FIN Transfer of Function Finance Dept.
Authorizing implementation of transfer of function of one (1) Junior Accountant in the Cayuga County
Department of Social Services to the Finance Department pursuant to the recommendation of the
Commissioner of Social Services and Director of Finance

WHEREAS, currently one (1) Junior Accountant exists in the Department of Social Services; and
WHEREAS, upon administrative review by both the Commissioner of Social Services and Director of Finance,
it has been determined that this position and it’s functions are a better fit under the jurisdiction of the Finance
Department; and
WHEREAS, in anticipating the transfer of function, the Department of Social Services funded the above
position in their 2026 budget; Now therefore be it
RESOLVED, that the Transfer of Function of the one position described above be hereby ordered and initiated
with the effective date of the transfer as soon as practicable by the Commissioner of Social Services and
Director of Finance; and be it further
RESOVED, that the Finance Department be hereby directed to post a certified list of employees as attached
pursuant to NYS CS Law, Section 70.2 “as soon as practicable after the adoption of a law, rule, order or other
action direction such as transfer of function, but not less than twenty days prior to the effective date of such
transfer, the head of the department or agency from which such function is to be transferred a list of the names
and titles of those employees substantially engaged in the performance of the function to be transferred, and
shall cause copies of such certified list to be publicly and conspicuously posted in the offices of the department
or agency from which such function is to be transferred, along with copies of this subdivision;” and be it further
RESOLVED, that the County Finance Department be hereby authorized to make the appropriate journal entries
to carry out the intent of this Resolution; and be it further
RESOLVED, that the Legislature Chairperson be hereby authorized to enter into any agreements between these
departments to implement the intent of this resolution; and be it further
RESOLVED, that the “Transfer of Function” be facilitated in accordance with NYS Civil Service Law, Cayuga
County Service Rules and Regulations, bargaining contracts, and the policies of County of Cayuga.

HR EAP Contract
Authorize the Chairman of the Legislature and the Human Resources Administrator to enter into an agreement
to provide Employee Assistant Program services

WHEREAS, Cayuga County seeks to employ a workforce free from personal challenges which impacts their lives and
their ability to do their job; and
WHEREAS, An Employee Assistance Program (EAP) provides the resources necessary for employees to confront and
overcome such personal issues; and
WHEREAS, those employees who access EAP are more likely to have a positive outcome from personal adversity and
remain productive employees, and
WHEREAS, the Cayuga County Legislature finds that such a program would benefit employees, reduce unnecessary
employee turnover, and conserve taxpayer dollars by retaining trained and experienced employees; and
WHEREAS, the Human Resources Administrator and Purchasing Director need to select a qualified vendor from a
Request for Proposal to secure these services; and
WHEREAS, several companies were contacted for services provided under their EAP Program; and
WHEREAS, Employee Assistance Program should be provided by a qualified organization; and
WHEREAS, Crouse HelpPeople is willing to provide such a program at a cost of $18 per employee per year; now
therefore be it
RESOLVED, that the Chairperson and the Human Resources Administrator be authorized to enter into an agreement with
Crouse HelpPeople for provision of Employee Assistance Program for a one (1) year period beginning July 1, 2026,
through June 30, 2027 being the second (2) year of the one (1) year renewals for up to four (4) years if mutually agreed
upon.

RPS COA Sterling Easement
SEQRA Review for the granting of a Temporary Easement to Rebecca Hendricks on County owned real property
commonly known as Tax Map No. 12.00-1-25 in the Town of Sterling, and authorizing Temporary Easement
Agreement with Rebecca Hendricks

WHEREAS, Rebecca Hendricks Living Trust owns Tax Map No. 10.00-1-23.21 in the Town of Sterling, commonly
known as 1452 State Route 104A (“the Hendricks property”), which is adjacent to a property owned by Cayuga County,
Tax Map No. 12.00-1-25, located on Sterling Station Road, commonly referred to as the “Hojack Trail” (“the County
property”); and
WHEREAS, A pole barn was constructed on the Hendricks property, and it was later discovered when the property was
surveyed that the corner of the pole barn encroaches on the County property by +/- 6.8 feet as indicated on the filed survey
map 2026-41; and
WHEREAS, The structure does not interfere with use of the Hojack trail; and
WHEREAS, Rebecca Hendricks desires to leave the pole barn in its current footprint and has requested a temporary
easement from Cayuga County for the approximate 170 square foot area in which the pole barn encroaches on the County
property; and
WHEREAS, The temporary easement would terminate once the current structure is either moved or demolished and no
new structure would be built in the same place; and
WHEREAS, The temporary easement would also include an additional 10-foot buffer to allow for maintenance and
repairs to the pole barn; and
WHEREAS, The Hojack Trail is parkland, so the issue of parkland alienation must be considered; and
WHEREAS, The County-Owned Real Property Committee has reviewed the request and recommends the County
Legislature approve contingent upon Rebecca Hendricks granting a concurrent temporary easement to Cayuga County for
use of a similar sized portion of the Hendricks property along the Hojack Trail to avoid any parkland alienation concerns;
and
WHEREAS, The County Legislature has determined that the easement will not interfere with the County’s use and
enjoyment of the property; and
WHEREAS, SEQRA requires that a Lead Agency be designated to conduct the environmental review for the grant of the
easement; and
WHEREAS, The grant of an easement is a Type 2 Action under SEQRA and as provided in 6 NYCRR §617.5(c)(33);
now therefore be it
RESOLVED, That the Cayuga County Legislature hereby declares its intent to be Lead Agency under SEQRA for the
purpose of the environmental review for the grant of the temporary easement to Tax Map No. 12.00-1-25; and be it further
RESOLVED, That as a Type 2 Action under SEQRA no further action is required by the County of Cayuga for the
purpose of the environmental review for the granting of a temporary easement to Rebecca Hendricks for the encroachment
of her pole barn and buffer area for maintenance and repair activities on property owned by the County, on Tax Map No.
12.00-1-25; and be it further
RESOLVED, That the Cayuga County Legislature authorizes a temporary easement to Rebecca Hendricks on tax map no.
12.00-1-25, located on Sterling Station Road in the Town of Sterling, to permit encroachment of pole barn structure and
allow 10-foot buffer for maintenance and repair activities; and be it further
RESOLVED, That the above noted temporary easement will be granted contingent upon Hendricks granting the County a
concurrent temporary easement for use of an equal sized portion of her property, Tax Map No. 10.00-1-23.21 in the Town
of Sterling, directly adjacent to the Hojack Trail; and be it further
RESOLVED, That the Chair of the Cayuga County Legislature is authorized to sign any and all documents required to
implement this Resolution as set forth above after review and approval by the County Attorney; and be it further
RESOLVED, That this Resolution shall take effect immediately.

