ITEM #1 – PL 26-17, CLAASSEN ESTATES FIRST ADDITION EASEMENT
DEDICATION
Toby Stewart, Community Development Director, came before the Board for approval of
easement dedications on property located at 10701 SW 21st Ter., Towanda, Kansas. Janice
Claassen owns a tract of platted land containing 10.5+/- acres and is zoned RR. Ms. Claassen
wishes to replat lot four of Claassen Estates, creating two lots that are five+/- acres in size. Ms.
Claassen would like to sell the west parcel to a neighbor who lives on the same street. The
neighbor would use the parcel for recreational purposes and has no plans to construct a singlefamily dwelling. The property is located inside the urban growth area of the County and is
surrounded by RR, PRD-B, and AG-40 properties. Since the property will be used for
recreational purposes, there are no plans to service the property with water or a private

wastewater system. The new parcel is largely covered by a Federal Emergency Management
Agency (FEMA)-mapped floodplain area and trees, which would further deter future
development of a single-family dwelling. The state of Kansas has released draft updated
floodplain maps and it is expected that the floodplain will further increase to the south and north.
The Plat does indicate that no residential structure is to be built on lot four, tract B. State Statute
requires surrounding property owners within 1,000 ft. be notified of the public hearing. The
Planning Commission approved the plat by a vote of 5-0.
Commissioner Herzet motioned to approve the acceptance of easements as indicated on the
Claassen Estates First Addition Final Plat, PL 26-17 on property located at 10701 SW 21st
Ter., Towanda, Kansas. Commissioner Jackson seconded the motion. Motion carried 4-0.

ITEM #2 – PL 26-18, COUNTRYSIDE ACRES, ROAD AND EASEMENT DEDICATION
Toby Stewart, Community Development Director, came before the Board for approval of road
and easement dedications on property located south of SW 160th St., on SW County Line Rd.,
Rose Hill, Kansas. The Coykendall Living Trust owns a tract of land containing 40+/- acres. On
February 24th, 2026, the property was rezoned from AG-40 to RR, Case RZ 25-20 and May 5th,
2026, the Planning Commission approved the preliminary plat (PL 26-16). The trust desires to
plat six lots, each lot is approximately five+/- acres. The property is located inside the Urban
Growth area of the County and is surrounded by AG-40 and RR-zoned properties. Water will be
provided to the properties and will be serviced by private wastewater systems. Butler Rural
Electric will provide electricity. To access the properties, the development will be serviced by a
70-foot internal roadway with a cul-de-sac. The plat also notes utility easements, drainage
easements, and notes a 75-foot building setback line as required by the zoning regulations. There
are no FEMA-mapped floodplain areas located on the property. The County Engineer has
approved the drainage report. State Statute requires surrounding property owners within 1,000 ft.

5-0.
Commissioner Woydziak motioned to approve the acceptance of easements, road, and road
right-of-way as indicated on the Countryside Acres final plat, PL 26-18, on property located

ITEM #3 – RZ 26-07, CHANGE IN ZONING FROM AG-40 TO RE
Toby Stewart, Community Development Director, came before the Board for approval of a
change in zoning from AG-40 to RE on property located at north of SW 40th St., on SW Santa Fe
Lake Rd., Towanda, Kansas. BJ Ventures LLC owns a tract of land containing 80+/- acres and is
currently zoned AG-40. BJ Ventures LLC wishes to rezone the property to RE. This would allow
BJ Ventures LLC to make an application for a nine-lot preliminary plat. The site plan indicates
the lot sizes would range from five acres to 17.9+/- acres. There would be an interior roadway
constructed, which would access all of the lots. The property is located inside the urban growth
area of the County and is surrounded by AG- 40, RE, and many RR-zoned properties. There are
similar sized tracts in the area. The County’s Comprehensive Plan would consider this area a

Periphery Area that is located inside the urban growth area (UGA). BJ Ventures LLC is willing
to provide rural water, which will need to be extended from SW 40th St., along Santa Fe Lake R
to the site. Private wastewater systems will be utilized and electricity is provided by Butler Rural
Electric. There are no FEMA-mapped floodplain areas located on the property. State Statute
requires surrounding property owners within 1,000 ft. be notified of the public hearing. The
Planning Commission recommended approval of the rezone by a vote of 5-0.
Commissioner Herzet motioned to approve Resolution No. 26-26 for the rezoning of property
from AG-40 to RE, Case RZ 26-07, on property located north of SW 40th St., on SW Santa
Fe Lake Rd., Towanda, Kansas. Commissioner Jackson seconded the motion. Motion carried
4-0.

