COMMENTS FROM THE PUBLIC.
Pastor Wayne Ova~ A couple of weeks ago we celebrated my 40th year at Faith Baptist
Church. Originally, I was going to retire near the end of this year but the Lord spoke to me and I
am going to stay for another couple of years.

Lee Brewer (205 Brown Ave.) ~ When is Alcove going to finish fixing the school?
There are still broken windows and open ventilation ducts. Who is paying to mow this property?
If Alcove can’t handle this small property, how are they going to handle a hyperscale data
center?
Chris Bowles (30750 Osawatomie Rd) ~ GW Weld met with me at a coffee shop. I
really pressed him on the risks. I wanted to know how they did their risk assessments, what they
felt were their areas of least risk, most risk and what they were doing to address the most risk.
Jeff Hartl (37765 Cresent Hill Road) ~ I did not know if I was going to have time to get
there tonight, so I sent a letter to the newspaper editor explaining my feelings and what is going
on in the data centers. You represent us. Your friends, your family, your constituents have all
been coming and talking to you and saying that we do not want this. It is not good for the
community.
Ian Day (36397 W. 367th Street) ~ I was at the Topeka Data Center Summit. Evergy and
Google discussed the major corporate grid settlement adjusting the grid rules. The lobbyists
want to add a clean energy rider to the settlement. The data center will pay the utility provider a
fee. That fee will go to fund massive green energy infrastructure such as wind farms, solar farms
and battery storage. What else are we going to get besides a data center?
Sarrah Chapman (4840 Labette Rd.) ~ It was a red flag when I heard the developer
compare the sound of nature to the sound of their data center. They said it is so loud here with
the cicadas that the data center sound won’t be noticed. This person does not care about our
community. There are reports of data centers being responsible for killing bees and cattle in
Texas from the constant hum.
Jennifer Harp (33301 Osawatomie Rd.) ~ In January 2025, you passed Resolution 1276 –
establishing a temporary moratorium on shipping container structures. This resolution was
introduced under the banner of strict oversight, community protection and the necessity to
maintain orderly standards for our town. Project Catalyst is a major initiative with massive longterm implications on our infrastructure, neighborhoods and environment. It is a development
that demands the highest level of regulatory scrutiny. Apply the same rigorous zoning,
transparency and accountability to Project Catalyst as you expect from every other resident and
business in Osawatomie.
Len Jensen (34225 Lookout Road) ~ I oppose this project because in 2006 the city was
offered this property and it was supposed to revert back to the state in twenty years. Somebody
went to the state and got it turned back to the city. I think that is wrong. My challenge is for you
to go talk to your people to find out why they don’t like it. You are in charge not the city
manager.
Chasity Hendrickson (29980 W. 335th St.) ~ I do not support rezoning the additional
acreage from residential to industrial use. Farmland is precious & should be preserved. This
comment was emailed.

PRESENTATIONS, PROCLAMATIONS AND APPOINTMENTS
PAYING THE WAY - Deputy City Manager Michele Silsbee gave an update on the
progress of the street repairs, replacement and maintenance under the Paving the Way-Steet Repair
and Replacement plan.
UNFINISHED BUSINESS.
ORDINANCE 3880 – ADOPTION OF THE 2026 UNIFORM PUBLIC OFFENSE CODE
- The Standard Traffic Ordinance (STO) for Kansas Cities and the Uniform Public Offense Code
(UPOC) for Kansas Cities have been published by the League of Kansas Municipalities for
decades. They are designed to provide a comprehensive traffic code (STO) and criminal code
(UPOC) for Kansas Cities.
The STO, in large part, parallels the state traffic act, just as the UPOC parallels the state criminal
code. They do not take effect in a city until the governing body has passed and published an
ordinance incorporating each of them by reference. The incorporating ordinances do not change
the current modifications to the STO and UPOC which are already in the City Code. The Council,
using its ordinary home rule authority, may make changes to both the UPOC and the STO, so long
as the changes do not conflict with state statute (i.e. less stringent than state statute).
Changes in the 42nd Edition of UPOC
Section 3.5.1 Unlawful Approach of a First Responder
S Sub for HB 2372 introduced a new law that makes it unlawful for anyone to be within 25 feet
of a first responder while the first responder is engaged in the performance of their duties.
Section 3.1.1 Domestic Battery
The domestic battery language was amended to require an offender assessment as a condition of
anyone granted probation or having had their sentence suspended.
Section 6.1 Theft
This section has a few language edits regarding the term “knowing”, and also adds in offenses
for grain or hay, livestock, or motor vehicles between $500 and $1,500 in value.
Section 6.17 Criminal Use of a Financial Card or Gift Card
This section was expanded to include criminal use of gift cards, adding in language that would
make theft, altering, or tampering with a gift card a crime under this section.
Section 10.1.1 Criminal Carrying of a Weapon
Subsections (b) and (c) were flipped in accordance with how K.S.A. 21-6302 is structured.

