ZONING & SUBDIVISION REFERRALS
Chairperson Firendino called for the Board to begin review of the list of referral applications.
Address: Town Wide
Type of Action(s): Text Amendment
1. Project: Sodus, Town of Sodus
Mr. Levine introduced the project stating that the amended version of the code is reorganized and
structured to flow nicer than the previous code. Mr. Pincelli added that the main focus of the update was
to add further clarification for the uses of Political and Temporary signage and there were very few
differences to the new amended law.
Motion: Mr. Guthrie made a motion to approve the proposed application. Mr. Conklin seconded the
motion.
Ayes - 12 | Nays - 0
2. Project: Town of Walworth, Stonebrook Estates Subdivision
Address: 0 Mildhan Rd, Walworth, NY 14568
Type of Action(s): Site Plan & Final Subdivision
Chairperson Firendino introduced the site plan applicant. Mr. Don Lewis from D.H. Lewis Engineering
introduced the project as a 3.71-acre lot to be subdivided into 5 lots with residential houses. The property
would be on septic but with the option to connect to the sewer manifold. The proposed subdivision would
have a shared private drive for 4 of the houses with a common access easement; 1 house having private
drive access directly to Mildhan Rd. With a 24” drainage pipe with a catch basin, all water drainage will
be maintained and drained through to the storm water facility across the road. There is no well water
access so there will be town water access to all 5 houses. Mr. Pincelli asked to confirm if the proposal
was for both the subdivision and the site plan or if this was for the subdivision only. Mr. Lewis confirmed
this is for both although the paperwork was not fully sent over by the Town to the County. Mr. Peters
asked how much water would be coming across and how many acres will be affected. Mr. Lewis stated
that his requirements for the 24” access pipe and the 36” access pipe will redirect all water to the relief
pond across the road and the soil relief at the edge of the road. Mr. Spinning asked how much drainage
there will be coming off of the top lot. Mr. Lewis stated the area in question would not be disturbed and
the swale should be able to handle any excess drainage and runoff. Mr. Peters asked what the elevation
change is from the lowest point of the project to the highest point of the project. Mr. Lewis responded
533” was the total elevation change. He then explained that the property currently has an overgrowth of
vegetation and due to the elevation change the land is wet but not considered a wetland due to its’ size.
With potential to clean up the property and give proper drainage to the land. Mr. Guthrie asked what the
length of the private drive and where the access is for the nearest fire hydrant. Mr. Lewis stated the drive
will be approximately 400’ with the nearest fire hydrant access approximately 550’. Mr. Guthrie asked if
the length proposed is typical for a private subdivision drive. Mr. Lewis confirmed that the proposed is
what the Town requires for private drives for less than 5 lots. Mr. Burns then asked to confirm what the
maximum distance allowed between fire hydrants are. Mr. Lewis responded there can be no more than
600’ between hydrants. Mr. Burns stated that there would need to be a review on if the Town plans on
adding a hydrant to the access pipe over by Gananda Parkway as an additional access point for the Fire
Department. Mr. Lewis stated that actual fire access for the fire department would come from the hydrant
on Mildhan Rd. Mr. Pincelli asked what the size of the houses would be and if they would be single story
or two-story houses. Mr. Lewis responded the developers like building ranches as it’s a more desirable
market to sell to. The houses are approximately 40’ by 60’ but it will be up to the owners for final size
and application approval at the health department. Mr. Lewis closed the presentation out stating that the
subdivision would also provide necessary drainage and septic access relief for the daycare on the property
next door due to the lack of sewer lines available previously.
Motion 1: Mr. Burns made a motion for approval for the subdivision. Mr. Mendenhall seconded the
motion.
Ayes - 11 | Nays – 0 | Ms. Marini abstained.
Motion 2: Mr. Burns made a motion for approval for the site plan. Mr. Mendenhall seconded the motion.
Ayes - 11 | Nays – 0 | Ms. Marini abstained.