ITEM #4 – RZ 26-09, CHANGE IN ZONING FROM AG-80 TO RE
Toby Stewart, Community Development Director, came before the Board for approval of a
change in zoning form AG-40 to RE on property located at 14485 NE Samuel Rd., Cassoday,
Kansas. James Byers owns a tract of land containing 5.6+/- acres and is currently zoned AG-80.
Mr. Byers wishes to rezone the property to RE, this would allow the removal of an existing
abandoned home and allow the building of a new home. In 2014, the property was split by deed
from the larger parcel located to the south across the roadway. When the split occurred, the
parcel with the home became a non-buildable lot as it is not 80 acres in size and therefore nonconforming to the regulations. In 2020, Mr. Byers acquired the land by paying off the taxes and
ensuring it did not go through a tax sale. Mr. Byers has since been cleaning up the property. An
approval of the rezone would reclassify the property, making it legal and conforming to the
regulations. The property is located outside the urban growth area of the County and is
surrounded by AG-80 properties. There are a few similar sized tracts in the area. The character of
the area is agricultural in nature, and some do include single-family dwellings. The property is
located approximately 1.5 miles west of Cassoday. The County’s Comprehensive Plan would
consider this area an AG Preservation Area that is located outside the urban growth area. There
are no changing conditions in the area that make the requested amendment necessary. However,
due to the non-buildable nature of the property, there may not be much use for the land except
for dwelling purposes. The property is not being used for AG purposes. The property contains an
abandoned single- wide trailer. The property contains a water well for drinking purposes. A
lagoon would be utilized for wastewater purposes and Butler Rural Electric provides electricity.
The property does contain a FEMA-mapped floodplain area located at the northwest corner of
the property. There also appears to be a dam breach area as well. There is plenty of room on the
property to rebuild outside these areas. State Statute requires surrounding property owners within
1,000 ft. be notified of the public hearing. The Planning Commission recommended approval of
the rezone by a vote of 4-1.
Commissioner Jackson motioned to approve Resolution No. 26-27 for the rezoning of property
located from AG-80 to RE, Case RZ 6-09, on property located at 14485 NE Samuel Rd.,
Cassoday, Kansas. Commissioner Woydziak seconded the motion. Motion carried 4-0.

ITEM #5 – CU 26-06, CONDITIONAL USE PERMIT (CUP) TO OPERATE A

WEDDING VENUE
Toby Stewart, Community Development Director, came before the Board for approval of a CUP
on property located at 14297 SE Cole Creek Rd., Leon, Kansas. Pam Pirotte owns a tract of land
containing 236+/- acres and is zoned AG-80. Ms. Pirotte desires to operate an event venue. The
property is located outside the UGA of the County and is surrounded by AG-80 and one RRzoned property. The venue does sit quite a distance from all property lines, with the closest
property line being the south property line, which is over 400 feet away. SE Cole Creek Rd. is a
paved roadway maintained by the County. Rural water does exist and the venue would be
serviced by a septic system. Evergy would provide electricity. There are Federal Emergency
Management Agency (FEMA)-mapped areas on the property; the venue would be located
outside this area. The parking area along the existing driveway may be impacted by the
floodplain. However, since the vehicles are movable during a flooding event, there would be no
impacting FEMA regulations. State Statute requires surrounding property owners within 1,000 ft.
be notified of the public hearing. The Planning Commission recommended approval of the CUP
by a vote of 5-0 with the following conditions:
1. The Planning Commission may revoke the CUP upon finding that necessary
building permits have not been issued within twelve months of approval of the CUP
or twelve months following the final resolution of any litigation in connection with
the issuance of such permit (whichever is greater).
2. A maximum of 100 wedding attendees.
3. Events will end at 8:00 p.m. Monday through Thursday, and 10:00 p.m. Friday
through Sunday. Cleaning of the venue may occur after hours.
4. Alcohol may only be served by a licensed bartending service.
5. The construction of the venue shall meet applicable building code requirements.
6. No outside amplified music.
The Board and Mr. Stewart discussed parking for the event center. Commissioner Herzet wanted
to make sure emergency vehicles would have access.
Commissioner Herzet motioned to approve Resolution No. 26-28, a Conditional Use Permit to
operate a Wedding Venue, with recommended/amended conditions, Case CU 26-06, located
on property located at 14297 SE Cole Creek Rd., Leon, Kansas. Commissioner Jackson
seconded the motion. Motion carried 4-0.

