Edition (2021) is
the most current publication of trip generation rates and equations for the traffic engineering industry.
Table 1 shows the equation and rates utilized in this analysis. Table 2 shows the estimated trip generation
for the current proposed site above what would have been captured in counts collected for the Town of
Basalt Southside Traffic Impact Study.

The trip generation indicates the additional ADU at 540 Basalt Avenue is anticipated to generate 7 daily
trips with 1 outbound trip occurring in the AM peak hour and 1 inbound trip occurring in the PM Peak
hour. While it is possible that this additional ADU was accounted for in the Town of Basalt Southside
Traffic Impact Study, we have chosen to assume it was not previously accounted for to ensure a
conservative representation of this project. Based upon the 2035 peak hour projections from the Town of
Basalt Southside Traffic Impact Study the outbound AM peak hour trips along the south leg at the
intersection of CO 82 and Basalt Avenue were anticipated to be 346 and inbound PM peak hour trips along
the south leg at the intersection of CO 82 and Basalt Avenue were anticipated to be 319. The anticipated
additional traffic would represent a 0.3 percent increase in AM outbound traffic and a 0.3 percent increase
in PM inbound traffic. Of note, these percentage increases are well below the 20 percent threshold that
would require an update to the CDOT access permit for the intersection of CO 82 and Basalt Avenue.

Conclusions
The study resulted in the following conclusions:
▪

▪

The newly proposed 3rd story ADU unit at 540 Basalt Avenue would generate a marginal increase
in traffic which is anticipated to be less than half of a percent during peak hours to potential
impacted movements. We do not believe that a single additional trip in those peak hours
generated by the 540 Basalt Avenue site would change the results or recommendations of the
Town of Basalt Southside Traffic Impact Study.
The planned closure of one of the two existing curb cuts along Basalt Avenue should be supported
as we believe the consolidation of access points should be encouraged to eliminate additional
conflict points which has tangible safety benefits.

Please let me know if you have any questions about this letter or need any additional information.

MEMORANDUM
TO: Michelle Bonfils Thibeault, Planning Director and Carlton Henry, Planner
FROM: Catherine Christoff, Town Engineer and Justin Forman, Public Works Director
DATE: March 3, 2026
RE: 540 Basalt Ave
Please consider the following comments from engineering and public works:
1. The applicant should demonstrate that all improvements are outside the mapped 100-year
floodplain, and should show the floodplain boundary on the site plan.
2. How will the additional vehicles be accommodated? Historically overflow traffic has spilled into the
ROW during rug washing. Even the past few weeks, vehicles have been parked in the drive
entrances for rug washing operations and blocking egress/ingress. As it exists today it appears that
not enough parking onsite all throughout the year, the plan only increases the parking by one
space, will this be sufficient to accommodate the new development?
3. Will the driveway be graded in a way that directs all runoff from rug washing to the stormwater
system?
4. The applicant should provide a detailed drainage plan at building permit submission that shows the
development’s compliance with the Basalt Public Works Manual.
5. The applicant should verify that the 6” drain inlets in the driveway are traffic rated.
6. The specs for the Flo-Well dry well system say it needs to be placed 10’ from structures or
foundations, it appears to be placed closer than 10’.
7. The plans do not clearly identify the origin of the water service line or its point of entry into the
building. The plan set appears to show the water service originating from a hydrant service lateral.
Standard practice does not allow taps from a hydrant lateral for multiple reasons. The Water
Department did not locate a valve in the grass area as shown on the plans. The entire water
service line, including the curb stop, must be positively located. A private utility locator will be
required. Additional coordination with the Water Department is necessary.
8. Project is placing driveway and parking closer to hydrant. At least two bollards will be required to
prevent vehicle damage to existing hydrant.
9. Please confirm irrigation system tap and layout. Water Department has records of a backflow for
the system.
10. Please ensure additional EQRs are captured in permitting application process as outlined within
packet.
11. Several Aspen trees have been removed from the turf area near the stop sign without following the
proper procedure. Per the Towns' tree ordinance, trees 6 inches or greater DBH (dead or alive)
require a permit from the town to remove. This is to ensure that appropriate mitigation measures
are followed and the Town maintains an appropriate canopy cover. I counted four (4) stumps that I
have no permit for, although two (2) are questionably small enough to not need a permit. The
design will need to incorporate an additional one (1) tree on the property, preferably in this unused
turf space. The species should be a narrow or upright cultivar that don't impede sight lines at the
intersection. Avoid planting within proximity to the fire hydrant, and do not plant Spruce due to
space constraints.

12. The design shows the two (2) existing Colorado Blue Spruce on the property. They need to be
pruned to meet clearance guidelines noted in Town code. There should be a minimum of 14 ft
clearance for the road/curb, and 8 ft clearance for any adjacent sidewalks.

February 17th, 2026
Carlton Henry
Town of Basalt Planning Development
Carlton,
The Roaring Fork Fire Rescue Authority has received the Special Review for 540 Basalt Avenue
for a proposed residential unit on the third level of an existing two-story structure. I offer the
following comments;
Site Plan and Landscaping:
•
•
•

Proposed enclosed bike storage located off the first level garage, is an acceptable
location. Recommend drywalled enclosed storage for lithium-ion battery bicycles or
other devices.
Schematic Landscape Plan L2.00:
*Proposed deck planters, or planter’s edge, shall be made of non-combustible material.
*Rooftop sunshade- fire-retardant or fire-resistant material.
Missing snow removal area. I want to confirm that snow storage will not bury the fire
hydrant.

Access/Parking:
•

•
•

The fire hydrant located on Basalt Avenue is critical to keep unobstructed at all times.
The reduction of parking spaces is a concern for the space. Two units with four bedrooms
has a potential for more than two vehicles. On page 13 of the application under letter f, it
states “…proposed residential unit is intended for employee housing of the adjacent
commercial business and within 5 minutes’ walking distance of the Basalt Park and
Ride” Does this mean the adjacent commercial business (Cather’s Home?) is storing that
employee’s vehicle?
What about guest parking?
Recommend bollards to protect fire hydrant.

Portable Fire Extinguishers:
•

Portable fire extinguishers shall be on-site during the duration of construction.

Premise identification for Building
•

The address numbers and locations proposed are acceptable to RFFR.

Fire Inspection
•

In a multi-use building, it’s important that commercial space is inspected annually. Our
records show we have not conducted a fire and life safety inspection of the Rug Wash in
the last five years. A fire inspection will be done prior to occupancy.

Sincerely,
Brooke Stott, Fire Marshal