Section 11.11. Cruelty to Animals
A new subsection (c) was added to this section to provide a carve out for persons who are
catching feral cats for the purpose of vaccination, spaying, or neutering, before returning them to
the place they were caught.
Section 4.5 Buying Sexual Relations
This section was removed as this offense is now solely classified as a severity level 9, person
felony, and no longer necessary for the UPOC.
Motion made by Bratton, seconded by Filipin to approve Ordinance 3880 – Regulating public
offenses within the corporate limits of the City of Osawatomie, Kansas; incorporating by
reference the “Uniform Public Offense Code for Kansas Cites” edition of 2026; Amending and
repealing Chapter 11, Article 2, Section 201 of the City of Osawatomie Municipal Code; and
repealing existing provisions as presented. Yeas: All.

ORDINANCE 3881 – ADOPTION OF THE 2026 STANDARD TRAFFIC ORDINANCE
Changes to the 53rd Edition of the STO
Section 126.2.1 Use of a Mobile Telephone While Operating a Motor Vehicle in a School Zone
or Road Construction Zone
This is a new section that comes from SB 366 and places a prohibition on using cellphones and
other wireless communication devices in school zones during the time when the reduced speed is
enforced, or in a road construction zone where workers are present.
Section 169.2 Use of Lights in Road Construction Zones
This newly added section, also from SB 366, expands the usage of certain colors of flashing
lights in road construction zones.

Section 93. Parking Disabled and Other Vehicles
Here, we have a small change that expands the interference in subsection (b) to include law
enforcement operations.
Section 126.1 Obstructing License Plates
This section expands and defines obstructions of license plates to include frames and borders
around plates that may make it difficult to determine the registration number, state, or the month
or year of expiration on the registration decal. Additionally, subsection (b) was previously a part
of Section 126.1.1 Display of License Plate.
Section 126.1.1 Display of License Plate
Subsection (c) was removed from this section and inserted into the aforementioned Section
126.1.
Section 201.1 Failure to Comply with a Traffic Citation
This was a small change that removed the former subsection (h)(2) regarding division
notification from five years post-conviction.
Motion made by Dickinson, seconded by Bratton to approve Ordinance 3881 – Regulating traffic
within the corporate limits of the City of Osawatomie, Kansas; incorporating by reference the
“Standard Traffic Ordinance for Kansas Cities” edition of 2026, with certain omissions, changes,
and additions; prescribing additional regulations; amending Chapter 14, Article 1, of the City of
Osawatomie Municipal Code; and repealing existing provisions as presented. Yeas; all.
ORDINANCE 3882 – APPROVING FRANCHISE AGREEMENT WITH EVERGY (no
action) - The city's franchise agreement with Evergy expired several years ago and has not been
renewed. As a result, the city was able to assume electric service responsibilities for the State
Hospital and several other properties located north of the Marais des Cygnes River that were within
the city limits.
Historically, the amount of franchise fee revenue generated through Evergy's facilities within the
city has been relatively limited. However, the city has recently been approached regarding a
potential development project in the Northland area that, if constructed, could result in
substantially increased electric consumption on properties that may be served by Evergy.
Now that three of those parcels are being considered for a data center complex, the demand for
electricity is significant and we will want to have a franchise agreement in place. The previous
agreement percentage was 5% and that is the number that has been provided to the developer for
consideration in the community benefits analysis. The franchise agreement will be applicable to
all Evergy served parcels within the City of Osawatomie, of which, there are very few, all south
of Pottawatomie Creek.
This franchise agreement has been negotiated and the modifications have been accepted by