ITEM #6 – CU 26-08, CONDITIONAL USE PERMIT CUP) TO OPERATE A
THERAPEUTIC RIDING CENTER
Toby Stewart, Community Development Director, came before the Board for approval of a CUP
on property located north of SW 70th St. on SW Tumbleweed Rd., Andover, Kansas, owned by
Freedom Hooves Therapeutic Riding Center Inc. The property is 39.5+/- acres and is zoned
Rural Residential (RR). Freedom Hooves Therapeutic Riding Center Inc. desires to operate a
non-profit equine riding center that will provide riding and ground-based riding lessons to
children and adults with disabilities. The property is located inside the UGA of the County and is
surrounded by AG-40, RE, and RR-zoned properties. There are a couple of other conditional
uses in the area located to the east of the property along SW 70th St. One was for therapeutic

riding lessons, but staff is unaware if the business is still in operation. The property is surrounded
by trees and shrubs, which would be a natural barrier to surrounding property owners. The
closest neighbor appears to be approximately a half mile away from the riding facility, which is
located south of SW 70th St. A water well will be used for drinking purposes, and a lagoon will
be utilized for wastewater purposes. Butler Rural Electric can provide electricity. There is a
small FEMA-mapped area located by the south property line, which is indicated as an open area
on the site plan. State Statute requires surrounding property owners within 1,000 ft. be notified of
the public hearing. The Planning Commission approved the conditional use by a vote of 5-0 and
recommended the following conditions:
1. The Planning Commission may revoke the CUP upon finding that necessary building
permits have not been issued within twelve months of approval of the CUP or twelve
months following the final resolution of any litigation in connection with the issuance of
such permit (whichever is greater).
2. All construction shall meet building and environmental code standards.
3. Any lighting will be pointed in a downward direction to minimize impact on surrounding
landowners.
Commissioner Woydziak motioned to approve Resolution No. 26-30, a Conditional Use Permit
to operate a Therapeutic Riding Center with recommended conditions, Case CU 26-08, on
property located north of SW 70th St. on SW Tumbleweed Rd., Andover, Kansas. Commission
Chair Murphy seconded the motion. Motion carried 4-0.

ITEM #7 – CU 26-07, CONDITIONAL USE PERMIT (CUP) TO OPERATE A POLE
VAULT TRAINING CENTER
Toby Stewart, Community Development Director, came before the Board for approval of a CUP
on property located at 13819 SW 134th St., Rose Hill, Kansas, owned by Tyler Knight. The
property is zoned RR and is 4.6+/- acres in size. Mr. Knight requests to construct and operate a
Pole Vault Training Center, which is intended to support youth development in a growing sport.
The facility he wishes to construct will be a 50-foot by 176-foot building. The building would be
28 feet at its peak. The facility will be located approximately 425 feet away from SW 134th St.
and will sit toward the east and south property lines. Operations consist of:
Training groups of up to 12 participants.
Hours of operation are Mondays and Wednesdays, 6 p.m. to 8 p.m., and Sundays, 12
p.m. to 2 p.m.
Long Term: Mr. Knight would like to have groups attending, which may include up to 25
participants and would also like to hold meets four to five times a year, which may
include 50 to 60 attendees.
The property is located inside the UGA of the County and is surrounded by AG-40, RE, and RRzoned properties. There are some other conditional uses in the area. The Comprehensive Plan
would consider this a "Periphery" area, located inside the UGA and outside the Extraterritorial
Jurisdiction (ETJ). There is a mix of land uses in the area. Immediately surrounding the property,
there are residential uses. Surrounding the cluster of residential uses are larger land holdings,

which appear to be used for agricultural purposes. A training facility is not necessarily
compatible with the other land uses. However, if practices take place indoors, the use may be
more compatible. The current home is serviced by rural water. Mr. Knight would like to utilize a
water well for the building. However, he is willing to connect to Rural Water District #5 if
necessary. Mr. Knight will tie into the existing private wastewater system, which would most
likely need to be improved and/or enlarged. Butler Rural Electric provides electricity. State
Statute requires surrounding property owners within 1,000 ft. be notified of the public hearing.
The Planning Commission recommended approval of the CUP by a vote of 5-0, with the
following conditions:
1. The Planning Commission may revoke the CUP upon finding that necessary building
permits have not been issued within 12 months of approval of the CUP or 12 months
following the final resolution of any litigation in connection with the issuance of such
permit (whichever is greater).
2. The construction of the training facility shall meet all applicable building codes.
3. Future expansion of the building footprint or the need for additional buildings will
require approval of an amended CUP.
4. Any lighting will be pointed in a downward direction to minimize impact on surrounding
property owners.
5. All parking shall be located on site. No parking along the roadway or roadway easement.
The parking area shall be constructed in such a manner as to allow large emergency
response vehicles to be able to turn around and/or back up.
Staff is recommending one more condition: All pole vault activities shall take place indoors.
After the Public Hearing, staff received several letters from neighbors, one letter in support and
several letters of concern. Generalizing the letters of concern, the letters mentioned concerns
about additional traffic, the intersection of SW 134th St. and SW Meadowlark Rd., noise,
emergency vehicle response, road maintenance, the fact that they are already running the
business from the property, parking requirements, and wastewater requirements. Staff has also
spoken with the Township, and they are opposed to the approval. Staff has received a valid
Protest petition in opposition of approval.
The following neighboring landowners gave their reasons the CUP should be denied:

Mr. Stewart stated if the CUP passed, the land and building would have meet all County codes.
Commissioner Jackson motioned to deny Resolution No. 26-29 for a Conditional Use
Permit to operate a Pole Vault Training Center, Case CU 26-07, on property located at 13819
SW 134th St., Rose Hill, Kansas, due to the factors stated. Commissioner Herzet seconded the
motion. Motion carried 4-0.

ITEM #8 – GUARD RAIL REPAIRS
Curtis Mader, Public Works Director, came before the Board for approval of an invoice from J
and J Contractors to rebuild burnt guardrail. Guardrail on bridges is used to help keep vehicles
on the roadway if they begin to leave their lane or drift off the road. Guardrails act as a safety
barrier designed to redirect errant vehicles, reducing the risk of them going over the edge of the
bridge or into opposing traffic. Guardrails also help absorb and dissipate impact energy, which
can lessen the severity of crashes and improve overall safety for motorists. A guardrail on NW
Haverhill Rd., 0.1 miles south of NW 30th St. was found to be burned. Staff decided to have
the guardrail repaired when J and J Contractors were already working in the County. The cost of
this repair in $15,001.
Commissioner Jackson motioned to approve he guardrail repairs in the amount of $15,001.
Commissioner Woydziak seconded the motion. Motion carried 4-0.

ITEM #9 – SECURITY CAMERAS
Curtis Mader, Public Works Director, came before the Board for approval for Information
Technology (IT) to send out a Request for Proposals (RFP) to purchase and install cameras at the
North Shop, South Shop and Noxious Weed Department. Cameras have already been installed at
the Landfill and have had huge success in terms of security and video documentation. Installing
security cameras at the shops can help protect County property, equipment, and vehicles from
theft, vandalism, and unauthorized access. Cameras also provide valuable documentation in the
event of accidents, safety incidents, or disputes, helping to improve accountability and workplace
safety. To respect employee privacy, cameras will only be placed in work areas, entrances, exits,
and equipment storage locations, and will not be installed in break rooms or other areas where
employees have a reasonable expectation of privacy.
Commissioner Herzet motioned to approve the RFP to be issued for the purchase and
installation of security cameras. Commissioner Jackson seconded the motion. Motion carried
4-0.

Commissioner Jackson attended Jamie Downs, Health Director, and Vicky Wiebe, Health
Department, retirement reception on Friday and stated the reception was nice and had a great
turnout.

the Planning and Zoning Board at 6:00 p.m. tonight
June 24th - Work Session for Eastern Red Cedar management in the County
June 25th - The CAT meeting at Holly Sinclair Refinery
June 30th - Quad County Meeting at Point Nine, Andover, Kansas, at 11:45 p.m.
Ms. Wright asked for contact information for the Planning and Zoning Board; Administrator
Johnson stated they are all volunteers and staff does not give out their personal information. Ms.
Wright can give everything to Mr. Stewart and he will give it to the Planning and Zoning Board
members.

RECOMMENDATION
Consider approval of the appointment of Emily Jensen as the Health Officer for Butler County, KS in
accordance of K.S.A. 65-201.

