Action Requested: Approve the Public Works Department to enter into a sale agreement for the two
CAT Road and Bridge Dozers.
Analysis: The county leased the dozers from Foley, the board has already declared as surplus,

and a replacement lease was executed for the equipment. We have the option of selling them
to Foley for a predetermined profit. This process is very similar to the county manages the fleet
vehicles. The other option is to list the item on PurpleWave for an unknown return.

Action Requested: Consider the attached Board Policy creating administrative procedures
for compliance with Kansas law requiring the designation of multiple-occupancy private
spaces in public buildings for use by only one sex.
Recommendation: Take action as deemed appropriate.
Analysis: During the 2026 Legislative Session, the Kansas Legislature enacted H Sub for
SB 244, which requires the designation of multiple-occupancy public spaces in public
buildings for use by only one sex. The law requires that local governments maintain
processes to receive, investigate and respond to complaints of violations of the law. Failure
to comply with the law creates the potential for civil monetary penalties against the County
of $25,000 for a first violation and $125,000 for each subsequent violation.
To comply with the law, staff have already completed an inventory of the County’s
multiple-occupancy private spaces in County-owned buildings and confirmed that these
facilities have appropriate signage. Staff have also prepared the attached Board Policy that
provides for the management of complaints of violation of the law.
Alternatives: 1) Adopt the Board Policy as proposed, 2) Decline to adopt the Board Policy,
3) Modify the Board Policy, or 4) Table the matter for further study.

POLICY MANUAL
ISSUED BY

BOCC

EFFECTIVE DATE

REVISION
DATE

PURPOSE:
The Kansas Legislature passed House Substitute for Senate Bill 244 during the 2026
Legislative Session, which requires the designation of Multiple-Occupancy Public Spaces in
public buildings for use by only one sex. The Leavenworth County Board of County
Commissioners (BOCC) wishes to implement the following policy regarding the designation and
use of Multiple Occupancy Private Spaces as defined and regulated under Kansas law. Any
current policy or practice in place that conflicts with this policy is repealed.

POLICY:

I.

II.

III.

Purpose. The purpose of this policy is to ensure compliance with House Substitute
for Senate Bill 244 (adopted 2026) regarding the designation and use of multipleoccupancy private spaces owned or leased by Leavenworth County. This policy
establishes procedures for designation of such spaces, responding to complaints,
and documenting actions taken to comply with the law.
Applicability. This policy applies to all public buildings owned and leased by
Leavenworth County, except for buildings owned by Leavenworth County that are
leased to a private entity if the lease agreement was in force before February 26,
2026.
Definitions. For purposes of this policy, the following definitions apply:
a. Complaint Form: a complaint form substantially in the form of Exhibit A to this
policy.
b. Multiple-Occupancy Private Space: a facility designed or designated for
simultaneous use by more than one individual and in which an individual may be
in a state of undress in the presence of another individual, regardless of whether
the facility provides curtains or partial walls for privacy. For purposes of this
policy, multiple-occupancy private space includes, but is not limited to, a
restroom, locker room, changing room, or shower room.
c. Single-Occupancy Private Space: a facility designed or designated for use by
only one individual at a time and in which the individual may be in a state of
undress. For purposes of this policy, single-occupancy private space includes,
but is not limited to, a single toilet restroom with a locking door that is designed or
designated as unisex, or a family restroom or charging room.
d. Sex: an individual’s biological sex, either male or female, at birth.

VIII.

Designation of Facilities.
a. All multiple-occupancy private spaces located within a building owned or leased
by the County and subject to this policy shall be designated for use only by
individuals of one sex.
b. Clear signage shall be posted identifying the designation of each multipleoccupancy private space.
Exceptions. Consistent with Kansas law, individuals may enter multiple-occupancy
public spaces designated for the opposite sex:
i. for custodial, maintenance, or inspection purposes;
ii. to render medical or other emergency assistance;
iii. to accompany and provide assistance to an individual who needs
assistance using the facility;
iv. for law enforcement purposes;

Action Requested: Consideration of a Resolution disorganizing Rural Fire District No. 1 of Leavenworth
County, Kansas (“Fire District No. 1”).
Recommendation: Approval of a Resolution (attached) disorganizing Fire District No. 1.
Analysis:
•

Fire District No. 1 was formed in 2003 by the Board of County Commissioners of Leavenworth
County, Kansas (“County”) and was comprised of the City of Lansing, Delaware Township, and
High Prairie Township.

•

In 2025, the City of Lansing, Delaware Township and High Prairie Township all filed petitions to be
removed from the boundaries of Fire District No. 1 and now provide for their own fire protection.

•

Fire District 1 no longer has any territory, nor does it provide for fire protection. K.S.A. 19-3604 now
allows a Board of County Commissioners to disorganize a Fire District upon their own motion when a
fire district no longer has any territory by following the procedures set out in K.S.A. 19-3602.

•

Upon adoption, the resolution and attached map will be published in the official county newspaper three
times in accordance with K.S.A. 19-3602. A public hearing on the advisability of disorganizing Fire
District 1 will be held on September 9, 20026.

Alternatives: 1) Decline to disorganize Fire District No. 1; 2) Table the matter for further study.
