<p data-pasted="true">Over the past year, the Board has discussed constructing a centrally located Public Safety Building near the intersection of Wards Road and Colonial Highway. The timeline details are in the attached memorandum. Construction of the Augusta Springs development is well underway, and the next phase to be constructed is adjacent to the proposed Public Safety facility site. Since the Public Safety facility preliminary plan shows it connecting to the Augusta Springs development with a driveway, utilities, and stormwater discharge, it would provide better coordination if we had a grading plan developed. This could be shared with the engineer preparing the plans to ensure there would not be any future conflicts when a facility is constructed on this site.</p><p><strong>RECOMMENDATION: Staff recommends that the Board authorize staff to conduct a topographic survey and develop a grading plan to share with the Augusta Springs design engineer. </strong></p><p><br></p>

Rogers, County Administrator</u></p><p data-pasted="true">Attached is the public notice for a joint public hearing with VDOT on the proposed Six-Year Plan for secondary road improvements. The current plan includes improvements scheduled for Fiscal Years 2027 through 2032. Attached are the proposed Six-Year Plan and proposed resolution for adoption following the public hearing.</p><p>Robert Brown, Appomattox Residency Administrator, will represent VDOT at the public hearing. During the public hearing, citizens will be invited to provide comments on the Six-Year Plan and to request road improvements or road additions to the Secondary Road system. </p><p><strong>RECOMMENDATION: Staff recommends the Board conduct the required public hearing and adopt the attached resolution to approve the Six-Year Plan for the years FY2027-2032.</strong></p><p><br></p>

<h2 class="title">PUBLIC HEARING - TRANSIENT OCCUPANCY TAX USAGE</h2>

<p><u data-pasted="true">F.E. “Tripp” Isenhour, III, County Attorney</u></p><p data-pasted="true">The Board of Supervisors authorized staff to pursue increasing the Transient Occupancy Tax in the County from 2% to 7%. State Code provides that Transient Occupancy Tax greater than two percent (2%) but less than five percent (5%) levied upon on lodging within the County be designated specifically to be “designated and spent solely for tourism and travel, marketing of tourism or initiatives that, as determined after consultation with the local tourism industry organizations, including representatives of lodging properties located in the county, attract travelers to the locality, increase occupancy at lodging properties, and generate tourism revenues in the locality.” Va. Code § 58.1-3819(A)(2). </p><p>The Code’s requirement to “engage representatives of lodging properties located in the county” has been met by the recent meeting at the Citizen Services Building located within the County at 85 Carden Lane, Rustburg, VA 24588, held on April 28, 2026. Members of County Economic Development and Administration staff advertised the meeting broadly through internet postings and direct contact through Economic Development contact lists. The staff members met with a number of representatives and compiled the attached notes reflecting feedback from that meeting. </p><p>The Code’s requirement to consult “with the local tourism industry organizations” was more difficult, as there are no such organizations hosted within Campbell County. The Code does further provide, however, that “if there are no local tourism industry organizations in the locality, the governing body shall hold a public hearing prior to making any determination relating to how to attract travelers to the locality and generate tourism revenues in the locality.” In order to comply with this requirement, staff published notice of a public hearing at the May 5, 2026 meeting to consider the public’s input on the topic.</p><p><strong>RECOMMENDATION: Staff recommends that the Board conduct the public hearing and receive public input. There is no action requested or expected at this meeting; rather, notice of an intent to adopt ordinance changes consistent with the Board’s direction as shaped and guided by public input will be published for hearing on June 2, 2026.</strong></p><p><br></p>

<p data-pasted="true">This request is from Stuart Squier of GDN Properties for Verizon Wireless, agent for Steve Moorman, for a special use permit for the property located at 10566 Brookneal Highway and further identified as tax map parcel 74-5-2A to allow for a telecommunications tower. The property is located in the Brookneal Election District. As per the Comprehensive Plan, the property is located in an area designated as transitional.</p><p>The applicant is seeking to construct a 135 ft. steel monopole communications tower with a 4 ft. lightning rod for a total height of 139 ft. The monopole would be utilized by Verizon Wireless to address a coverage gap. The applicant will be leasing an approximately 10,000 sq. ft. area from the property owner for the purpose of constructing and operating the tower.</p><p><strong>RECOMMENDATION: The Planning Commission recommended approval of the request with the staff-recommended condition that the applicant utilizes the site in conformance with the use described in the narrative and shown on the site plan submitted with the request, and the condition that lights be added to the structure, by a vote of 7-0.</strong></p><p><br></p>

Previously, Data Centers were allowed by-right in Industrial Heavy Zones. In December 2025, the Board adopted an emergency ordinance making Data Centers a special use only use in Industrial Heavy, which emergency ordinance was subject to review and readoption within 60 days. The Board reviewed the question, making permanent the proposed change to Industrial Heavy zones as a regular ordinance following ordinary publication at its January 6, 2026, meeting. Following that hearing, the Board adopted a time-limited ordinance making Data Centers a special use only use in Industrial Heavy zones for a period of 120 days only, with the recognition that the language would revert back to the pre-December 2025 language of by-right use in Industrial Heavy if no action was taken. Following a work session on April 14, 2026, the Board directed staff to advertise an ordinance making Data Centers a special use only use in Industrial Heavy zones as a normal, non-time-limited ordinance. At its April 27, 2026, meeting, the Planning Commission voted 4-1 to recommend approval of the Code update to change data centers to a special use permit in the Industrial Heavy zoning district.</p><p><strong>RECOMMENDATION: Staff recommends that the Board review the Code change requested and conduct the necessary public hearing required to take action on the list of proposed change to the County Code. Following the public hearing, the Board should consider taking such action as the Board may direct. </strong></p><p><br></p>