3. Project: Town of Walworth, Navratil & Bear Subdivision
Address: 5335 Swadling Rd, Walworth, NY 14568
Type of Action(s): Final Subdivision
With no applicant in attendance to present, Mr. Levine introduced the project as a proposed subdivision
dividing a 15.75-acre parcel into 4 lots. 3 of the lots would be approximately 1-acre with the remaining
12.6-acre lot behind the houses. There are existing structures on the property already and the proposal
would be to build houses on the 3, 1-acre lots. There is no sewer for the property so each lot would need
to have their own septic. Water is on site that they can connect to; the back lot has a ditch and creek for
water access and drainage. Mr. Guthrie asked if there were plans for the 12.6-acre lot. Mr. Levine
confirmed there are no plans for that lot, only for the 3 smaller lots. Mr. Peters asked how wide the
entrance is going onto the property leading to the 12.6-acres. Mr. Levine stated the width of the access
would be 40’ across and 350’ long. Mr. Peters asked if that can be split the 40’ into 20’ and turn the
access into smaller lots. Ms. Marini replied that the Town requires a minimum of 30’ so that wouldn’t be
possible. Mr. Guthrie asked what the character of the neighborhood is. Mr. Levine stated that the property
is in a rural, low density housing neighborhood. Mr. Krolak asked if there are any hills or drumlins that
may impact the driveway. Ms. Marini stated the property is fairly flat.
Motion: Mr. Hutteman made a motion to approve the final subdivision. Mr. Peters second the motion.
Ayes - 11 | Nays – 0 | Ms. Marini abstained.
4. Project: Town of Ontario, AutoZone Site Plan
Address: 1558 NYS Route 104, Ontario, NY 14519
Type of Action(s): Final Site Plan
Chairperson Firendino introduced the final site plan applicant. Mr. Paul McCarthy from AutoZone
introduced the project as building an AutoZone on Route 104 in the vacant 1.1-acre lot next to Walgreens.
Mr. McCarthy stated that when the neighboring Walgreens was built in 2008 there was a retention pond
built to handle runoff but is no longer usable per DEC regulations. His proposal is to pump the existing
retention pond and backfill it due to lack of maintenance by Walgreens. Then install an updated drainage
system per SWPP / DEC regulation, that will filter waste and redirect the water through plastic chambers
to the drain soil on the south edge of Route 104. The new proposed system should help maintain the
drainage for the entire area; by doubling the size of the 4-bay chamber system they will remain compliant
with the DEC. Mr. Burns asked who will be responsible for maintaining the chamber system. Mr.
McCarthy stated the Town of Ontario will provide an easement for the pipe to go out to the road, however
it would be AutoZone’s responsibility to maintain the system. Mr. Burns restated that Walgreens was
supposed to maintain their retention pond for the same purposes and didn’t; He then asked what will
enforce AutoZone to maintain theirs. Mr. McCarthy suggested that the Town could possibly maintain as
there is little to no monitoring of the business’ maintenance of these systems. Mr. Hutteman asked if there
was a shared access driveway with Walgreens on 104. Mr. McCarthy answered yes, there is a shared
easement as well as the storm water and drainage systems. Mr. Hutteman asked how deep the storm water
system will go and if it will be draining into the sewer which backs up to the property. Mr. Peters stated
that these systems are used quite frequently and often get buried under a parking lot when there’s little to
no room on the sides; Typically buried around 3-4 feet underground. Mr. Peters then asked how will that
system be maintained. Mr. McCarthy answered the waste and water will go into the first chamber where it
will be filtered out so waste stays in the chamber and can then be cleaned out or hosed out twice a year
per manufacture recommendation. Mr. Hutteman recommended that as done in the past with previous
projects maintenance is on the property owner but have the Town require verification of maintenance be
submitted to the Town and DEC for review. Ms. Marini then asked if Ontario is an MS4 Town. Mr.
Conklin confirmed it is. Mr. Burns and Mr. Hutteman asked if there was a plan for snow removal and
where it would go in the winter time. Mr. McCarthy responded the snow storage would be plowed to the
back of the property and to the edge of the road and to the top of the chambers. The chambers sit 18” high
and 24” wide. Mr. Peters asked what was the rear setback from the surrounding properties to the
AutoZone property. Ms. Marini answered it was 36’ and 20.5’ from the rear to the property lines. Mr.
Guthrie asked if there were any variances for those. Mr. McCarthy responded no they were within the
guidelines set by the town. Mr. Guthrie asked if there would be a buffer or barrier. Mr. McCarthy
confirmed there is currently a fence there but they will be taking it down and replacing it with a new one.
Mr. Guthrie asked if DOT approved the driveway use. Mr. McCarthy confirmed DOT granted approval.