BACKGROUND
The board of county commissioners of each county shall act as the county board of health for the
county. Each county board shall appoint a person licensed to practice medicine and surgery, preference
being given to persons who have training in public health, who shall serve as the local health officer and
who shall act in an advisory capacity to the county board of health. The appointing authority of citycounty, county or multicounty health units with less than 100,000 population may appoint a qualified
local health program administrator as the local health officer if a person licensed to practice medicine
and surgery or person licensed to practice dentistry is designated as a consultant to direct the
administrator on program and related medical and professional matters. The local health officer or local
health program administrator shall hold office at the pleasure of the board.
ANALYSIS
With the retirement of Jamie Downs the position of Health Officer is vacant in Butler County. The
County through a search process selected Emily Jensen as the next Health Department Director for
Butler County to replace Jamie. As such the Board is required to make the appointment of a Health
Officer which traditionally has been the Health Department Director as the County contracts with with
Dr. Rousch as a medical consultant and medical director for the Butler County Health Department. The
appointment of Ms. Jensen would be in compliance to K.S.A. 65-201 and she would serve in this
position at the pleasure of the board and until such time as a successor is appointed.

65-201. County, city-county and multicounty units; local health officers; appointment, tenure, removal; laws
applicable; review, amendment or revocation of local health officer orders; limitation on certain orders;
approval by board of county commissioners required; civil action for relief from orders. (a) The board of county
commissioners of each county shall act as the county board of health for the county. Each county board shall appoint a
person licensed to practice medicine and surgery, preference being given to persons who have training in public health,
who shall serve as the local health officer and who shall act in an advisory capacity to the county board of health. The
appointing authority of city-county, county or multicounty health units with less than 100,000 population may appoint
a qualified local health program administrator as the local health officer if a person licensed to practice medicine and
surgery or person licensed to practice dentistry is designated as a consultant to direct the administrator on program and
related medical and professional matters. The local health officer or local health program administrator shall hold
office at the pleasure of the board.
(b) (1) Except as provided in paragraph (2), any order issued by the local health officer, including orders issued as
a result of an executive order of the governor, may be reviewed, amended or revoked by the board of county
commissioners of the county affected by such order at a meeting of the board. Any order reviewed or amended by the
board shall include an expiration date set by the board and may be amended or revoked at an earlier date by a majority
vote of the board.
(2) If a local health officer determines it is necessary to issue an order mandating the wearing of face masks,
limiting the size of gatherings of individuals, curtailing the operation of business, controlling the movement of the
population of the county or limiting religious gatherings, the local health officer shall propose such an order to the
board of county commissioners. At the next regularly scheduled meeting of the board or at a special meeting of the
board, the board shall review such proposed order and may take any action related to the proposed order the board
determines is necessary. The order shall become effective if approved by the board or, if the board is unable to meet, if
approved by the chairperson of the board or the vice chairperson of the board in the chairperson's absence or disability.
(c) The board of county commissioners in any county having a population of less than 15,000 may contract with
the governing body of any hospital located in such county for the purpose of authorizing such governing body of the
hospital to supply services to a county board of health.
(d) (1) Any party aggrieved by an order issued pursuant to subsection (b)(2) may file a civil action in the district
court of the county in which the order was issued within 30 days after such order is issued. Notwithstanding any order
issued pursuant to K.S.A. 20-172(a), and amendments thereto, the court shall conduct a hearing within 72 hours after
receipt of a petition in any such action. The court shall grant the request for relief unless the court finds such order is
narrowly tailored to the purpose stated in the order and uses the least restrictive means to achieve such purpose. The
court shall issue an order on such petition within seven days after the hearing is conducted. If the court does not issue
an order on such petition within seven days, the relief requested in the petition shall be granted.
(2) Relief under this section shall not include a stay or injunction concerning the contested action that applies
beyond the county in which the action was taken.
(3) The supreme court may adopt emergency rules of procedure to facilitate the efficient adjudication of any
hearing requested under this subsection, including, but not limited to, rules for consolidation of similar hearings.

BACKGROUND
The landfill operates two trash compactors: a CAT compactor for municipal solid waste (MSW) and a
BOMAG compactor for construction and demolition debris (C&D). The BOMAG has four motors that
run each wheel.
ANALYSIS
Last fall, the BOMAG experienced a failure of one of its wheel motors. We evaluated both replacing
and rebuilding the motor, with the replacement costing $49,045.97 and the rebuild costing $26,045.44.
After discussions with Barry Tractor and our maintenance staff, we are concerned that rebuilding the
motor may not provide a long-term solution and could result in another failure, placing us back in the
same situation. Although the replacement cost is higher, we recommend replacing the wheel motor to
provide a more reliable backup machine and reduce the risk of future downtime and additional repair
expenses. I would like to add 15% to make sure to cover the cost of the repairs. This estimate does not
include freight.
FINANCIAL CONSIDERATION
The vendor for the purchase is Barry Tractor and the invoice of $56,400 will come out of 0045-0416233-000 Equip Maint. & Repair.