Evergy. Our city attorney has also reviewed the agreement. Evergy published their notice to the
public of their intent to enter into this agreement in the July 8th edition of the Miami County
Republic, which is a requirement of them in state law.

NEW BUSINESS
RESOLUTION 1387 – AUTHORIZING SALE OF CITY OWNED PROPERTY – Over
the last year, the city has come into possession of three vacant lots that were on the Miami County
tax sale last year. The addresses of those properties are: 1105 Walnut, 736 Parker, and 727 Lincoln.
The city was given all three of these parcels either by way of a trade that the council approved
earlier this spring, between the City and Korey Holmberg (remember the easement issue across
city owned property and he expressed an interest in trading these two buildable lots for the of
parcel the city owned in the floodplain), or through enforcement of the city’s property maintenance
code (which was the case at 1105 Walnut). The owner of the 1105 Walnut property elected to give
the city the property and trailer and let us tear the trailer down because he didn’t want the expense
of dealing with the trailer.
Staff would like the council to approve an RFP and sealed bid process like we have done in the
past, to dispose of these lots to the highest bidder on the condition that each lot has a new home
built on it within 18 months from the closing date of the sale.
Motion made by Schasteen, seconded by Filipin to approve Resolution 1387 – Authorizing the
city manager to issue an RFP for the sale of three city-owned lots as presented. Yeas: All.
EXECUTIVE SESSION
ATTORNEY-CLIENT PRIVILEGE - K.S.A. 75-4319(b)(2) - Motion made by Dickinson,
seconded by Henness that the City Council recess into closed, executive session for the purpose
of discussing personnel matters of nonelected personnel pursuant to the exception in K.S.A. 754319(b)(1). The closed meeting will last twelve minutes and will resume here in the Osawatomie
Middle School Gym at 7:03 p.m. Also attending will be the City Manager Bret Glendening and
City Attorney Jeff Deane. Yeas: All.
The council meeting resumed to open session at 7:03 p.m. with no action taken.

COUNCIL REPORTS - None.

Subject: 715 Pacific Avenue – Request for Extension of Rehabilitation Deadline

Good afternoon Daniel,
I am writing regarding the rehabilitation of 715 Pacific Avenue and the August 31, 2026 completion
deadline established by Resolution 1378.
We remain fully committed to completing the rehabilitation and have continued moving the project
forward. However, the required environmental testing, selective demolition, and engineering process
took substantially longer than anticipated. In particular, the structural engineer’s availability and the
time required to complete the drawings created delays outside our control.
The project timeline to date is as follows:
May 27: Building permit and business license applications submitted
June 1: Building permit issued and project commenced
June 9: Titan Environmental testing results received
June 18: Two structural engineering firms contacted
June 22: Selective demolition began to expose the framing and structural conditions
July 6: First available date for the structural engineer to inspect the property
July 30: Final structural plans completed
As required, we retained Titan Environmental to perform lead-based paint and asbestos testing. Once
the results were received, we performed selective demolition to expose the framing and determine the
full extent of the structural work. The engineer could not accurately evaluate the structure or prepare
the necessary repair drawings until these conditions were exposed.
On June 18, we contacted two structural engineering firms that we regularly use. The earliest available
inspection was July 6. Following the inspection, it took several additional weeks for the engineer to
complete the final structural drawings. Although this process took longer than anticipated, we
continued advancing each required step as quickly as reasonably possible.

The completed structural drawings and the engineer’s invoice are attached to document the work
performed and our continued investment in the project.
We now have the structural plans and have a framer and foundation contractor ready to begin as soon
as you approve the drawings. After the structural work, the remaining rehabilitation will require
licensed plumbing, electrical, and mechanical contractors, together with the corresponding city
inspections. Based on the remaining scope, we realistically anticipate completing the rehabilitation by
October 31, 2026.
Before committing substantial additional funds to the structural work and remaining rehabilitation, we
respectfully request:
1. A formal extension of the completion deadline from August 31, 2026, through October 31, 2026;
and
2. Written confirmation that the city will not proceed with demolition while we are actively
completing the work, complying with inspection requirements, and demonstrating continuous
progress.
We understand the city’s concerns regarding the condition of the property, and we are not requesting
an indefinite extension. We are willing to provide photographs of the work completed to date,
environmental testing results, contractor information, and periodic progress updates. We would also
be willing to agree to reasonable interim milestones so the city can verify that the rehabilitation is
progressing.
We have already invested significant time and money into saving this property and are now prepared
to begin the most substantial phase of the rehabilitation. We need reasonable assurance that the city
will allow us the necessary time to complete the project before we commit the significant additional
funds required for the structural work and remaining improvements.
Please let us know what formal action is required to amend the deadline and whether this request
needs to be placed before the City Council. We would appreciate addressing this as soon as possible
so our contractors can proceed without further delay.
Thank you,
Ian Reeves

R VALUES ARE MINIMUMS. U - FACTORS AND SHGC ARE MAXIMUMS. WHERE INSULATION IS
INSTALLED IN A CAVITY THAT IS LESS THAN THE LABEL OR DESIGN THICKNESS OF THE
INSULATION, THE INSTALLED R-VALUE OF THE INSULATION SHALL NOT BE LESS THAN THE
R-VALUE SPECIFIED IN THE TABLE.
THE FENESTRATION U - FACTOR EXCLUDES SKYLIGHTS. THE SHGC APPLIES TO ALL GLAZED
FENESTRATION.
"10/13" MEANS R-10 CONTINUOUS INSULATION ON THE INTERIOR OR EXTERIOR OF THE HOME
OR R-13 CAVITY INSULATION ON THE INTERIOR OF THE BASEMENT WALL.
R - 5 SHALL BE PROVIDED UNDER THE FULL SLAB AREA OF A HEATED SLAB IN ADDITION TO THE
REQUIRED SLAB EDGE INSULATION R-VALUE FOR SLABS, AS INDICATED IN THE TABLE. THE
SLAB EDGE INSULATION FOR HEATED SLABS SHALL NOT BE REQUIRED TO EXTEND BELOW THE
SLAB.
THERE ARE NO SHGC REQUIREMENTS IN THE MARINE ZONE.
BASEMENT WALL INSULATION SHALL NOT BE REQUIRED IN WARM-HUMID LOCATIONS AS
DEFINED BY FIGURE N1101.10 AND TABLE N1101.10.
ALTERNATIVELY, INSULATION SUFFICIENT TO FILL THE FRAMING CAVITY PROVIDING NOT LESS
THAN AN R-VALUE OF R-19.
THE FIRST VALUE IS CAVITY INSULATION, THE SECOND VALUE IS CONTINUOUS INSULATION.
THEREFORE, AS AN EXAMPLE, "13+5" MEANS R-13 CAVITY INSULATION PLUS R-5 CONTINUOUS
INSULATION.
MASS WALLS SHALL BE IN ACCORDANCE WITH SECTION N1102.2.5. THE SECOND R-VALUE
APPLIES WHEN MORE THAN HALF OF THE INSULATION IS ON THE INTERIOR OF THE MASS WALL.

ACTION ITEM SUMMARY
Resolution 1388
City Manager

Item Number:
Date:
From:

RE: Resolution 1388 – Authorize returning the HEAL grant and approving an RFP for demolition services
RECOMMENDATION: Approve the resolution
DETAILS: Unfortunately, the developer and their contractor have done a more extensive evaluation of what it
would take to salvage the building and believe that the costs to just stabilize the building, let alone the costs to
make it useable are incredibly prohibitive. The risks involved with stabilizing the building are too great and the
cost to demolish and build a new building is less than the cost to save the existing building.
I would recommend that the council approve this resolution which will terminate the HEAL grant with the
Department of Commerce as well as authorize an RFP to take the building down. Once bids are received and
opened, I will bring them to the council with a recommendation of award. Additionally, since the project has
changed significantly, we need to amend the development agreement to reflect the changed nature of the
project as well as incorporate a schedule of work. The goal has always been to transfer this out of city ownership
and back to the private sector, and the sooner that happens the better.
As a reminder, the timeline for this project started in December of 2024 with the search for a developer. In June
of 2025, US Federal Properties viewed the building, made an offer, and we worked through a basic development
agreement. In October 2025 the development agreement was approved for both 500 and 510 Main, as was an
authorization to apply for the HEAL grant.

RESOLUTION NO. 1388
AUTHORIZING CITY STAFF TO TERMINATE THE HISTORIC ECONOMIC ASSET
LIFELINE (HEAL) GRANT WITH THE KANSAS DEPARTMENT OF COMMERCE
AND ISSUE AN RFP FOR THE DEMOLITION OF 510 MAIN
WHEREAS, the City of Osawatomie has established a set of goals to aid in revitalizing
the community and one of those goals is to focus on economic development, including housing of
all types; and
WHEREAS, in 2025, the City issued an RFP for 500 and 510 Main and received one
acceptable proposal from US Federal Properties; and
WHEREAS, the HEAL grant was awarded for the sole purpose of restoring 510 Main;
and
WHEREAS, despite the need to demolish 510 Main, US Federal Properties is still
interested in helping to revitalize our downtown corridor; and
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE
CITY OF OSAWATOMIE, KANSAS, AS FOLLOWS:
SECTION 1. The governing body authorizes the City Manager to terminate the HEAL
agreement with the Kansas Department of Commerce.
SECTION 2. The governing body hereby directs the City Manager to develop an RFP for
the demolition of 510 Main and report back to the council, the number of bidders, the bids they
provided to perform the work, as well as make a recommendation on who the council should award
the work to.
SECTION 3. The governing body further authorizes the City Manager to work with
developers to amend the development agreement to reflect the changed nature of the project as
well as set forth a schedule for work to begin and be completed by.

RE: Resolution 1390
RECOMMENDATION: That City Council approve Resolution 1390 – Letter of Intent with Shoot House, LLC.
DETAILS: Resolution 1250 was approved by the council on August 8, 2024 and it approved an LOI and lease
agreement with an option to purchase the land. The price of the land was established based on an appraisal
that was performed on the property prior to the lease agreement being executed in June of 2025.
Title to the property remains with the city until the Lessee exercises their right to purchase the property. The
owners of Shoot House Paintball have exercised their right to purchase the property and in order to complete
the sale and secure title insurance, the underwriters for the insurance company have requested a resolution be
adopted by the council accepting and confirming the sale of the property to Shoot House Paintball. The property
is 10.53 acres and the agreed upon price was $57,430.62.

CITY OF OSAWATOMIE
CITY MANAGER’S REPORT
August 13, 2026
Water Treatment Plant and Distribution Project Status:
Plans for the water distribution portion of this project have been reviewed and approved by KDHE
and package 1 of the plans (of 2 packages) for the water treatment plant have been submitted to
KDHE for review. We have identified the following systems as being on the critical path to
complete the project by the required timeframe: 1. Systems Integrator; 2. Slide Gate Materials; 3.
Presidimentation Equipment; 4. Rapid Mix Equipment; 5. Sedimentation Equipment; and 6.
Filtration Equipment. These critical path equipment packages will be the first packages we procure
this fall.
We received our first pass at the GMP, and we are still evaluating it and asking questions. After
we have completed the evaluation process, we will release the number. The GMP is allowed to
update once more, once KDHE signs off on the water treatment plant’s plans, but only to the extent
that the plans change. We should be able to advertise for the water distribution portion of the
project soon and we hope to make a recommendation to the council on the contractor for that work
early this fall. Lastly, we’ve had an update to the schedule. This is not the final version, and it will
be updated as we learn more lead times from suppliers as we work through the GMP process. New
dates are below:

Data Center Update:
On Monday, July 13, the motion to cease service with Evergy was filed at the KCC and Evergy
filed their motion during the same week. The first meeting in August will be the date for the
adoption of the new franchise agreement with Evergy.
Northland Inquiry:
On July 1, I received a call from the Kansas Dept. of Commerce. They have a manufacturer who
employs approximately 150 people, looking for ~20 acres. What they manufacture has not yet
been disclosed, but they have stated that it is a family-owned operation that has been in business
for nearly 100 years. They stated they are not a heavy user of utilities. The property they were
inquiring about was the parcel where the solar array is. I asked the Dept. of Commerce to confirm

what the company’s building height would need to be because of the shade easement protecting
the solar array. I will keep the council apprised of any developments on this project.
Memorial Hall Restoration:
Now that the interior of the building is complete, the restoration committee will turn its attention
to the exterior. Sidewalks and accessibility will be addressed in the coming weeks.
Court will remain at 605 O’Neal.
KDOT Transportation Alternatives Grant:
Early start will be July 27th and late start will be at the end of either September or October. We
will be working with KDOT and the awarded contractor to settle on a start date.
AMI Meter Update & Water Main Extension to Sunflower Recovery Center:
As of July 17, 1,579 (of 1,680) meters have been installed. Most of the meters being installed now
are the larger service meters, which will take longer to complete. Additionally, our water crew
continues to work on installing the new water main by the state hospital. As of mid-July, we are
still optimistic that we will be done by the end of the month. They have approximately 750 more
feet to go, plus the testing of the main before it goes into service. They are currently producing
between 40’ and 80’ per day, depending on whether they are in rock or not.
500/510 Main – Redevelopment:
Unfortunately, additional investigation has been made of 510 Main and the contractor and the
developer would like permission to return the HEAL Grant, demolish the building and build back
new. The cost to just stabilize the building in order to start restoration is nearly as much as the cost
to build a new building. Since the project has changed substantially, we need to revisit the
development agreement and redefine what this project is going to ultimately be and how long this
project is going to take to be completed.
2027 Street Improvements:
As Deputy City Manager Michele Silsbee presented at the last council meeting, we’ve made
significant progress on our Paving the Way program in the last five years. Since we are capped out
on how much we want to levy (not how much we can issue in terms of debt), we need to look
towards projects that can be paid for as they are completed. That means we will be looking at
several street projects that have adequate base and curbs. We have sat down and identified several
streets that could benefit from a mill and overlay project next year. I do not anticipate getting to
do all of these, but here are the ones that are on the list: Main Street from 12th to 18th, Walnut from
7th to 12th, Lom Vista, Brown Circle Drive, and Carr from 1st to 6th (this last one won’t be done
until the water line is replaced).
Library Expansion Update:
The final schematic design review was held on July 1. I hope we are in a position to apply for a
CDBG grant for the library project later this summer. As a reminder, the estimated cost is $272,250
to prepare a set of construction ready plans and work through the construction phase. We will
continue to identify grants to help offset some of these planning expenses.

Hickory Valley and Indian Ridge RFPs:
I anticipate issuing these for bid again this year. The recently released housing study for Miami
County and more specifically, Osawatomie which is attached, indicates that much more housing
is going to be needed than what we have been accustomed to getting on an annual basis for the
past couple of years and those growth pressures are going to continue. I am optimistic that we can
find developers for both of these properties in light of that housing study.
2025 Golf Course Clubhouse and Community Facility Project:
The design for the new community center and clubhouse is complete. Our assumed annual debt
payments have increased to approximately $152,000, and this does assume a $650,000 CDBG
grant. We have heard from CDBG that they will consider the project in 2026’s CDBG application
process because of the community facility aspect. The current estimated cost of construction is
approximately $3.5M and we would be looking to finance $2.85M for 30 years.