Mr. Conklin stated that currently there are 3 entrance points to get into the neighboring Walgreens, with a
connecting driveway access customers will likely use all 3 to go over to AutoZone as well. Mr. Peters
expressed concern that with more traffic heading to the AutoZone there will also be more U-Turn traffic
at the stop light on 104. Mr. Lockwood stated that the neighboring property on the other side, Preston’s,
may have more drainage issues with moving forward with this project. Mr. McCarthy stated that with
drains going to the south side of 104, flow off AutoZone should be less than what it is currently. Mr.
Krolak asked to confirm if there will be indirect lighting. Mr. McCarthy confirmed.
Motion: Mr. Guthrie made a motion to approve the final site plan with the following comments:
•
Maintenance of the Drainage system needs to be addressed and confirmed with the Town. Adding
required maintenance at least twice a year.
Mr. Krolak seconded the motion.
Ayes - 11 | Nays – 0 | Mr. Conklin abstained
OTHER BUSINESS
Mr. Pincelli added that the Planning Board, EDC & IDA are anticipating a higher volume of potential
projects involving solar energy, data centers and battery storage. Mr. Peters stated that the board has
challenged those projects in the past as there wasn’t enough information for them to approve. Mr. Krolak
asked how many solar projects there are in total. Mr. Hutteman said that in Arcadia alone there are 5 total;
1 is operational and another 2-3 are under construction. Mr. Pincelli stated there is a map of all the Solar
Projects on NYSERTA and most solar developers are coming to the IDA for PILOTs but not all of them.
There is a general concern of the decommissioning process when 10-15 years down the road the
developer walks away from the project and leaves behind waste. New York State Independent System
Operator will help with the energy deficit to support new systems like data centers and battery storage
centers. Mr. Conklin expressed concern about ORES and it limiting the county’s ability and say in
projects like these moving forward. Mr. Pincelli stated ORES has not come to Wayne County yet.
The general discussion maintained that within the next 10 years minimum there will be more projects to
increase the power infrastructure to support these new data centers and other industrial uses.
Chairperson Firendino asked for a motion to adjourn. Mr. Guthrie made a motion. Mr. Burns seconded
the motion. All members were in favor. The meeting adjourned at 8:03 P.M.
The next County Planning Board Meeting is on June 24, 2026 at 7:00 P.M.
Respectfully Submitted,

Revised March 2023
PROPOSED LOCAL LAW NO. 1 OF THE YEAR 2026
OF THE TOWN OF ROSE
A local law to amend the Zoning Law of the Town of Rose, Wayne County, New York.
Be it enacted by the Town Board of the Town of Rose as follows:
SECTION 1. TITLE AND SCOPE
This local law shall be known as "A LOCAL LAW TO AMEND THE TOWN OF ROSE ZONING
LAW TO MODIFY THE ZONING MAP TO EXPAND THE HAMLET GENERAL BUSINESS
DISTRICTS IN THE HAMLETS OF ROSE AND NORTH ROSE AND MODIFY SECTION 607
PERTAINING TO MOTOR VEHICLE FILLING STATIONS."
SECTION 2. PURPOSE.
(a) Authority. This Local Law is adopted pursuant to the Town Law of the State of New York,
Chapter 62 of the Consolidated Laws, Article 16, and Articles 2 and 3 of the Municipal
Home Rule Law, to protect and promote public health, safety, convenience, order,
aesthetics, prosperity and general welfare of the Town of Rose in a fashion that is consistent
with the Comprehensive Plan of the Town of Rose, adopted November 2024 (the
“Comprehensive Plan”). This Local Law regulates the use of buildings and structures and
the development and use of land within the Town of Rose.
(b) To these ends, this local law and the Sections that it amends is designed to:
1.
Enhance and regulate the orderly growth, development and redevelopment of the
Town in accordance with the Future Land Use Considerations provided in the
Comprehensive Plan by incorporating denser development of businesses and mixeduse structures in the hamlets within the Town of Rose to allow for more community
services, retail, and housing.
2.
Having these services in the hamlets can help expand the tax base without intruding
development into rural areas, so that the Town may realize its potential as a place to
live and work, with the most beneficial and convenient relationships among the
agricultural, commercial, industrial, and residential areas within the Town and with
due consideration to the character of each district and its suitability for particular
uses; and
3. Protect and manage the character of the Town.
SECTION 3. CHANGES TO SECTION 301—ZONING MAP AMENDMENTS
(a) The official Zoning Map of the Town of Rose is hereby amended to reflect the change in
zoning classification of the parcels listed in Exhibit A from the HR (Hamlet Residential)
District to the HGB (Hamlet General Business) District, said parcels being those HR
District parcels with frontage on State Route 414 (Main Street) in the hamlets in the Town
of Rose.