HR Amend Part IV of Comp Plan rev 4
Amending the Cayuga County Compensation Plan Part IV for Non-Bargaining Employees

WHEREAS, the Cayuga County Legislature has heretofore adopted a Compensation Plan for all its employees, consisting of
Part I for employees who are members of a collective bargaining unit, Part II for part-time employees, Part III for elected and
term appointees, and Part IV for managerial employees; and
WHEREAS, Cayuga County conducted a comprehensive study in 2024 to evaluate the County’s existing compensation plan
for Part IV full-time non-bargaining employees (General Government Group), which included the use of a compensation
consultant, the conducting of a market comparison, as well as a thorough internal equity review process; and
WHEREAS, having completed that review, the Legislature finds and determines that it is in the best interests of the County to
amend the County’s compensation plan for Part IV General Government group (excluding General Law Group) of full-time
employees which includes a new grading structure, hiring bands, midpoint, and maximum levels, copies attached; and
WHEREAS, a subsequent Resolution will adjust the salaries for the positions; now therefore be it
RESOLVED, that the Cayuga County Legislature amends the Cayuga County Compensation Plan for Part IV General
Government group (excluding General Law Group) of full-time employees by adopting the following policy setting documents:

compensation paid to full-time managerial staff among comparable counties, but in no event not less than every four years, and
to recommend to the Legislature such amendments to the Compensation Plan as may be appropriate at the time; and be it further
RESOLVED, that the Human Resources Administrator is hereby authorized and directed to utilize the new hiring bands
together with the adopted Compensation Guidelines,
in consultation with department heads, for determining the appropriate salaries for Part IV General Government group
(excluding General Law Group) of full-time employees hired on
or after the date of adoption of this Resolution; and be it further
RESOLVED, that except as specifically amended by the documents attached hereto, the 2026 Compensation Plan for Cayuga
County remains in all respects in full force and effect; and be it further

INTRODUCTION
The Compensation Plan for Non-Bargaining Employees is comprised of several component parts. The
intent of this Manual is to provide the tools necessary to identify, evaluate and grade the essential
characteristics (category) of each employment position within the non-bargaining group of County
employees. Each job characteristic (category) is broken down to various degree levels, which describe
the relative complexity or scope of responsibility within each category. A compilation of the points for
each position will establish the appropriate Grade Level for that position.
Organizational Definitions:
Department – an administrative unit of county government that provides specified services to the public
or to other departments within the government.
Large Department – a department with approximately 40 employees or has a departmental budget of
approximately $1 million or more. May include two or more departments under a single supervisory
structure. Also, may include a department with County-wide policy-influencing authority regardless of
department size.
Department Head – the leader/manager of a department who is accountable to the County Legislature
for department policy, goals, budget, and personnel.
Deputy Department Head – the employee appointed by a Department Head and designated to assist with
the administration of the department and to fill in for the Department Head in his or her absence. May
have oversight of one or more supervisors, or one or more units within the department.
Department Head (Large Department) – the leader/manager of a Large Department.
Deputy Department Head (Large Department) – the employee appointed by the Department Head of
a Large Department to assist with managing two or more units within the Department, and having direct
oversight of two or more supervisors within the department or unit.

JUDGMENT
Judgment considers the degree of independent judgment exercised by the employee. This factor involves
consideration of how much discretion and application of professional knowledge and experience an
employee exercises in carrying out work assignments. The more that an employee’s functions are directed
by either supervision or relevant guidelines, the less independent judgment is required.
There is a direct correlation between this factor and the Complexity factor.

Nature and Purpose of Personal Contacts measures the communication and interpersonal skills required
and their importance to the success of the work. Contacts with supervisors are not considered here. This
factor also measures the degree of human interaction and the responsibility for meeting, dealing with and
influencing other persons (either individually or the public at large). In rating this factor, consider how
often the contacts are made and whether they involve furnishing or obtaining information only, or whether
they involve influencing others. Please note that the higher degrees include those contacts listed in the
lower degrees.

Supervisory Responsibility measures the extent and nature of supervisory and managerial responsibilities
in terms of the degree of involvement in work planning and organization, work assignment and review,
and personnel functions. Positions are classified according to their relative scope of duties and
responsibilities. Those employees who have no supervisory responsibility receive no points under this
category.

deadlines and priorities; recommends and justifies to higher levels of management changes in
the organization of work, work methods or assignment of functions to positions that may affect
staffing patterns, costs, work standards, etc.; recommends promotions, reassignments; advises
employees of performance requirements and prepares formal evaluations of performance (if
applicable); resolves employee complaints and may implement certain disciplinary actions at
the direction of the Department Head, such as oral warnings to improve performance.

The employee, as a regular and continuing part of the job, leads other workers in
accomplishing assigned work and performs non-supervisory work that is usually of the same
kind and level as is done by the group led. The employee is responsible to his/her supervisor
for assuring that the work assignments of other workers are carried out.

3rd Degree:
This employee is a mid-level manager whose scope of duties include managing a small
department (approximately ten or fewer employees) or assisting with the managing of a
department (but not a Large Department). Employee is responsible for the administration and
workflow of the department in order to achieve departmental goals, which may include
preparation of departmental budgets and staffing plans, recommending and implementing
results oriented work plans, delegating tasks to subordinate supervisors or employees and
monitoring for timely completion of assignments. Advises and instructs employees in office
policies and procedures and holds them accountable for same.
4th Degree:
The employee is a senior level manager whose scope of duties may include responsibility for
a specified unit within a Large Department (more than 40 employees) or managing a moderate
sized department (between approximately 10 and 40 employees). This employee is
responsible for supervising subordinate supervisors or employees in the administration of the
workflow of the department and assuring the goals of the department or unit are met. Plays a
senior role in the development and implementation of departmental mission, budgets,
personnel management, and long and short-term strategies; determines organizational
structure; operating guidelines and work operations; may provide certain personnel functions
such as hiring and training of new employees, and/or employee discipline.
5th Degree:
This employee is accountable to the County Legislature for the oversight and management of
a Large Department and/or several departments. Same duties and responsibilities as outlined
in the Fourth Degree, but the scope of duties is more complex due to the size and complexity
of the department.

