Re:
Proposal for 2026 Stormwater Management Program Services
MS4 Permit Compliance Activities
Dear Messrs. Suozzi and Borroni:
D&B Engineers and Architects (D&B) is pleased to provide this proposal to continue assisting the
Village in maintaining its mandated compliance with the New York State Department of
Environmental Conservation (DEC) State Pollutant Discharge Elimination System (SPDES)
General Permit for Stormwater Discharges from Municipal Separate Storm Sewer Systems
(MS4s).
STATUS OF REGULATIONS
In January 2024, the revised DEC General Permit for Stormwater Discharges from MS4s No. GP0-24-001 (MS4 General Permit) became effective and outlines the terms and conditions, minimum
control measures, and related requirements for the Village’s Stormwater Management Program
(SWMP). The MS4 General Permit is now in the third year of the five-year permit term. Much of
efforts will continue to focus on updating the Village’s written SWMP Plan documentation and
establishing new measures.
Since the new MS4 General Permit builds and expands on the programs developed under the
previous MS4 General Permits, the DEC expects the Village to continue implementing the
established programs while they are being updated, revised, or expanded in response to the new
MS4 General Permit requirements. Please be aware that the DEC and United States Environmental
Protection Agency have the authority to conduct MS4 Program Evaluations and Audits at any
time. These reviews can include electronic record requests, staff interviews, and/or site
inspections.

SCOPE OF WORK AND TECHNICAL APPROACH
The MS4 General Permit provides an iterative compliance schedule, which is presented as annual
milestones. The tasks provided in this proposal represent deliverables and updates required to be
documented in the third year of the MS4 General Permit term. Please note that there will be
additional SWMP Plan requirements to be documented for each subsequent year of the five-year
Permit term.
Due to the nature of the requirements, there will be additional required tasks to be completed by
Village staff that are outside of D&B’s scope of work (e.g., catch basin cleaning, street sweeping,
etc.). As always, D&B’s annual municipal stormwater support for the Village includes reviewing
the MS4 General Permit requirements and advising the Village on current, ongoing, and upcoming
required tasks throughout the year.
Task 1: 2026 SWMP Annual Report and Two Interim Progress Certifications for Submittal
to DEC
The MS4 General Permit mandates the following reporting deadlines: SWMP Annual Report and
first Interim Progress Certification are due by April 1, 2026; and the second Interim Progress
Certification is due October 1, 2026.
To assist the Village in complying with the three (3) reporting requirements of the MS4 General
Permit in 2026, D&B will:
•
Review the new reporting requirements based on the MS4 General Permit, fact sheets,
presentations, policy statements, guidance memoranda, and/or forms;
•
Consult with Village staff via meetings, teleconferences and/or correspondence to
conduct a review of the Village’s comprehensive SWMP activities for the applicable
reporting period;
•
Prepare a Draft for the reporting period on the mandated DEC electronic reporting form
for review by the Village;
•
Assist the Village in making the Draft SWMP Annual Report available for public
review;
•
Prepare a summary of comments provided by the public on the Draft SWMP Annual
Report as applicable;
D&B Engineers and Architects
Ralph V. Suozzi, Village Administrator
John Borroni, P.E., Superintendent of Public Works
Village of Garden City
February 27, 2026

•
Incorporate comments provided by the Village and/or the public on the Draft SWMP
Annual Report as applicable;
•
Prepare the Certification form for eReports to enable D&B to submit the reports on the
Village’s behalf; and
•
Submit the reports electronically to DEC by reporting deadlines.
Task 2: Annual SWMP Plan Updates and Public Education and Outreach Program
Documentation
The MS4 General Permit requires frequent and specific updates to the Village’s written SWMP
Plan documents to align with the new regulations. The previously prepared Village SWMP Plan
documents must incorporate an annual update by April 1st of each year. To assist the Village with
documenting the completion of these requirements, D&B will update the following Villagespecific SWMP Plan documents by incorporating the Village’s current SWMP procedures and the
administrative requirements of the MS4 General Permit:
•
SWMP Plan Framework
•
Written Procedures for Minimum Control Measure 3: Illicit Discharge Detection and
Elimination
•
Written Procedures for Construction Oversight Program and Post-Construction SMP
Inspection and Maintenance Program
In addition, the Village Public Education and Outreach Program is required to be updated during
the third year of the MS4 General Permit term to incorporate the following requirements:
•
Focus Areas: Specific areas throughout the Village will be evaluated and designated as
focus areas based on established criteria listed in the MS4 General Permit. Once
identified, these focus areas will be mapped and documented in the Village SWMP
Plan in accordance with the Phase I Comprehensive System Mapping requirements of
the MS4 General Permit.
•
Target Audiences: Target audiences will be identified based on the focus areas
established within the Village. For each audience, the associated pollutant-generating
activities will be documented.