(b) Pursuant to Section 301(C) of the Zoning Law, such zoning district amendments shall be
permanently affixed to the zoning map promptly after this Local Law is effective and shall
convey information as to the date and nature of the change. No amendment to this law that
involves matters portrayed on the zoning map shall become effective until such change and
entry has been made on said zoning map and has been attested by the Town Clerk.
SECTION 5. EFFECTIVE DATE.
This local law shall be effective thirty (30) days after its filing with the Office of the Secretary of
State.

RESOLUTION
OF THE TOWN BOARD
OF THE TOWN OF ROSE
April 21, 2026
RESOLUTION INTRODUCING THE PROPOSED
LOCAL LAW NO. 1 OF 2026 AND RELATED SEQRA EAF
FOR REVIEW, ESTABLISHING SEQRA LEAD AGENCY,
REFERRING PROPOSED LOCAL LAW NO. 1 OF 2026
TO THE WAYNE COUNTY PLANNING BOARD
AND SETTING A PUBLIC HEARING
WHEREAS, the Town of Rose Planning Board (“Planning Board”) has recommended
changes to the Zoning Law of the Town of Rose (“Zoning Law”), as set forth below, to align
elements of the Zoning Law and Zoning Map with the Town of Rose Comprehensive Plan, adopted
November 2024 (the “Comprehensive Plan”); and
WHEREAS, the Comprehensive Plan includes among its recommendations the denser
development of businesses and mixed-use structures in the hamlets of Rose and North Rose to allow
for more community services, retail, and housing; and
WHEREAS, the Comprehensive Plan concluded that having these services in the hamlets
can help expand the tax base without intruding development into rural areas and that current
community spaces should continue to be utilized and opportunities to develop new community
spaces in the hamlets should be explored; and
WHEREAS, the Comprehensive Plan also contemplated a transportation corridor along
Route 414 for denser mixed-use developments with housing in close proximity to retail and services;
and
WHEREAS, the current zoning in the hamlets includes a significant number of Hamlet
Residential (HR) District parcels along Route 414, which limits the types of commercial uses
permitted along the main business corridors in the hamlets; and
WHEREAS, converting the HR District zoning for parcels along Route 414 in the hamlets to
a Hamlet General Business (HGB) District would expand the permitted commercial uses in the
hamlets while continuing to permit residential development. A table comparing the permitted,
specially permitted, and permitted with special conditions uses in the HR and HGB Districts is
attached as Exhibit A; and
WHEREAS, certain Special Conditions contained in Article VI of the Zoning Law contain
obsolete provisions that could unnecessarily restrict development, including the requirement of
Section 607.C prohibiting above ground tanks at Motor Vehicle Filling Stations when the current
preferred configuration for petroleum storage tanks by the New York State Department of
Environmental Conservation are above ground tanks to prevent petroleum leaks from impacting soils
and groundwater; and
-2WHEREAS, proposed Local Law No. 1 of 2026, annexed hereto as Exhibit B (the
“Proposed Local Law”), to amend the Zoning Law to (1) update the Zoning Map to revise the zoning
district for parcels along Route 414 in the hamlets from HR to HGB zoning (see the parcel list in the
Proposed Local Law and the maps attached as Exhibit C showing the locations of the proposed
parcels to be converted to HGB District zoning); and (2) revise Section 607.C of the Zoning Law to
permit above ground storage tanks at Motor Vehicle Filling Stations but with a minimum setback
requirement to property lines; and
WHEREAS, adoption of the Proposed Local Law could be considered a Type 1 action under
the State Environmental Quality Review Act (“SEQRA”) because it impacts the allowable uses in
more than 25 acres in a zoning district; and
WHEREAS, Part 1 of a Long Form SEQRA Environmental Assessment Form (“EAF”),
annexed hereto as Exhibit C, has been prepared for the Proposed Local Law; and
WHEREAS, the Proposed Local Law is required to be referred to the Wayne County
Planning Board pursuant to General Municipal Law § 239-m; and
WHEREAS, the Proposed Local Law is subject to the notice and hearing requirements of
Town Law § 264.