Cayuga County Amended Compensation Plan Guidelines
Part IV, FT Managerial
Part IV of the Cayuga County Compensation Plan for non-bargaining, managerial, full-time employes is
hereby amended and re-stated to substitute the attached documents for the grading plan previously in
place for these positions.
The amended compensation plan provides the Human Resources Civil Service Department with the
tools necessary to evaluate and assign each position in this group an appropriate grade level consistent
with Cayuga County employment practices. The pay structure then provides guidance on the range of
compensation that may be offered to new hires in these positions.
It is the policy of the County of Cayuga to compensate its employees in a fair and equitable manner,
without regard to race, creed, nationality, age, familial status, marital status, military or veteran status,
sex, disability, sexual orientation, gender, gender identity, gender expression, or any other protected
status under federal or state law and consistent with sound economic policy as set forth in the budget
established by the Legislature.
Accordingly, the Legislature has established the attached Grade Level Plan for each full-time position in
Part IV of the Compensation Plan. Using the Grade Level Plan as a guide, the pay structure establishes a
hiring position band minimum, midpoint and maximum. The compensation for all new hires shall be
within the minimum and midpoint of the salary band for the position. No new hire shall be hired at a
salary above the midpoint of the salary band without the express written approval of the Cayuga County
Legislature.
When a new job title is created, the Human Resources Administrator shall use the Position Rating
Manual, and such other information as may be relevant to assess the duties and responsibilities of the
new position and assign the position to an appropriate Grade Level. This assessment will determine the
Grade Level for such position and therefore, the hiring salary band for that position.
The Human Resources Administrator may modify or amend the Position Rating Manual or the Grade
level Characteristics Chart as deemed necessary or appropriate to improve the process for evaluating
new or existing positions. Once a position is assigned a grade, any change in the Grade Level for that
position may not be modified without the approval of the Legislature.
The Legislature may modify the compensation plan for full-time, managerial positions at any time as it
deems necessary and appropriate. The Human Resources Administrator is directed to conduct a market
analysis of Part IV, full-time, managerial compensation at least once every four (4) years to assure that
the compensation levels at Cayuga County are competitive within the marketplace. Upon completion of
such analysis, the recommendations of the HR Administrator shall be delivered to the Ways and Means
Committee for further action by the Legislature.
The Legislature sets the following mechanism for continued maintenance of the Compensation Plan

Hiring Salary Bands so that it remains reasonably competitive within the marketplace.
Maintenance of the Cayuga County Compensation Plan: Hiring Salary Bands Part IV, FT
Non-Bargaining Staff
All the actions described below must be performed within the parameters of the appropriate Federal,
State and local laws and regulations, including Civil Service Law. Their purpose is to establish the
practices to be used to maintain the validity of the Part IV FT Non-Bargaining compensation plan as it
relates to new hires.
Comprehensive Review – The Part IV FT Non-Bargaining Compensation Plan Hiring Bands
shall have a comprehensive review every 4 years. At the direction of the Legislature, the HR
Administrator will undertake a search for a competent and recognized consultant / organization
with whom to contract who has the appropriate technical expertise, guidance, and resources to
perform this review. The HR Administrator will make a recommendation to the Legislature.

The review should include but not be limited to the market assessment of salaries
constituting the hiring bands, the placement of job titles in those bands, factors used in
determining grades and any remedial recommendations appropriate to resolve issues
raised by any modifications.
Upon completion of such analysis, the HR Administrator shall deliver recommendations
to the Ways and Means Committee for further action by the Legislature.
In addition, each year as part of the budget process, the Budget Director in consultation
with the HR Administrator will make a recommendation to the Chair of the Legislature
what, if any, increase the non-bargaining group will receive and the amount the hiring
salary bands will be adjusted.
Vacancy Review – Human Resources Administrator will do a full review of any position that
becomes vacant when the incumbent has served in the position for more than 5 years.

The department head may make a request for a review due to a vacancy in writing to the
HR Administrator if the incumbent has served in the position for less than 5 years. The
request should include a justification for the review, a detailed listing of the
qualifications, duties and conditions which have changed or are to be changed. If the
significant changes are made, a review of the position will be conducted.
Upon completion of the review, if the HR Administrator recommends a change in grade
for the position, such a recommendation will be made to the Chair of the department’s
oversight committee for the Legislature to consider.
Process for determining the starting salary for new hires covered by the Compensation
Plan for FT Part IV Non-Bargaining employees.

When a candidate for a non-bargaining position covered by this Plan has been identified,
the Appointing Authority will provide the candidate’s name to the Human Resources
Civil Service Office.
The compensation for all new hires shall fall within the minimum and midpoint of the

established salary grade for the position.
The Human Resources Administrator will review the candidate’s application to determine
the starting salary. The HR Administrator shall make the offer unless otherwise agreed
with the Appointing Authority. The salary will be offered to the candidate.
Process for determining the starting salary for a current employee being hired into a new
position covered by the Compensation Plan for FT Part IV Non-Bargaining employees.

When a current Cayuga County employee has been identified for a new non-bargaining
position covered by this Plan, the same process for determining the starting salary
outlined for new hires will be followed.
Nothing contained in these guidelines nor in the amended compensation plan as described in the
attached exhibits creates or is intended to create a contract of any kind or nature whatsoever. Nor does
the attached amended compensation plan create an expectation of continued employment for any
employee. The Legislature retains its rights to fix the compensation of employees paid from County
funds pursuant to County Law § 205.

Adopting Salary Adjustment Plan for Certain Non-Bargaining Positions

WHEREAS, the Cayuga County Legislature has conducted a comprehensive study to evaluate the County’s existing
compensation plan for Part IV, full-time general government employees (excluding legal group employees) and adopted
Resolution No. -26, a Resolution adopting and amending the County’s compensation plan by establishing new salary and
hiring pay bands for each of the identified positions; and
WHEREAS, additionally the Cayuga County Legislature desires to provide a monetary increase for the Part II employees and
Part IV Non-Bargaining Legal Group employees for 2026; and
WHEREAS, sufficient monies are budgeted in the 2026 adopted Budget to pay for the salary adjustments; now therefore be it
RESOLVED, that except as otherwise stated hereafter, the annual salaries for full time Part IV, Non-Bargaining employees for
the year 2026 shall be adjusted for the incumbents who presently occupy the position as set forth on the attached listing of
positions; and be it further
RESOLVED, that the 2026 salary adjustment for full time Part IV, Non-Bargaining employees for the year 2026 shall be

WHEREAS, the Health Department has money in their salary line as a result of temporarily unfilled employee vacancies;
and
WHEREAS, a resolution is required by Cayuga County to move money from a salary line to other expense lines for the
purpose of utilizing all Health Department budget funds in a manner to serve the department best;
WHEREAS, the current Health Department needs reflect an increase in expenses related to additional costs such as
professional services, overtime and the filling of a part-time public health engineer; NOW THEREFORE BE IT,

Authorizing the Chair of the Legislature and the Public Health Director to Contract with CiTi BOCES
for provision of services for Children Eligible for 3-5 Services (SED-4410 pre-school special education
services).