•
Page 4
Education and Outreach Topics: The SWMP Plan will be revised to include the
education and outreach topics developed under this task, along with how each topic is
intended to reduce pollutant generation by the identified target audiences based on the
corresponding focus areas.
Task 3: Monitoring Locations Map, Inventory, and Prioritization
Under this task, D&B will assist the Village with preparing a Prioritized Monitoring Locations
Inventory. In accordance with the MS4 General Permit, the following Monitoring Locations will
be included in the Inventory: end-of-pipe MS4 Outfalls, Interconnections to adjacent MS4
Operators, and Municipal Facility Intraconnections.
D&B will work with Village staff to gather existing geographic location data of the Village’s MS4
that the Village has in its possession. Information may include GIS data, paper maps and previous
inspection field sheets (e.g., Outfall Reconnaissance Inventory). D&B will evaluate the existing
MS4 data and identify potential data gaps. A memorandum report will be prepared identifying
areas where investigations or field visits may be necessary to obtain additional information to
complete a comprehensive Inventory. This scope of work is limited to a desktop assessment of
existing data and information. If necessary, D&B can provide a separate scope of work and cost
estimate to conduct investigations and field visits so that the Village has a comprehensive
Monitoring Location Inventory.
The specific Monitoring Location attributes will be organized and presented in a table format.
Once the inventory is developed, each monitoring location will be assigned a unique identification
number and prioritized (high vs. low) based on the specific criteria listed in the MS4 General
Permit. In addition to the development of the inventory, D&B will prepare a map displaying the
Monitoring Locations with their associated type and prioritization identified in accordance with
the Phase I Comprehensive System Mapping requirements of the MS4 General Permit.
Task 4: Written Procedures for Municipal Facilities, Operations and Catch Basin Program
D&B will prepare a detailed SWMP Plan Supplemental Document describing the Village-specific
best management practices (BMPs) to be implemented at Village facilities and during operations.
The goal of the BMPs is to minimize the discharge of stormwater pollutants associated with
municipal facilities and municipal operations. The BMP handbook/manual will summarize
potential pollutant sources within the Village facilities and operations; and describe policies,
practices, procedures and structures used to prevent, reduce or treat stormwater pollution. BMPs
to be considered include minimizing exposure, preventative maintenance, spill prevention and
response, erosion and sediment controls, open space, salt storage, waste management, alternative
implementation options, right of way maintenance, winter road maintenance, corrective actions,
and training requirements.

The BMP SWMP Plan Supplement Document will also include a Catch Basin Inspection and
Maintenance Program. D&B will prepare a detailed written description of when catch basins
inspections are needed, required inventory information, inspection procedures, training
recommendations, corrective actions, and documenting actions. Catch Basin inspection
recordkeeping forms will also be prepared for the Village’s use.
Task 5: Municipal Facility Prioritization
To assist the Village with complying with the requirements of the MS4 General Permit Municipal
Facility Program, D&B will build upon the previously developed Municipal Facility Inventory list.
D&B will coordinate site visits with Village staff knowledgeable of the operations conducted the
facilities. D&B will observe and discuss operations with Village staff. The locations of activities
conducted, materials stored and existing BMPs will be noted. Based on this information, a
municipal facility pollution prevention prioritization will be assigned to the facility (high vs. low)
according to the criteria listed in the MS4 General Permit. If applicable, D&B will provide the
Village with recommendations to lower the facility’s prioritization.
The information gathered and associated attributes will be organized and presented in a facility
information sheet. In addition, D&B will prepare a map displaying the locations of the Village’s
facilities with their associated prioritizations identified in accordance with the Phase I
Comprehensive System Mapping requirements of the MS4 General Permit.
Task 6: Annual Update to Construction Inventory and Post-Construction Inventory
To assist the Village with the ongoing tracking requirements associated with regulated
construction activities (i.e., total land disturbance of greater than or equal to one acre), D&B will
assist the Village with updating the previously developed inventory of applicable construction
sites. D&B will collect the applicable/required information for the inventory and prioritize the
construction sites (high vs. low) according to the criteria listed in the MS4 General Permit.
In addition, D&B will assist the Village with updating the inventory of Village- owned/operated
post-construction stormwater management practices (SMPs) as defined by the MS4 General
Permit. Once identified, Village-owned/operated post-construction SMPs will be mapped and
documented in the Village SWMP Plan in accordance with the Phase I Comprehensive System
Mapping requirements of the MS4 General Permit.
COST
Our lump sum costs are presented in the table below. Please check the appropriate box(es) for

Board considera on is requested for the following ma er(s):
Authoriza on is requested to correct a previously approved step increase for Adam Weiner in
accordance with the 2026 adopted budget, effec ve December 1, 2025.
Mr. Weiner was granted an advancement of his step which was not the original intent. The intent
of the approval was to provide one addi onal step while allowing Mr. Weiner to remain on his
current step increase schedule. This ac on corrects the step placement to reflect that intent.
There is no financial impact associated with this correc on. No addi onal funding is required, as
this adjustment has been accounted for within the 2026 adopted budget.