NOW, THEREFORE, IT IS RESOLVED that the Proposed Local Law is introduced for
consideration by the Town Board; and
RESOLVED, that, pursuant to 6 N.Y.C.R.R. §617.6(b)(1), the Town Board shall serve as
Lead Agency for the SEQRA review of the Proposed Local Law; and
and
RESOLVED, that the Town Board accepts and directs the Town Supervisor to sign the EAF;
RESOLVED, that the Town Board directs the Town Supervisor to arrange for the referral of
the Proposed Local Law, EAF, and this Resolution to the Wayne County Planning Board for review
pursuant to General Municipal Law § 239-m; and
IT IS HEREBY FURTHER RESOLVED that a public hearing before the Town Board at
the Rose Town Hall regarding the Proposed Local Law and the SEQRA review for the Proposed
Local Law is set for the 19th day of May 2026 at ________ pm; and
RESOLVED, pursuant to Town Law § 264, notice of the time and place of the public
hearing shall be published in the Times of Wayne County at least ten days prior to the date of the
public hearing; and
RESOLVED, notice of the time and place of the public hearing shall be posted on the sign
board of the Town of Rose, and posted on the Town of Rose website.

SECTION 4. CHANGES TO SECTION 607 -SPECIAL CONDITIONS FOR MOTOR VEHICLE
FILLING STATIONS
The current Section 607(C) of the Zoning Law of the Town of Rose is hereby modified and
amended to acknowledge the preferred use of above-ground storage tanks for new petroleum
storage tanks at Motor Vehicle Filling Stations by the New York State Department of Conservation:
C.
Above ground storage tanks shall be installed set back from adjacent property lines
at least the minimum distance required by New York State Fire Code and New York
State Department of Environmental Conservation regulations.
SECTION 5. EFFECTIVE DATE.
This local law shall be effective thirty (30) days after its filing with the Office of the Secretary of
State.

are subject to public review, and may be subject to further verification.
Complete Part 1 based on information currently available. If additional research or investigation would be needed to fully respond to
any item, please answer as thoroughly as possible based on current information; indicate whether missing information does not exist,
or is not reasonably available to the sponsor; and, when possible, generally describe work or studies which would be necessary to
update or fully develop that information.
Applicants/sponsors must complete all items in Sections A & B. In Sections C, D & E, most items contain an initial question that
must be answered either “Yes” or “No”. If the answer to the initial question is “Yes”, complete the sub-questions that follow. If the
answer to the initial question is “No”, proceed to the next question. Section F allows the project sponsor to identify and attach any
additional information. Section G requires the name and signature of the applicant or project sponsor to verify that the information
contained in Part 1is accurate and complete.
A. Project and Applicant/Sponsor Information.
Name of Action or Project:
Local Law #1 of 2026: Zoning Map Amendments to Add HGB Parcels in Rose Hamlets and Amend Section 607 of Zoning Law
Project Location (describe, and attach a general location map):
Town of Rose
Brief Description of Proposed Action (include purpose or need):
Proposed Local Law No. 1 of 2026 would amend the Town of Rose Zoning Law to (1) update the Zoning Map to revising the zoning district for parcels
along Route 414 in the hamlets to HBG zoning (see the parcel list in the Proposed Local Law and the maps attached as Exhibit C showing the locations of
the proposed parcels to be converted to HGB District zoning); and (2) revise Section 607.C of the Zoning Law to permit above ground storage tanks at
Motor Vehicle Filling Stations, but with a minimum setback requirement to property lines, for consistency with NYSDEC regulations. These updates would
address Comprehensive Plan recommendations to encourage denser development of businesses and mixed-use structures in the hamlets of Rose and
North Rose to allow for more community services, retail, and housing without intruding development into rural areas. Converting the HR District zoning for
parcels along Route 414 in the hamlets to a Hamlet General Business (HGB) District would expand the permitted commercial uses in the hamlets while
continuing to permit residential development. Attached as Exhibit A is a comparison of permitted uses in the HR vs. the HGB zoning districts; attached as
Exhibit B is the proposed local law; and attach as Exhibit C are maps showing the locations of the parcels proposed to be converted to HGB zoning.

EXHIBIT B
This local law shall be effective thirty (30) days after its filing with the Office of the Secretary of
State.