WHEREAS, the Cayuga County Health Department assumes fiscal responsibility for the provision of services
to eligible children (SED-4410 pre-school special education services); and
WHEREAS the Health Department is required to ensure that appropriate service providers are available for
provision of services for those eligible children; and
WHEREAS, the Health Department has the desire to contract with CiTi BOCES for provision of services; and
rate schedule is established and set by State Education for those 4410 providers operating preschool programs;
and
WHEREAS, CiTi BOCES has the following set rates for the 2026-2027 school year:

RESOLVED, that the Chair of the Legislature and the Public Health Director be authorized to contract with
CiTi BOCES to provide services as required for SED-4410 for a term of July 1, 2026, through June 30, 2027, at

HD Create/Fill P-T Rabies Coordinator
Authorizing the Chair of the Legislature to create and the Director of Public Health to fill a P-T Rabies
Coordinator position within the Health Department

WHEREAS, there exists in the Environmental Health Division of the Health Department a need to provide rabies
exposure case management and education services as a mandated service; and
WHEREAS, the Public Health Director wishes to create and fill a part-time Rabies Coordinator position within the
Environmental Health Division; and
WHEREAS, the personnel committee reviewed and approved this request at their meeting held on May 19, 2026; and
WHEREAS, there is funding in the Health Department 2026 budget; and NOW, THEREFORE, BE IT
RESOLVED, that the Chair of the Legislature be authorized to create a part-time Rabies Coordinator at a rate of $27.07
per hour (Probationary Step) and $27.22 per hour (STEP 1) in the Cayuga County Compensation Plan, Non-Bargaining
Part II in the Public Health Department; and be it further
RESOLVED, that the Public Health Director be authorized and directed to fill the PT Rabies Coordinator position in
accordance with Civil Services Rules and Regulations and the policies of the County of Cayuga; and be it further
RESOLVED, that the Authorization to Fill is valid through December 31, 2026, per resolution 307-20; and be it further

WHEREAS, the Health Department currently has one Public Health Educator (Help Program) position (position control
#9579) that was vacated in April 2026 due to a resignation; and
WHEREAS, the Public Health Educator (Help Program) position works in the 100% grant funded Healthy
Neighborhoods Program; and
WHEREAS, the Public Health Director wishes to fill a Public Health Educator (Help Program) position (position control
#9579)
WHEREAS, this position is 100% grant funded; and
WHEREAS, the personnel committee reviewed and approved this request at their meeting held on May 19, 2026; NOW,
THEREFORE, BE IT
RESOLVED, that the Public Health Director be authorized to fill a Public Health Educator position (Help Program)

Authorizing the Chair of the Legislature and the Public Health Director to enter into a contract with Natural Balance
Wildlife Solutions, LLC

WHEREAS, The Health Department worked with the Purchasing Department and completed a full quote request for rabies
specimen preparation services; and
WHEREAS, Natural Balance Wildlife Solutions, LLC is able to provide wildlife specimen preparation for potential rabies
exposure; and
WHEREAS, it is the desire of the Cayuga County Health Department to enter into this contract for the period of 7/01/2026
through 12/31/2027; NOW, THEREFORE, BE IT
RESOLVED, that the Chair of the Legislature and the Public Health Director be authorized to enter into contract with Natural
Balance Wildlife Solutions, LLC with the following rates:
Field Response and Animal Capture (these rates include: travel to site, set up, safe capture and containment preparation)

MH C&F Crisis Intervention Care Manager (HELP) rev 2
Authorize the creation and filling of a full-time Crisis Intervention Care Manager (HELP Program) position at the
Community Mental Health Center

WHEREAS, the New York State Department of Civil Service, Municipal Services Division has announced the Hiring
Emergency Limited Placement Program (HELP Program) in response to local agencies having significant challenges
filling positions across local governments due to the tight labor market, competition with private employers and eligible
lists that have become exhausted; and
WHEREAS, this is a temporary program to help local government employers address the current staffing issues for
critical health and safety titles that meet the criteria of the HELP program which include titles that provide services or
direct care to clients/public/consumers/ patients, there is a severe shortage of candidates as proven by exhausted eligible
lists and are entry level titles that are filled by open-competitive examination; and
WHEREAS, the New York State Department of Civil Service, Municipal Services Division in partnership with the New
York State Office of Temporary and Disability Assistance (OTDA) identified that the Competitive Crisis Intervention
Care Manager position meets the criteria for participation in the HELP program; and
WHEREAS, the HELP program allows for approved titles to be placed in the non-competitive Civil Service classification
for a period of 12 months, meaning applicants will need to meet the minimum qualification for the position to be hired,
and will not need to take a competitive examination and be on an eligible list prior to hire; and
WHEREAS, a New Position Duties Statement was submitted to the Cayuga County Civil Service Commission for
review, and the Commission agreed that the position of Crisis Intervention Care Manager (CMH HELP) qualifies for this
program; and classified the position as Non-Competitive pending submission to the New York State Civil Service
Commission; and
WHEREAS, there is a vacancy for a Crisis Intervention Care Manager (PC#9166) position in the Mental Health Center
(MHC) due to a termination; and
WHEREAS, the last day of work for the individual was May 18th, 2026; and
WHEREAS, the position of Crisis Intervention Care Manager is critical to the efficacy of the MHC’s Mobile Crisis
Team; and
WHEREAS, the Crisis Intervention Care Manager’s roll in the Daytime Mobile Crisis Team enhances the effectiveness
of interventions and provides comprehensive support to individuals in crisis; and
WHEREAS, the funding exists in the current Mental Health budget salary account A43101-51001; and
RESOLVED, that the Personnel Committee has already approved the filling of these positions at the May 19, 2026,
meeting; now therefore be it
RESOLVED, that the Cayuga County Legislature create one Crisis Intervention Care Manager (CMH HELP) position
(Grade 16 of the CSEA Bargaining Unit) in the Department of Mental Health with the jurisdictional class allocation being
Non-Competitive; and be it further
RESOLVED, that the creation of the Crisis Intervention Care Manager (CMH HELP) position is budget neutral with the
transfer of funding from the current funded Crisis Intervention Care Manager (PC #9166) position within the Department
of Mental Health budget, and be if further
RESOLVED, that the Director of Community Services fills the newly created position and any fill-behinds that occur, in
accordance with the Civil Service Rules and Regulations and the Policies of the County of Cayuga, and be it further

MH Employee Leave Bank Request
Authorizing the creation of a temporary leave bank for a Cayuga County Mental Health employee.

WHEREAS, an employee of the Cayuga County Mental Health Center is needing a leave due to a medical condition; and
WHEREAS, this employee has worked for the Cayuga County Mental Health Center for 3 years and accruals will be
exhausted by the end of May 2026; and
WHEREAS, a sick bank is requested to create a temporary leave bank at the request of the employee to address the
immediate loss of income for the employee; and
WHEREAS, discussion has occurred regarding this issue with representatives of the County and all have agreed to allow
for the creation of a temporary leave bank at the request of the Cayuga County Mental Health Center to address the
immediate loss of income for the employee; now therefore be it
RESOLVED, that the Cayuga County Legislature hereby approves and authorizes this temporary leave bank to take
effect after the exhaustion of all benefit time attributed to the employee; and be it further
RESOLVED, that the Cayuga County Legislature authorizes and directs all those steps that may be required to undertake
this temporary leave bank in accordance with the following conditions:
∙ All other leave shall have been exhausted by the employee
∙ All County employees may be permitted to donate personal, compensatory, or vacation time in no less than
full day increments
∙ All leave donations shall be in writing on a standardized leave bank form
∙ Leave time shall be used by the employee using one full day from each donation before additional days are
utilized from donors making multiple day donations
∙ The maximum time allowed for the individual employee’s leave bank shall not exceed a total of ninety-five
(95) work days
∙ Upon return to full-time employment the Leave Bank will be terminated
And be it further
RESOLVED, that the Cayuga County Finance Department make all necessary adjustments to execute the intent of this
resolution.

Authorizing the Legislature to create and fill one Complex Care Supervisor (CMH HELP) position at the

clinic operations, and coordination of Assisted Outpatient Treatment (AOT) and Enhanced Voluntary Agreements (EVAs),
which are critical public health and safety functions within the community mental health system; and
WHEREAS, a New Position Duties Statement was submitted to the Cayuga County Civil Service Commission for
review, and the Commission agreed that the position of Complex Care Supervisor (CMH HELP) qualifies for this
program and classified the position as Non-Competitive pending submission to the New York State Civil Service
Commission; and
WHEREAS, there is a critical need to establish and fill one (1) full-time Complex Care Supervisor position to oversee
clinic operations, supervise clinical staff, and coordinate AOT/EVA activities, court processes, and system-wide care for
high-risk individuals; and
WHEREAS, to participate in the HELP Program, the newly classified non-competitive Complex Care Supervisor (CMH
HELP) position must be created by the Legislature; and
WHEREAS, that the Personnel Committee has approved of the filling of this position at the May 19, 2026, meeting; now
therefore be it.
RESOLVED, that the Cayuga County Legislature hereby creates one (1) Complex Care Supervisor (CMH HELP)
position (Grade 36 of the CSEA Bargaining Unit) in the Department of Mental Health with the jurisdictional class
allocation being Non-Competitive; and be it further
RESOLVED, that the creation of the Complex Care Supervisor (CMH HELP) position is budget neutral through the use
of State Aid within the Department of Mental Health budget; and be it further
RESOLVED, that the Director of Community Services is authorized to fill the newly created position, any fill-behinds
that occur, in accordance with the Civil Service Rules and Regulations and the Policies of the County of Cayuga; and be it
further
RESOLVED, that this Resolution will take effect immediately and this authorization will be valid until December 31,
2026, in accordance with policy Resolution No. 307-20.
RESOLVED, that the Finance Director/Budget Director is authorized to make any necessary financial transfers to fund

WHEREAS, the Sr. Account Clerk position qualifies to be reclassified as non-competitive per the New York State
Department of Civil Service Hiring Emergency Limited Placement Program (HELP), and
WHEREAS, a New Position Duties Statement was submitted to the Cayuga County Civil Service Commission for
review, and the Commission agreed that the position of Sr. Account Clerk (HELP Program) qualifies for this program;
and classified the position as Non-Competitive pending submission to the New York State Civil Service Commission; and
WHEREAS, to participate in the HELP Program the newly classified non-competitive Sr. Account Clerk (HELP

Livescan and Mugshot System for biometric data collection, fingerprint capture, mugshot photography, electronic record
submission, and related criminal justice identification processes; and
WHEREAS, the RICI Plus system is a fully web-based livescan solution accessible through standard web browsers from
authorized workstations regardless of location, allowing staff to efficiently complete booking workflows including data
entry, photo capture, fingerprint capture, and electronic submission of records; and
WHEREAS, the maintenance and support agreement provides critical software updates, remote technical support,
hardware maintenance and replacement services, cloud storage services, and ongoing operational support necessary to
maintain compliance and uninterrupted law enforcement operations; and
WHEREAS, the agreement includes maintenance coverage for livescan workstations, palm scanners, cameras, signature
pads, associated biometric hardware, and the Annual Identity Services Platform Subscription utilized by the Sheriff’s
Office and Jail; and
WHEREAS, continued maintenance and support of the RICI Plus system is necessary to ensure the reliability, security,
and operational continuity of the County’s booking and identification systems; and
WHEREAS, DataWorks Plus, LLC has submitted a one-year renewal agreement at a total annual cost of $11,660.00; and
WHEREAS, the total cost of said renewal agreement is $11,660.00, to be paid from IT software budget account A16104
54018, and sufficient funds are available within the approved budget to support this purchase; and
WHEREAS, DataWorks Plus, LLC has extended pricing from the New York State Office of General Services group

reliability, security, compliance, and operational continuity of the County’s information technology systems; and

services for Cayuga County; and

Authorizing the Cayuga County Legislature to adopt the amended and restated Cayuga County Continuity of
Operations Plan (COOP) – Volume I for Cayuga County and adopts (COOP) Volume II for the Cayuga County
Departments

WHEREAS, New York State Executive Law Section 27 requires local Governments and Political Subdivisions to establish a
plan for Continuity of Operations / Continuity of Government in Emergency and Disaster (herein referred to as the “COOP
Plan”); and
WHEREAS, Cayuga County has provided for the continuity of County government in the event that a natural or man-made
disaster or other emergency prevents an elected County government official from performing his or her duties pursuant to Local
Law No. 2-2013; and
WHEREAS, in 2017, the County Emergency Preparedness Assessment (CEPA), conducted with Cayuga County officials,
State officials, and other stakeholders, identified the need for a COOP Plan to implement and assist with the continuity of
County government as established under the Local Law; and
WHEREAS, consistent with Local Law No. 2-2013, Cayuga County Legislature initially adopted a COOP Plan by Resolution
#299-18 in July 24, 2018, which set forth continuing operations, lines of succession, delegations of authorities, restoration of
vital services, continuing operations of civil and criminal justice systems, and predetermined resource needs (to include facility
needs); and
WHEREAS, the Cayuga County Office of Emergency Services, the Operations Officer, Cayuga County Department Heads,
and other identified critical staff, have reviewed the critical operations of County government, gathered the necessary
information, and have recommended necessary and appropriate revisions to update, amend and restate COOP Volume I and
update COOP Volume II Departmental Plans in order to reflect current services provided by the County, the relevant staff for
same, and to meet or exceed the set standards identified in Article 2B of the Executive Law; and
WHEREAS, the Cayuga County COOP Volumes I and II are the identified plans for the County’s operations in the event of an
emergency, including providing protections in the event of a domestic terrorist incident or other threat to the security of Cayuga
County and its residents, and therefore Volume I and Volume II shall be considered for Official Use Only and dissemination
limited to County officials; public safety representatives; and designated local, state, federal, tribal, and military officials with a
need to know to protect against any threatening individuals or groups who may use such information in a nefarious manner,
and;
WHEREAS, the edits to Volume I include adding the alternate County locations of 63 Genesee Street, and the Community
College and the edits to Volume II have designated laptops and take-home laptops as policy for employees operating in those
environments; and
WHEREAS, the amended and restated 2022 Cayuga County COOP Volume I and Volume II have been reviewed and now
updated in 2026 requiring revision for Volume I in 4 Years and Departmentally as needed; now therefore be it
RESOLVED, that the Cayuga County Legislature hereby adopts and restates the amended Cayuga County Continuity of
Operations Plan (COOP) Volume I and the finalized COOP Volume II Departmental Plans as this jurisdiction’s Continuity of
Operations Plan in its entirety; and be it further
RESOLVED, that the County Chairperson, County Operations Officer, County Office of Emergency Services, Department
Heads, and other stakeholders execute the actions identified in Volume I and II of the COOP Plan under its jurisdiction

