RES2026-043

A RESOLUTION EXTENDING THE CURRENT MORATORIUM ON THE
ACCEPTANCE OF ANY APPLICATIONS RELATED TO THE NEW DEVELOPMENT
OR ESTABLSHIMENT OF ANY DATA CENTER OR OTHER LARGGE SCALE DATA
STORAGE UNTIL September 9 2026; AND FOR OTHER PURPOSES.

Councilwoman Natasha Williams-Brown)
WHEREAS, the City of South Fulton ("City") is a municipal corporation duly organized
and existing under the laws of the State of Georgia;
WHEREAS, the duly elected governing authority of the City, is the Mayor and Council
thereof ("City Council");
WHEREAS, the City has been vested with substantial powers, rights and functions to
generally regulate the practice, conduct or use of property for the purposes of maintai
ning health, morals, safety, security, peace, and the general welfare of the City of Sou
th Fulton; and
WHEREAS, Georgia law recognizes that local governments may impose moratoria
on zoning decisions, building permits, licenses and other development approvals whe
re exigent circumstances warrant the same; and
WHEREAS, the Courts take judicial notice of a local government's inherent ability to
impose moratoria on an emergency basis; and
WHEREAS, the Mayor and City Council of the City of South Fulton have, as a part of
planning, zoning and growth management, been in review of the City's Zoning
Ordinances and have been studying the City's best estimates and projections of the
type of development which could be anticipated within the City of South Fulton; and
WHEREAS, the Mayor and City Council deem it important to develop a
comprehensive plan which integrates all of these concerns and therefore considers
this moratorium a proper exercise of its police powers; and
WHEREAS, on December 9, 2025, the City of South Fulton instituted a six-month
MORATORIUM ON THE ACCEPTANCE OF ANY APPLICATIONS RELATED TO THE
NEW DEVELOPMENT OR ESTABLSHIMENT OF ANY DATA CENTER OR OTHER
LARGGE SCALE DATA STORAGE which was designated as RES2025-094;

NOW THEREFORE, THE COUNCIL OF THE CITY OF SOUTH FULTON HEREBY
RESOLVES as follows:
Section 1. That the Data Center Moratorium which was passed by the Mayor and Council
of the City of South Fulton on 12/09/2026, which is designated as RES2025-094, and
including all provisions of Resolution RES2025-094, be extended until September 9,
2026.

Section 2. The City Attorney, City Clerk and contracted City Codifier are authorized
to make non-substantive formatting and renumbering edits to this ordinance for proofing,
codification, and supplementation purposes. The final version of all ordinances shall be
filed with the City Clerk.
Section 3. The City Police Chief, and/or his designee, in conjunction with the City
Attorney, shall be authorized to make forms for applications and the issuance of permits
consistent with the terms of this Ordinance and as permitted by State law.
Section 4. The effective date of this Resolution shall be on the date as set forth under
Sec. 3.21 of the City Charter unless provided otherwise by applicable local, state and/or
federal law

The foregoing RESOLUTION No. 2026-043, adopted on May 12, 2026, was approved by
unanimous consent without objection. The result was as follows:
