ORDINANCE NO. 2026.13

AN ORDINANCE OF THE TOWNSHIP OF PENNSAUKEN TO REPEAL ORDINANCE 2025.05 WHICH PROVIDED
FOR SALARIES AND COMPENSATION TO BE PAID TO THE OFFICERS AND EMPLOYEES OF THE TOWNSHIP
OF PENNSAUKEN AND SUBSITITUE THEREFORE SALARIES AND COMPENSATION HEREIN FOR THE YEAR
2026 AND BEYOND
BE IT ORDAINED by the Township Committee of the Township of Pennsauken, County of Camden, State
of New Jersey as follows:

SECTION 1
This ordinance sets the minimum and maximum salaries (listed in Attachment A) for the officers
and employees of the Township of Pennsauken, County of Camden, State of New Jersey, in accordance
with the provisions of this Ordinance, as set forth below to be effective upon adoption.

SECTION 2 AUTHORITY OF TOWNSHIP ADMINISTRATOR TO PAY BETWEEN MINIMUM AND MAXIMUM
RATES
In addition to any other authority for the payment of salary and other remuneration that may
be set forth in this Ordinance, or any applicable Collective Bargaining Agreement, the Township
Administrator shall have the discretion to pay all employees and officials of the Township covered by
this Ordinance, an amount of money which shall be no less than the minimum or greater than the
maximum amounts as set forth in Section 1 of this Ordinance.
In the event that a union negotiated salary increase or, in the case of a non-union employee, an
across the board increase, or other similar salary adjustment causes an employee to exceed the
maximum rates established herein, the employee may receive a salary increase and will not experience
a reduction in salary.
SECTION 3 COLLECTIVE BARGAINING UNITS
The Township Administrator is hereby authorized to make payment of salaries, remuneration,
allowances and expenses as may be provided for any collective bargaining agreement approved by the
Township Committee.
SECTION 4
This Ordinance is not intended to reduce the salary of any person presently employed at a
higher rate than that established herein for that position.

SECTION 5
All ordinances or parts of ordinances inconsistent with this Ordinance are hereby repealed to
the extent of such inconsistency.
SECTION 6
This Ordinance shall take effect immediately upon its proper publication after passage as
required by law.

Ordinance 2026:5
CALENDAR YEAR 2026
ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION
LIMITS AND TO ESTABLISH A CAP BANK
(N.J.S.A. 40A: 4-45.14)
WHEREAS, the Local Government Cap Law, N.J.S. 40A: 4-45.1 et seq., provides that in the preparation
of its annual budget, a municipality shall limit any increase in said budget up to 2.0% unless authorized
by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain
exceptions; and,
WHEREAS, N.J.S.A. 40A: 4-45.15a provides that a municipality may, when authorized by ordinance,
appropriate the difference between the amount of its actual final appropriation and the 3.0% percentage
rate as an exception to its final appropriations in either of the next two succeeding years; and,
WHEREAS, the Township Committee of the Township of Pennsauken in the County of Camden finds it
advisable and necessary to increase its CY 2026 budget by up to 3.5% over the previous year’s final
appropriations, in the interest of promoting the health, safety and welfare of the citizens; and,
WHEREAS, the Township Committee hereby determines that a 1.5% increase in the budget for said
year, amounting to $627,139.05 in excess of the increase in final appropriations otherwise permitted by
the Local Government Cap Law, is advisable and necessary; and,
WHEREAS the Township Committee hereby determines that any amount authorized hereinabove that is
not appropriated as part of the final budget shall be retained as an exception to final appropriation in
either of the next two succeeding years.
NOW THEREFORE BE IT ORDAINED, by the Township Committee of the Township of
Pennsauken, in the County of Camden, a majority of the full authorized membership of this governing
body affirmatively concurring, that, in the CY 2026 budget year, the final appropriations of the Township
of Pennsauken shall, in accordance with this ordinance and N.J.S.A. 40A: 4-45.14, be increased by 3.5%,
amounting to $ 1,463,324.45 and that the CY 2026 municipal budget for the Township of Pennsauken be
approved and adopted in accordance with this ordinance; and,
BE IT FURTHER ORDAINED, that any that any amount authorized hereinabove that is not
appropriated as part of the final budget shall be retained as an exception to final appropriation in either of
the next two succeeding years; and,
BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the
Director of the Division of Local Government Services within 5 days of introduction; and,
BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with the recorded
vote included thereon, be filed with said Director within 5 days after such adoption.

NOW, THEREFORE BE IT RESOLVED, the Township Committee of the Township
of Pennsauken, Camden County hereby rescinds Resolutions 2026:139: 2026:140 and 2026:141

RESOLUTION OF THE TOWNSHIP OF PENNSAUKEN
MAKING APPLICATION TO THE LOCAL FINANCE BOARD
PURSUANT TO N.J.S.A.40A:4-45.3ee
WHEREAS, THE Committee of the Township of Pennsauken in Camden County desires to
make application to the Local Finance Board for its approval of a proposed budget cap waiver
authorizing the Township of Pennsauken to exceed the Spending Cap; and,
WHEREAS, the Committee has determined that:
(a)

it is in the public interest to accomplish such purpose; and,

(b)

the cap waiver is for the health, wealth, convenience or betterment of the
inhabitants of the Township of Pennsauken; and,

(c)

the amount of the cap waiver is not unreasonable or exorbitant; and,

(d)

the proposal is an efficient and feasible means of providing services for the needs
of the inhabitants of the Township of Pennsauken and will not create an undue
financial burden to be placed upon the Township of Pennsauken.

NOW THEREFORE, BE IT RESOLVED by the Township Committee of the Township of
Pennsauken, County of Camden, State of New Jersey as follows:
Section 1. The application to the Local Finance Board is hereby approved, and the Chief
Financial Officer, and Registered Municipal Accountant, along with other representatives of
the Township of Pennsauken are hereby authorized to prepare such application and to
represent the Township of Pennsauken in matters pertaining thereto.
Section 2. The Municipal Clerk of the Township of Pennsauken is hereby directed to
file a copy of the proposed cap waiver with the Local Finance Board as part of such
application.
Section 3. The Local Finance Board is hereby respectfully requested to consider such
application and to record its findings, recommendations and/or approvals as provided by the
applicable New Jersey Statute.

WHEREAS, N.J.S.A. 40A:4-4 establishes the procedures for the adoption of the
fiscal budget; and
WHEREAS, the Township Committee wishes to introduce the Solid Waste Collection
District Budget of the Township of Pennsauken, County of Camden for the Fiscal Year
2026.

Plan and Master Plan Reexamination reports; and
WHEREAS, the Township of Pennsauken Committee acknowledges the rise and
prevalence of facilities commonly referred to as “data centers”, “server farms”, “hyperscale
facilities”, “internet data centers”, “cloud data centers”, and similar facilities that are utilized to
house computer systems and associated components such as telecommunication, and data storage
systems, redundant or “backup” components, infrastructure for power supply, data communication
connections, environmental and safety controls for building climate, equipment cooling, and fire
suppression, and security devices, systems, and installations, for the purpose of aggregating
collective computing demands for cloud services, video streaming, blockchain and crypto mining,
artificial intelligence and machine learning, virtual reality and other data maintenance and
transmission purposes; and
WHEREAS, the Township Committee is aware of growing concerns from the public
regarding the emergence of data centers in the State of New Jersey and the potential environmental,
societal, and socioeconomic impacts, including but not limited to air pollution, climate impacts,
noise, high electrical usage and water consumption; and
WHEREAS, the Township desires to regulate the use of data centers, server farms,
hyperscale facilities and similar facilities; and
WHEREAS, pursuant to N.J.S.A. 40:55D-26, prior to the adoption of a development
regulation, revision or amendment thereto, the municipal governing body is to refer the matter to
the municipal planning board for study and recommendation; and
WHEREAS, the Pennsauken Township Committee desires that the Pennsauken Township
Planning Board undertake a study regarding the regulation of data centers and similar facilities
and make such recommendations as they feel are appropriate.

NOW THEREFORE BE IT RESOLVED, that the Pennsauken Township Planning
Board undergo a study on the regulation of data centers and similar facilities and make such
recommendation for such amendment to the Development Regulations as they feel appropriate.
BE IT FURTHER RESOLVED, that the Municipal Clerk is authorized to forward a
certified copy of this resolution to the Pennsauken Planning and Zoning Offices, and to the
Pennsauken Planning Board Solicitor.

and other factors considered; and

awarding a contract to said entity; and

THAT THE LICENSE BE RENEWED WITH THE CONTINUANCE OF ALL TERMS AND
CONDITIONS IMPOSED BY THE TOWNSHIP COMMITTEE IN PRIOR YEARS. THE
TOWNSHIP CLERK IS HEREBY AUTHORIZED AND DIRECTED TO PREPARE AND ISSUE
THE LICENSE WITH TERMS AND CONDITIONS FOR THE YEAR 2026-2027.

RESOLUTION NO. 2026:188
RESOLUTION OF THE TOWNSHIP OF PENNSAUKEN, IN
THE COUNTY OF CAMDEN, NEW JERSEY, RESCINDING
AWARD OF THE 2026 LAWN MAINTENANCE SERVICES
CONTRACT TO YELLOWSTONE LANDSCAPE AND
AWARDING THE 2026 LAWN MAINTENANCE SERVICES
CONTRACT TO MAPLE LEAF LAWNCARE, INC.
BACKGROUND
WHEREAS, on or about March 20, 2026 the Township of Pennsauken (hereinafter, the
“Township”) advertised it was soliciting bids for 2026 Lawn Maintenance Services (hereinafter,
the “Services”); and
WHEREAS, on or about April 14, 2026, the Township opened bids submitted for the
Services and determined Yellowstone Landscape (hereinafter, “Yellowstone”) was the lowest
responsive bidder with a total bid of $65,768.80; and
WHEREAS, on or about April 15, 2026, the Township formally awarded the Contract for
the Services to Yellowstone; and
WHEREAS, the Contract incorporated the Bid Specifications for the Services (hereinafter,
the “Specifications”) into the Contract; and
WHEREAS, the Specifications provided that by submitting a bid, Yellowstone
acknowledged it had the equipment and manpower to start the work immediately; and
WHEREAS, the Specifications provided that if Yellowstone failed to fulfil its contractual
obligations in a timely and proper manner, or otherwise violated the requirements of the Contract,
the Township may terminate by giving Yellowstone written notice of such termination; and
WHEREAS, on or about May 4, 2026, the Township became aware that Yellowstone had
failed to perform the Services in accordance with the Contract, and informed Yellowstone of such
failure to perform; and
WHEREAS, since the time of award, Yellowstone has continually failed to perform the
Services as provided in the Specifications; and
WHEREAS, examples of Yellowstone’s failure to perform include, but are not limited to:
(1) leaving grass clippings behind; (2) failing to cut the grass in the areas detailed in the
Specifications; and (3) running over trash with a mower rather than picking it up; and

WHEREAS, on or about May 21, 2026, the Township served Yellowstone with official
notice of cancellation of award; and
WHEREAS, pursuant to N.J.S.A. 40A:11-24(b) Yellowstone had twenty-one (21) days
from award of the Contract to execute same; and
WHEREAS, Yellowstone failed to return the executed Contract to the Township before
the statutory deadline; and
WHEREAS, in accordance with the Specifications, the Contract has never been binding
on the Township due to Yellowstone’s failure to successfully execute the Contract; and
WHEREAS, legal counsel for the Township has reviewed the bid submitted by Maple
Leaf Lawncare, Inc. (“Maple Leaf”), the second-lowest numerical bidder who submitted a bid
totaling $80,775.00; and
WHEREAS, legal counsel for the Township has concluded that Maple Leaf’s bid is fully
responsive and compliant with the Specifications and applicable law.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWNSHIP OF PENNSAUKEN, IN
THE COUNTY OF CAMDEN, NEW JERSEY, AS FOLLOWS:
Section 1.
Yellowstone.

The Township hereby rescinds award of the Contract for the Services to

The Township is further authorized to award the Contract for the Services to
Maple Leaf, and to execute same.
Section 3.
June, 2026.

RESOLUTION NO. 2026:189
RESOLUTION OF THE TOWNSHIP OF PENNSAUKEN, IN
THE COUNTY OF CAMDEN, NEW JERSEY, APPROVING
CHANGE ORDER #3 ON THE PENNSAUKEN COUNTRY
CLUB DINING ADDITION AND DECK REPLACEMENT
PROJECT
BACKGROUND
WHEREAS, on January 18, 2024, the Township Committee of the Township of
Pennsauken awarded a contract to RNM Construction (“RNM”) for the Pennsauken Country Club
Dining Addition and Deck Replacement Project (the “Project”) in the amount of $1,889,500.00;
and
WHEREAS, Change Order One was approved on December 5, 2024 for $55,266.00
through Resolution 2024:370; and
WHEREAS, Change Order Two was approved on April 3, 2025 for $12,428.05 through
Resolution 2025:157; and
WHEREAS RNM Construction claims that $18,460.49 remains due and owing for HVAC
design and equipment and $3,300.00 for Credits allegedly due to RNM Construction on this
project, for a total amount of $21,760.49, which amount is in dispute; and
WHEREAS RNM Construction and the Township of Pennsauken have worked out an
Agreement whereby the Township of Pennsauken will pay $3,000.00 toward the $21,760.49
allegedly due to RNM Construction and RNM Construction agrees to repair the lettering on the
country club canopy; and
WHEREAS, the amount allegedly due to RNM Construction shall then be $18,760.49,
which amount shall remain in dispute at this time until resolved by the parties; and
WHEREAS, the Township has further determined that the proposed modification
necessitates a change order to reflect the actual contract amount, and that approval of Change
Order No. 3 paying $3,000.00 toward the balance allegedly due is necessary and appropriate.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWNSHIP OF PENNSAUKEN, IN
THE COUNTY OF CAMDEN, NEW JERSEY, AS FOLLOWS:
Section 1.
The Township hereby approves the proposed Change Order No. 3 in the
amount of a $3,000.00 to be paid to RNM Construction LLC, thus reducing the amount allegedly
due to RNM Construction LLC to $18,760.49.

Section 2.
The Township is further authorized and directed to execute all necessary
documents to effectuate this change, and to take any and all actions necessary to implement this
resolution.
Section 3.
June 2026.

RESOLUTION 2026:190
RESOLUTION AUTHORIZING A CLOSED SESSION OF THE
TOWNSHIP COMMITTEE OF THE TOWNSHIP OF PENNSAUKEN TO DISCUSS
MATTERS OF CONTRACTS
WHEREAS, the Township Committee of the Township of Pennsauken is subject
to the requirements of the Open Public Meetings Act, N.J.S.A. 10:4-6- et. seq; and
WHEREAS, the Open Public Meetings Act of the State of New Jersey generally
requires that all meetings of public bodies be open to the public; and
WHEREAS, the Open Public Meetings Act further provides that a public body
may exclude the public from a portion of a meeting at which the public body discusses
items enumerated in the Open Public Meetings Act at N.J.S.A. 10:4-12b, which items
are recognized as requiring confidentiality; and
WHEREAS, it is necessary and appropriate for the Township Committee of the
Township of Pennsauken to discuss certain matters in a meeting not, open to the public
consistent with N.J.S.A. 10:4-12b.
WHEREAS, matters under discussion will not be disclosed until the need for
confidentiality no longer exists; and
NOW, THEREFORE BE IT RESOLVED by the Township Committee of the
Township of Pennsauken, pursuant to the Open Public Meetings Act of the State of
New Jersey that:
1. The Township Committee of the Township of Pennsauken shall hold a closed meeting
from which the public shall be excluded, on June 4, 2026.
2. The general natures of the subjects to be discussed at said closed meeting shall be
matters of acquisition of real property, N.J.S.A. 10:4-12b (8).

Pennsauken on the 4th of June 2026.