WHEREAS, the Probation Department currently has a contract with Catalis for Caseload Explorer, the operating system
used in the Probation Department, and
WHEREAS, Caseload Explorer is currently hosted on our server, and
WHEREAS, we have found that automatic upgrades to the system and the overall operation of the system have been
limited due to us hosting, and
WHEREAS, Catalis hosting would include the following services:
•
Installation of Caseload Explorer and all County Probation data
•
Installation and configuration of all required NY State interfaces
•
On-demand database scalability
•
Remote access to Caseload Explorer outside of the County network without a VPN (assuming County
IT approval)
•
Disaster Recovery measures, including geo-replication of all databases to different regions, providing
data redundancy from any potential datacenter failure
•
Apply Windows/SQL Patches (weekly)
•
Disk cleanup (bi-weekly)
•
Re-boot (bi-weekly)
•
35-day Point-in-Time Recovery
•
Set up and Maintain SQL backups with a 7-day retention policy
•
Set up and monitor Database Maintenance plans to ensure database health
o Perform Index ReBuild (Monthly) and Index ReOrganize (Weekly)
• Monitor (CPU, Memory, and SQL Performance); Resolve Issues
o Real-time performance monitoring
• Install all New Releases, Versions, and Hotfixes (Standard)
o Including region-specific updates (i.e., Statute Imports for NYS)
• Verify Backups (Monthly)
• Security Audit (Monthly)
• Verify Billing (Monthly), and
WHEREAS, The Catalis Court & Land Records would provide this service at a prorated cost for year one of $583.00,
year 2 would be $3500.00 and year 3 would be $3710.00, and
WHEREAS, The Catalis Court & Land Record Contract Amendment has been reviewed in collaboration with the County
Attorney and the IT Department; and
WHEREAS, this agreement is to be paid for under account A16104 54018; now therefore, be it
RESOLVED, that the Chair of the Cayuga County Legislature is hereby authorized to execute the contract amendment
with Catalis Court & Land Record for Ce Analytics for Microsoft Azure Government Hosting Services & System
Administration for the term of the existing contract that expires June 30, 2029.

DWI Fill Stop DWI Coordinator
Authorizing the Chairman of Legislature to Fill STOP-DWI Coordinator

WHEREAS, there is a Part Time STOP DWI Coordinator position vacancy for Cayuga County (Position Control No.
002002-SYS) due to a resignation; and
WHEREAS, “Special Traffic Options Program for Driving While Impaired”, the STOP-DWI Program was created by the
State Legislature in 1981by Vehicle and Traffic Law § 1678- h , superseded by Vehicle and Traffic Law § 1197,
empowers counties to coordinate local efforts to reduce alcohol and other drug related traffic crashes; and
WHEREAS, the STOP-DWI Program reduce the number of persons killed or injured in alcohol and other drug-related
traffic crashes, promotes DWI prevention as a public priority, and coordinates local efforts in Law Enforcement,
Prosecution, Probation, Rehabilitation, Public Information, Education, and Administration; and
WHEREAS, the personnel committee approved the request to fill the Part Time STOP DWI Coordinator position at the
May 5, 2026 meeting; and
WHEREAS, the STOP-DWI (‘the Program”) functions as a financially self-sustaining alcohol and highway safety
program since the Program efforts are funded entirely from fines paid by convicted drunken drivers, no tax dollars are
used; now therefore be it
RESOLVED, the Chairman of Cayuga County Legislature be hereby authorized to fill the STOP DWI Coordinator
position at an hourly rate of $20.00, Part II Cayuga County Compensation Plan; and be it further
RESOLVED, that the STOP DWI Coordinator position be filled in accordance with Civil Service Rules and Regulations
and the policies of the County of Cayuga; and be it further

WHEREAS, this position is fully funded by the Union Springs Central School District; and

RIDE 4 FRIENDS, INC. to increase the hourly rate for Peer Support Services and amend the budget relative to
funding for this service amending Resolution No. 207-24.

WHEREAS, NICK'S RIDE 4 FRIENDS, INC. is a duly organized non-profit organization that provides peer counseling,
treatment, education, vocational assistance and related support services to assist with the treatment of substance abuse and
substance dependence; and,
WHEREAS, pursuant to Resolution No. 207-24 the Sheriff currently contracts with Nick’s Ride to provide Peer Support
Counseling to the incarcerated population within the Cayuga County Jail for a maximum number of 20 hours per week at a
rate of $26.00 per hour; and,
WHEREAS, funding to pay for Peer Support Counseling in the jail exists in the Sheriff – Jail Professional Services budget
line A31504-54059; and,
WHEREAS, due to the increasing costs associated with offering peer support services in the Cayuga County Jail, Nick’s
Ride 4 Friends, Inc. is requesting an increase of their hourly rate to $27.00 per hour to cover their costs, now therefore be it
RESOLVED, that the Chair of the Cayuga County Legislature and the Sheriff be authorized to amend and sign the contract
with Nick’s Ride 4 Friends to provide Peer Support Services in the jail at an increased cost of $27.00 per hour upon approval

SHR CLPS Contract Amend rev
AUTHORIZING THE CHAIR OF THE CAYUGA COUNTY LEGISLATURE AND THE CAYUGA COUNTY
SHERIFF TO ENTER INTO A CONTRACT WITH CLPS LLC (CLPS) TO PROVIDE A THREAT ASSESSMENT
AND MANAGEMENT SOFTWARE PLATFORM THAT WILL BE UTILIZED BY THE CAYUGA COUNTY
BEHAVIORAL THREAT ASSESSMENT AND MANAGEMENT TEAM AND AREA SCHOOL DISTRICTS.

WHEREAS, in 2022 the Cayuga County Sheriff’s Office, in partnership with Cayuga County Mental Health, formed a
multidisciplinary Behavioral Threat Assessment and Management Team to address threatening behaviors in our
community and to address individuals that are on a potential pathway to commit violence that has addressed over 150
cases, primarily connected to our area schools, to date since the team’s development; and
WHEREAS, the NY State Division of Homeland Security & Emergency Services has established the
Domestic Terrorism Prevention Grant Program to allow counties, including Cayuga County, to apply for
funding to administer their Domestic Terrorism Prevention Plans in accordance with Executive Order 18 which
will reimburse the County for costs related to administering our local plan; and
WHEREAS, the Cayuga County Behavioral Threat Assessment and Management Team is seeking to
implement a threat assessment and management software platform that will allow the team to effectively assess
and manage cases in close partnership with our area schools, the members of the multi-disciplinary team, and
our community pursuant to our Domestic Terrorism Prevention Plan; and
WHEREAS, CLPS is a sole source provider of a threat assessment and management software platform (“TAMSP”) that
is designed to allow for effective assessment and management of threat cases by multidisciplinary teams, schools, and
the broader community; and
WHEREAS, on April 28th, 2026, the Cayuga County Legislature passed Resolution Number 178-26 authorizing the
Chairman of the Legislature and Cayuga County Sheriff to contract with CLPS to provide said platform and licensing to
Cayuga County for use by our local Behavioral Threat Assessment and Management Team in partnership with our area
schools at a cost of $43,450 annually; and
WHEREAS, since passing the Resolution the Cayuga County Sheriff was able to renegotiate a lower cost for said
platform and licensing by eliminating additional public safety technology that would have been provided by CLPS to
area school districts at the original cost but would not be utilized in the behavioral threat assessment process; and
WHEREAS, CLPS can provide their threat assessment and management software platform (“TAMSP”) and licensing at
a cost of $16,500.00 for one year; and
WHEREAS, the NY State Domestic Terrorism Prevention Grant can be utilized to fully fund the purchase and annual
cost of the CLPS threat assessment and management software platform; now therefore be it
RESOLVED, that the Chairman of the Legislature and the Sheriff be authorized to sign the necessary documentation to enter
into a contract with CLPS after review by the County Attorney and approval as to form to purchase and implement a threat
assessment and management software platform at a cost of $16,500.00 for a contract term of one year that will be used by the
Cayuga County Behavioral Threat Assessment and Management Team in partnership with our area schools; and be it further
RESOLVED, funding from the NY State Domestic Terrorism Prevention Grant Program will be utilized to fully fund the
purchase and licensing; and be it further
RESOLVED, that the Finance Department is authorized to make the journal and accounting entries required to implement the
intent of this Resolution; and be it further

Authorize the Chair of the Cayuga County Legislature to execute an approved 2025-2026 Statewide Targeted
Reductions in Intimate Partner Violence (STRIVE) grant award to the Cayuga County Sheriff’s Office in the amount
of $19,000.00 and amending 2026 Budget

WHEREAS, the Sheriff’s Office has been awarded grant funding in the amount of $19.000.00 from the New York State
Division of Criminal Justice Service for the 2026-2027 Statewide Targeted Reductions in Intimate Partner Violence
(STRIVE) grant; and
WHEREAS, the Division of Criminal Justice Services requires that jurisdictions budget funding for specific strategies,
staffing and agencies to enhance the effectiveness of their STRIVE program with necessary funding, guidance and
training to directly respond to, mitigate, and prosecute intimate partner violence through evidence-based, survivor
sentenced, trauma informed, and culturally responsive interventions; and
WHEREAS, the grant funds will be used for staffing and training within the Sheriff’s Office; now therefore be it
RESOLVED, that the Chair of the Cayuga County Legislature and the Cayuga County Sheriff be authorized to sign the
necessary documentation to accept the STRIVE funding; and be it further

Authorizing a contract extension with Pitney Bowes for mailing equipment and related services for the
Cayuga County District Attorney’s Office

WHEREAS, the Cayuga County District Attorney’s Office utilizes mailing equipment and related services
provided by Pitney Bowes; and
WHEREAS, Pitney Bowes has offered to continue providing such equipment and services pursuant to a five (5)
year contract extension at a total cost of $4,848.00, payable in quarterly installments of $242.40 ($80.80 per
month); and
WHEREAS, sufficient funds for these services are included in the 2026 Cayuga County Budget; now, therefore,
be it
RESOLVED, that the Cayuga County District Attorney is hereby authorized to execute a five (5) year contract
extension with Pitney Bowes for the provision of mailing equipment rentals and related services; and be it further

SHR-Leave Bank June 2026
Authorizing the creation of a temporary leave bank for a Cayuga County Sheriff’s Employee

WHEREAS, an employee of the Cayuga County Sheriff’s Office is out of work due to illness; and
WHEREAS, this employee has worked for Cayuga County since August 23, 1998, and due to this illness will
have exhausted all leave time accruals as of June 30, 2026; and
WHEREAS discussion has occurred over this issue with representatives of the County and SEACC and both
parties have agreed to allow for the creation of a temporary leave bank at the request of fellow employees to
address the immediate loss of income for the employee;
therefore be it,
RESOLVED that the Cayuga County Legislature hereby approves this temporary leave bank (subject also has
approval of the SEACC officials); and be it further
RESOLVED, that the Cayuga County Legislature authorizes and directs all those steps that may be required to
undertake this temporary leave bank in accordance with the following conditions:

All County employees may be permitted to donate personal, vacation, or compensation time in no less
than half-day increments, at any amount up to a grand total of ninety-five workdays.

Authorizing the Chair of the Cayuga County Legislature to Execute a Professional Services Agreement with
Pracademic Partners for Organizational Assessment, Advisory Services, Search Preparation, and Executive
Recruitment Services Related to the County Administrator Position

WHEREAS, the Cayuga County Legislature has identified the need to evaluate the County's administrative structure and
assess the feasibility, implementation, and long-term success of a County Administrator position; and
WHEREAS, the Legislature recognizes the importance of conducting a comprehensive review of County operations,
management practices, organizational structure, communications, governance, and administrative functions in order to
support informed decision-making regarding the creation and implementation of such position; and
WHEREAS, Pracademic Partners, through its Founder and President, Dr. Ian M. Coyle, ICMA-CM, possesses extensive
experience in county government administration, organizational assessment, executive leadership development, strategic
planning, and executive recruitment services; and
WHEREAS, Pracademic Partners has submitted a proposal to provide organizational assessment, advisory services,
leadership training, search preparation services, and executive recruitment services designed to assist the County
Legislature in evaluating organizational needs and conducting a professional recruitment process for a County
Administrator position; and
WHEREAS, Phase 1 of the proposed engagement consists of Organizational Assessment, Advisory Services, and Search
Preparation at a cost of Ten Thousand Dollars ($10,000) per month for approximately three (3) months and includes
management consulting, leadership training, organizational assessment, policy and procedure review, meetings and
training with legislators and department heads, written recommendations and assessments, and periodic reports to the
Legislature regarding findings, activities, and recommendations; and
WHEREAS, Phase 2 of the proposed engagement consists of a full-service executive search for the County Administrator
position at a cost of Twenty-Two Thousand Five Hundred Dollars ($22,500), including position development, candidate
recruitment and sourcing, applicant screening, interview process management, and appointment support; and
WHEREAS, Phase 3 of the proposed engagement consists of post-hire executive coaching and transition support services
at a cost of One Thousand Five Hundred Dollars ($1,500) per month, which services are not being authorized by this
resolution and may be considered by the Legislature at a later date; and
WHEREAS, there are sufficient funds available in Account No. A12301 51001 Salaries
to fund the services authorized herein; and
WHEREAS, the Legislature has determined that obtaining these specialized professional consulting and recruitment
services is in the best interests of Cayuga County and will assist the County in evaluating and implementing
organizational and administrative improvements; now, therefore, be it
RESOLVED, that the Chair of the Cayuga County Legislature is hereby authorized and directed to execute a professional
services agreement with Pracademic Partners for Phase 1 Organizational Assessment, Advisory Services, and Search
Preparation Services and Phase 2 Executive Recruitment Services, at a total cost not to exceed Fifty-Two Thousand Five
Hundred Dollars ($52,500), subject to review and approval by the County Attorney as to form; and be it further

expiration date of July 1, 2024, the expanded use of videoconferencing by public bodies in the conduct of open
meetings, under extraordinary circumstances, regardless of a declaration of emergency; and,
WHEREAS, April 2024 Governor Hochul signed and enacted the State Fiscal Year Budget which, in part extend
the use of videoconferencing by public bodies in the conduct of open meetings, under extraordinary circumstances
for an additional two (2) years, until July 1, 2026; and
WHEREAS, on May 28, 2026, Governor Hochul signed and enacted the State Fiscal Year Budget which, in part
extended the use of videoconferencing by public bodies in the conduct of open meetings, under extraordinary
circumstances for an additional two (2) years, until July 15, 2028; and,
WHEREAS, in order to continue meeting virtually, the County must pass a local law to extend Local Law 4 for
the year 2022 which opted in to the use of videoconferencing; and,
WHEREAS, there has been duly presented and introduced at a meeting of this County Legislature held on June
23, 2026, a proposed local law entitled:

CONTINUE THE AUTHORIZATION FOR VIDEOCONFERENCING FOR PUBLIC MEETINGS
FOR TWO YEARS, UNTIL JULY 15, 2028.
Be it enacted by the Cayuga County Legislature of the County of Cayuga, as follows:
Section 1: LOCAL LAW NO. 4 FOR 2022, A LOCAL LAW TO AUTHORIZE VIDEOCONFERENCING FOR
PUBLIC MEETINGS, is hereby amended to add a new Section 7, as follows:
SECTION 7: Expiration:
This Local Law shall be effective until July 15, 2028
Section 2. Said LOCAL LAW NO. 4 FOR 2022, A LOCAL LAW TO AUTHORIZE VIDEOCONFERENCING
FOR PUBLIC MEETINGS, shall remain unchanged in all other respects and are hereby so ratified.
Section 3. This Local Law shall take effect immediately upon its filing with the Secretary of State.
Purpose:
The Cayuga County Legislature intends this Local Law to authorize the use of videoconferencing under certain
circumstances, to conduct public meetings pursuant to Section 103-a of the New York State Public Officers Law.
SECTION 2: Applicability:
A. This Local Law and the procedures outlined herein shall apply to all meetings of the Cayuga County
Legislature including all committees and sub-committees.
B. All other boards or agencies of the County that are subject to the Open Meetings Law may determine for
themselves the extent to which they wish to allow videoconferencing to conduct meetings and, if so, may
adopt appropriate resolutions to that effect.
SECTION 3: Attendance Requirements:
A. Members of the governing board shall be physically present at meetings, and committees unless unable to
be physically present at the meeting due to “extraordinary circumstances” which are defined as follows:
1. Disability,
2. Illness,
3. Caregiving responsibilities which may include caring for a child, spouse, parent, grand-parent, grandchild, sibling, partner, or significant other, due to illness or disability;
4. Temporary travel outside the County,
5. Any other significant, unexpected event that prevents the member from attending the meeting in
person.
B. A member who is unable to be physically present at a meeting, shall provide notice to the Cayuga County
Legislative Clerk’s Office at least 24 hours prior to the meeting or as soon as reasonably able.
C. The Chair of the Cayuga County Legislature’s determination on whether the extraordinary circumstances
cited by a board member qualifies under this Local Law to permit that member to participate in a
legislative meeting shall be final and binding.
D. The Chair of a Standing Committee’s determination on whether the extraordinary circumstances cited by
a committee member qualifies under this Local Law to permit the committee member to participate in a
committee meeting shall be final and binding.
E. The Chair of the Legislature, or in the case of a Standing Committee, the Chair of the Committee, shall
announce at the beginning of the meeting the names of the members who are participating remotely and
identify them for the record.
F. Only those members who are present at the meeting or have been permitted to attend remotely pursuant
to the procedures of this Local Law shall count towards a quorum or be permitted to vote on any matter
that comes before the board/committee.
G. Except in the case of executive sessions, all members of the board/committee, including those who have
been permitted to participate remotely, shall be capable of being seen, heard and identified throughout the
meeting being conducted.
SECTION 4: Other Requirements:
A. If video conferencing is used to conduct a meeting, the public notice shall inform the public where they
can view and/or participate in such meeting, where required documents and records will be posted or
available, and identify the physical location for the meeting where the public can attend.
B. Minutes of any meeting involving videoconferencing shall include which, if any, members participated
remotely.
C. Meetings conducted using videoconferencing shall be recorded and those recordings shall be posted or
linked within five (5) business days of the meeting and maintained for 5 years thereafter. Recordings shall
be transcribed upon request.
D. In those meetings where videoconferencing is used, the public must be able to view the meeting via video
and participate in the proceedings via videoconference in real time and to testify or present in the same
manner as they would be permitted to participate pursuant to the Cayuga County Legislature Rules of
Order, or under State or local law.
E. The in-person participation requirements of this Local Law shall not apply during a state disaster
emergency declared by the governor or a local state of emergency as declared by the chief executive of
the county if it is determined that the circumstances necessitating the emergency declaration would affect
or impair the ability of the board/committee to hold an in-person meeting.
F. These written procedures shall be conspicuously posted on the County’s website.
SECTION 5: Effective Date:
This local law shall take effect immediately upon filing with the Secretary of State.
SECTION 6: Severability:
If any clause, sentence, paragraph, subdivision, section or part of this Local Law or the application thereof, to any
person, individual, corporation, firm, partnership, entity, or circumstance, shall be adjudged by any court of
competent jurisdiction to be invalid or unconstitutional such order of judgement shall not affect, impair, or
invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph,
subdivision, section or part of this Local Law or in its application to the person, individual, corporation, firm
partnership, entity, or circumstance directly involved in the controversy in which such judgment or order shall be
rendered.
SECTION 7: Expiration:
This Local Law shall be effective until July 1, 2024 as set forth by New York State in Chapter 56 of the Laws of
2022.
